bankpensioner enhanced gratuity -effective date

can any one inform me that the enhanced gratuity is applicable in banks also or not w.e.f. from 01.01.2006/or wef from 01.01.2007 like wise applied to central govtt employees/public enterprises....what union people r doing in this regard? a stich in time saves the nine....now they r keeping quiet.....and after implementation they will persue to make it effective from 01.01.2006.....perhaps they have written a letter to finance minister to make it effective from 01.01.2006.....but have not persued the matter there after....if i m correct...

As per bank's Gratuity Rules, workings will be done as per Bank's Provision for payment and also as Per Gratuity Act and the amount payable is the higher one.  When Gratuity Act is amended and higher sum with ceiling of Rs.10 lakhs is payable, the benefit has to come to the employee.  In case the payment is not made, petition can be given to the concerned ALC ( C).   There is no need for Unions to seek the benefit of enhancement as it will generate an impression that bankmen are not entitled to it.     The right way according to me  is to sit quiet and prefer a claim through ALC(C) if banks do not pay the benefit.

my question is whether the persons retired between 01.01.06-to-04.05.2010 are eligible for enhanced gratuity....

Dear Sir..I took voluntary retiremwnr from bank of baroda in July 07 after 34 years of service.
I was paid grautity as per the formula which was higher..i.e. abt Rs 460000/
I would like to know if I will benefit from the revised ceiling and what is the formula to be applied.
Kindly let me know.

Shri Padmanabhan is not likely to get any further amount as already he has been paid Rs.4.60 lac. The rate at which gratuity is calculated has not been changed, as per the
assumption. I too received more than the pescribed limit of Rs.3.50 lacs in May 2008 and I feel that there can not be any enhancement to that.

mr u r wrong....
perhaps u do not know the formula by which gratuity is calculated...
u must have been paid gratuity bby formula of b.p only and not by b.p &d.a and month taken as 26 days subject to max of rs..3.50 lac..and the gratuit which ever is higher must have been paid to u....now after removal of celing of rs 3.50 lac ur gratuity by second formula should br more than first and such u must be entitled for higher gratuity provided notification by labur miinistry is done from retrospective date and u shold have retired there after
