Sir,

I came across the following mail in Bankpensioners@googlegroups:



Friends recently i came across  a news  in ALL INDIA EX-SERVICEMEN JOINT ACTION FRONT(SANJHA MORCHA) that there is  a  SC civil  case  judgement   1123 of 2015   regaring updation and   fixing  pension at  not less than  50 %  of BP.   please go through      Canara bank  retired officers association circular  03/2016 dated august,2015.   I am  surprised why our  retired associations  not  taken up the matter with IBA .    Kindly check up the   civil  case & also  the circular .-

I will be much glad if any one in this will arrange to forward the referred Circular 03/2016.  I would like to send it to SBI Pensioners Federation as it may help them in Delhi High Court Case W.P.(C) 1875/2013 for which arguments are scheduled during second week of Aug 2017.

The news regarding this Judgment has appeared number of times in this forum and Facebook in Past. The Judgment may not be applicable to us.

It is Civil Appeal 1123 of 2015 in Supreme Court.  Kindly go through the judgement thoroughly. 

 It has relied upon DS Nakara case( which has been cited in Canara Bank case also). 

 Further, it is not fixation of pension at NOT LESS THAN 50%.   The said judgement reiterates fixation of pension NOT less than 50% of the initial basic pay in the new scale of pay for the relevant grade.  That means, if the same yardstick were to be applied in respect of bank pensioners, the gross pension drawn by an existing pensioner who retired in scale-1,  SHOULD NOT BE less than 50% of starting stage of new basic pay for scale-1 plus DA thereo
