MUMBAI, MAIL NO. 2016/41OF 23.04.2016
CAMP: SAN FRANCISCO (U.S.A.)GOOD NEWS TO ALL CRS BANK EMPLOYEESDEAR FRIENDS,SPECIAL LEAVE PETITION filed by Punjab & Sind Bank in Supreme Court against pension option to CRS retirees stand dismissed by the Supreme Court as per the Supreme Court Order attached.
Copy of judgement is posted below......................
Now let us hope that CRSBank employees will get justice soon by extending second/another pension option to them, which was denied on account of 9th bipartite settlement/agreement.Let us also hope that Bank Resignees and all left out Bank employees will also get justice by extension of pension option to them at the earliest by upholding principles of natural justice and equity.with best wishes,
Dear All,It is a good heartening news that Hon'ble Supreme Court has dismissed the SLP filed by Punjab & Sind Bank and thus Compulsorily Retired Officer, Mr Surinderjit Singh, is entitled for retiral dues such as Pension, Leave Encashment, etc.It is hereby mentioned that Canara Bank has filed three SLPs ( C ) No 28315, 26623 & 30252 of year 2011 and Hon'ble Supreme Court on 25th Aug, 2015 has dismissed all these three SLPs of Canara Bank along with three other SLPs of OBC, PNB and Syndicate Bank and the Judgement of Hon'ble Supreme Court has made the Compulsorily Retired Officers entitled for payment of retiral dues such as Pension and Leave Encashment, etc.But the Banks are not taking cognizance of these Judgements and are not deciding for payment of retiral dues to the Compulsorily Retired Officers in the similar placed cases. Thus the concerned General Managers, Executive Directors and CMDs of the banks be blamed for contempt of Orders of Hon'ble Supreme Court. They should be charge-sheeted and given the punishment of Compulsory Retirement. Then they will realise the pains of the sufferings of the Compulsorily Retired Officers who are struggling to get payment of their legitimate retiral dues for such a long time.In my case I am struggling to get payment of my retiral dues for last more than seven years. I have come to know that one Mr K R Narayanan is suffering to get his retiral dues even for more number of years as he is around 70 years now and has not got his legitimate retiral dues. There are many others like Mr PNP Haran, who are yet to receive their legitimae retiral dues.Non payment of retiral dues have put these compulsorily retired officers in many untold financial, mental and social sufferings. They are not in a position of living a dignified life. When these officers have worked for their respective beloved banks and for some mis-doings/lapse, they have been placed under Compulsory Retirement, they have got one punishment. Now they are going through undecided other punishment of not getting the payment of their respective legitimate retiral dues. Non payment of their retiral dues have made them to live a life of neglected person in the society. This is against the Natural Justice.Their should be pragmatic and humanitarian approach and the already suffering compulsorily retired officers should not be dragged to other problems. If the payment of retiral dues are not received during the life time, then what is the use if such payments are made after the extinguishment of that hapless retired officer. Will the concerned authorities in the banks, leaders of the retirees associations/unions look into cases of compulsorily retired officers ON PRIORITY and take action that legitimate retiral dues are paid to the concerned retired officers without any inadequate delays.Hope good sense will prevail upon on the concerned and we, the hapless compulsorily retired officers will get redressal of our grievances and will get payments of our legitimate retiral dues.R K Sehgal, 91-9990217028, sehgal...@yahoo.com

Mr Bhullar
May i correct you in what you have said.
This is not the first SLP to be dismissed by Hon SC.In Jan 2015, 2 review petitions filed by Andhra Bank bearing No 34889, 35449 of 2013 were dismissed by Hon SC.
I regret to point out that except for writing couple of formal letters, none of the unions have pursued the matter with IBA.
Had it been taken in all seriousness by retiree organisations and more particularly by UFBU,the matter would have been settled by now.
I don't know whether you know Mr Surenderjit or not but i know him very well. He is a poor man struggling to meet both ends. I arranged for filing of his caveat both in HC and SC,which has resulted in quick decision of his case.
I trust at least now you people will come forward to help other similarly placed officers to get their legitimate dues.
Regards

Immediately after getting the text of the Supreme Court order against the SLP filed by the Management of Punjab 7 SIndh Bank, we have taken up the issue with our Management. As the Supreme Court judgement is petitioner specific our Bank has written to IBA about the implications of the judgement. You are aware of the fact that every bank will act on the advice of IBA in such matters. We are awaiting the response of the heartless IBA.In the meanwhile, our apex organisation AIBPARC is pursuing the matter with IBA. We have prevailed upon the leadership of AIBOC also to mount presuure on IBA in the background of the Supreme Court setting aside the SLP of P&S Bank against the orders of the High Court of Punjab & Haryana High Court. We are following up the matter with all seriousness and we will keep you informed of the further developments. Kindly bear with us for some more time. With best wishes and regards.Yours sincerely,K B BallurGeneral Secretary
