Query regarding PNB Family Pension

Hello everyone!

My father retired from Oriental Bank of Commerce in 2014. At that time, the bank wasn't merged with PNB.

But, after the merger- he was withdrawing his pension from PNB only.

He passed away in October 2021 and me (his younger daughter) was eligible for the pension as I was unmarried, unemployed and below 25 years.

I did all the process and I started to get the pension from Dec'21 or Jan'22.

Now, all of a sudden I am told this year in March 2024 that since I'm above 25 years now, I won't be getting the pension.

Moreover, someone from the pension departement at the Circle office told that since I have been withdrawing pension even after I became 25 years, I would have to return the money.

This came as a shock to me and because of that I even stopped communicating with them.

All this happened back in March.

Since then I haven't got any pension.

Now, two days back I decided to look into it again. 

And I found in an article that one clause regarding family pension in the PNB Pension Regulations 1995 is changed.

Here I am quoting it:

"In regulation 40 of the said regulations, —

(a) in sub-regulation (1), —

(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:—

“Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees twelve thousand per month from employment in Government or private sector or self–employment:”;

Now I am confused. 

Can anyone please help me with this?

Madam,

As per Bank Employees Pension Regulations, 1995,the period of payment of Family Pension is defined as follows:
b)in the case of a son or daughter (including widowed/divorced) till he/she attains the age of twenty five years or upto the date of his/her marriage/remarriage, whichever is earlier: Provided the family pension payable to sons/daughters (including widowed/divorced) shall be discontinued/not admissible when the eligible son/daughter starts earning a sum in excess of( Rs. revised)   per month from employment in Government/private sector/self-employment, etc.

So stoppage  of pension seems to be in tune with regulations.

Regulation 40 is as follows: 

40. Period of Payment of family pension. 
(1) The period for which family pension is payable shall be, - 

(a)in the case of a widow or a widower, upto the date of death or remarriage, whichever is earlier; 

(b)in the case of a son or daughter (including widowed/divorced) till he/she attains the age of twenty-five years or upto the date of his/her marriage/remarriage, whichever is earlier: 

Provided the family pension payable to sons/daughters (including widowed/divorced) shall be discontinued/not admissible when the eligible son/daughter starts earning a sum in excess of Rs. 2550/- per month from employment in Government/private sector/self-employment, etc. 

Hence as a daughter if you have attained the age of 25 years, then further pension is not payable. 

Even if you have not attained the age of 25 years, if you are employed with salary of Rs.2550 per month, then also pension is not payable. 

It is logical that if you have received pension, for which you are not eligible, then it has to be returned.

Sir, though I am not very sure but  as per Central Govt. rules a dependent  divorcee daughter ( who is not earning) is eligible for family pension till her death.

Yes, that's written. I am aware of that.

But, my question is there is an amendment in the same clause (for which I have attached the official doc)- what does that mean?

Madam

As per Pension Regulations:

Provided the family pension payable to sons/daughters (including widowed/divorced) shall be discontinued/not admissible when the eligible son/daughter starts earning a sum in excess of Rs. 2550/- per month from employment in Government/private sector/self-employment, etc.

Only the above clause is amended by Gazette Notification. Not the condition on age of 25 years.

As per Amendmemt :

Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees twelve thousand per month from employment in Government or private sector or self–employment:”

Bankers are not covered under Central Govt pension rules

There is further amendment  for relaxation to mentaly and physically retarded children for family pension irrespective of age.
