The Supreme Court of India on Thursday observed that it will decide the issues of Pay Scales and pensionary/retiral benefits of the Subordinate Judiciary on a priority basis, considering the long pendency of these two issues.

What about Bank Pensioners  , 
left in the lurch in life long lamentation?

PSBs recorded net profit of 31,820 crore in FY 2020-21, highest in last 5 financial years, the state-owned banks' top officials told Finance Minister Nirmala Sitharaman today. She was informed that PSBs are "adequately capitalised" and their CRAR as on September 2021 stood at 14.4%, against regulatory requirement is 11.5% (including CCB).

Then why don't you take care of bank pensioners' needs, 
at least now?

A cursory glance at the last Report of Trends & Progress of banking reveal that net profit , spread etc of public sector banks have shown an uptrend over previous years ( profit for 2020-21 Rs 31000 cr) and the wage bill constitute only 15.4% of the total operating expenses which works out to Rs.1.26 crore. The ratio of retired pensioners to serving employees is roughly 36%. While no specific information about bank pensioners expenses is not available in the public domain,it is certain that  50 % increase on account of updation from the current level of pension will be around 22680 cr for psb pensioners. It will erode profits to a certain extent but still the bank will be able to be in the blue The cost is not a constraint. The constraint is in the mind space of the bank managements.

The 66th AGM of Bharat Pensioners Samaj unanimously resolved that the legitimate benefits to pensioners of DoP&T’s 2009 Orders of NF Upgradation should not be denied to pre-2006 retirees, if they are otherwise eligible. Since the pensioners, irrespective of the date of their retirement, constitute ONE INDIVISIBLE GROUP, the benefits accruing to post-2006 are legally available to pre-2006 pensioners”.

Justification.

"From time to time, the Apex Court has repeatedly clarified in their Judgements that benefits of any Scheme introduced by Gov’t. are Equally applicable to All pensioners(as they constitute One Single Indivisible Group), irrespective of the dates of their retirement. What is admissible to post-2006 pensioners should, therefore, be admissible to pre-2006 pensioners, too.

Further, the denial of legitimate benefits to pre-2006 pensioners also infringes the Sacred Principle of modified parity, uniformly adopted by the Gov’t., w.e.f. 1.1.96. Moreover, in this particular case, the Gov’t. have specifically mentioned the admissibility of 2009 Orders also to pensioners, vide DoP&T No. A14017/64/ 2008- Estt.(PR) dated 25.9.2009, with a view to make doubly sure that the existing pensioners are not ignored."

Is not the Apex Court 's  basis of judgements quoted here

 e. Pensioners Constitute one single Indivisible Group, etc  applicable to Bank pensioners? 

How long do we have to suffer such blatant towering 

anomalies?

If any doubt still persists, it is requested that a reference be made to DoP&T to get their confirmation, once for all, that their 2009 Orders of NF Upgradation are Equally applicable to pre-2006 Retiree officers of ‘Organised’ Central Services, if otherwise eligible. This is essential as the matter affects many pre-2006 pensioners of various ‘Organised’ Central Services(including the Survey of India), who are being currently denied their Rightful dues.

What a blatant agonizing irony! 
For pension Updation, lot of mind boggling , wayward, weird quixotic, obsolete rules, regulations, principles, policies, lack of funds what not  ! 
But for MPs, MLAs no such things  !

Can somebody answer the following questions ?
1. Can you legally proceed against the FM for giving a false promise?
2. Can you file a case against Mallikarjuna Rao for failing to submit a report as chairman of the committee?
3. Can you book IBA for not implementing court orders and ignoring pleas of pensioners ?
4. Can you file a case against UFBE for breach of trust ? pensioners ?

Given the time consumed by court in deciding cases , it will be years and years before pensioners are rendered justice. By that time , yhe pensioners would no longer remain mortal.

Forget , court cases. Persuasion and follow up with the FM is the only option. Let us forget the rest in our own interest.

Let me answer your questions: 

1. Can you legally proceed against the FM for giving a false promise?

There is no contract between us and the FM and she has not given any promise (in legal terms) to anyone. So if you try to file any case, it will be rejected at the admission stage itself. 

2. Can you file a case against Mallikarjuna Rao for failing to submit a report as chairman of the committee?

You do not have any contract with  Mallikarjuna Rao. He was not your servant and you were not his master. You are nobody in this case. Hence you do not have any locus standi here and hence you cannot proceed against him 

3. Can you book IBA for not implementing court orders and ignoring pleas of pensioners ?

IBA will always implement the final orders. If they do not implement any order, then they could have gone on appeal. Moreover the court orders are to individual banks and IBA will always escape as it is not a party to any case. It will also plead that it is only representative body. 

4. Can you file a case against UFBE for breach of trust ? pensioners ?

Again you do not have any privity of contract with UFBU. 

So what can be done?

1. If the government wants to give us something, then nobody can stop it. Hence it is important to convince the government Babus that we deserve pension updation, DA hundred percent neutralization etc. 

2. To support our case, we need the support of all. So let us not unnecessarily criticize any segment (Unions, Banks, IBA officials, Government functionaries)

3. If the Unions are interested, they can also solve this in no time. But they have their priorities. They may take up our case. But only after their other issues are addressed. They have some limited ammunition only  nowadays. Their strike action cannot be effective. Their threat to the government is not  effective. So with limited resources first they will try to solve their problems.
