Judiciary for pensioners and importance of 17th Dec - Pensioners' Day

"Pension is neither a bounty, nor a matter of grace depending upon the
sweet will of the employer, nor an ex-gratia payment. It is a payment
for the past services rendered. It is a social welfare measure
rendering socio-economic justice to those who in the heyday of their
life ceaselessly toiled for the employer on an assurance that in their
old age they would not be left in the lurch" These are the words of
Late Justice Y.V. Chandrachud, then Chief Justice - Supreme Court of
India, in the landmark judgement given in famous Nakara's case on
pension.
The judgement was delivered on 17/12/1982. The judgement came a magna
carta for the pensioners. It is a landmark in the evolution of the
pension structure for past pensioners and the history of pesioners'
movement. It gave pensioners a new lease of life. It provided
inspriration, strength and optimism amongst pensioners. It also
brought good respectable status for the pensioners in India. Thereupon
a large number of pensioner associations sprang up in India. The
Judgment brought an awareness in the mind of Government, and it
realized that it cannot ignore the pensioners any more. That is why
17th December every year is celebrated all over India as "Pensioners'
Day".

The following are the true facts:


Bank pension is paid only on 1st of each month.  If 1st happens to be a holiday, it will be paid on the next working day   Some times, we may get the pension on 3rd day of the month.  But, state and central govt. pensioners can draw it four days earlier to the last working day except March 2009. 


No updation of pension.  But, all other industries including State and Central Governments update the pension punctually. 


The loud talk of 5 years notional service to VRS optees have been paid in only few banks.  Majority of the Banks have not paid the arrears for different reasons.  There is a blank on the face of the Pensioner.


The 50% pension that should have been paid from 1.4.98 or from the respective date of retirement, was paid only from 1.5.2005 stating that financial constraints of the banks wont permit them to pay the arrears etc.,   No commutation was also paid.  


The pensioners must be happy with paltry raise in Dearness relief at half yearly intervals.


There are many cases pending in court questioning the legality of these anomalies and one should be happy by reading the news and nothing more.   Many have already passed away.  

The much publicised pension for PF Optees will only be payable from certain future date.  


These are the harsh and true facts. Kindly discuss and do needful on these things.  


Above all, Dearness allowance or relief must be neutralised.  


There are about 4-5 different scales of Dearness relief and basic pension being paid to pensioners.   


We all know one thing for sure:  All pensioners who are drawing pension now have to spend similar amount for their day to day living.  All pensiners have to live in dignity and peace of mind and should not worry for at least two square meals a day and to buy at least few clothes out of the pension.  If no revision happens, how can they afford to meet the expenses?
