Advice about scanning this academic year

Hi everyone,

As we are now in the midst of preparing for September, I have a question about scanning and copyright.  With the pandemic relaxation last year, we could scan, within reason, more than usual in order to facilitate online teaching.  Now that we've opened that Pandora's Box, faculty expect us to continue providing large scans of class reserve materials, etc. even though they'll be teaching in person.  Other than merely forwarding our copyright libguide, have any of you come up with a nicer way to disappoint faculty and students by explaining that we must return to following copyright more closely?  I know there'll be a lot of pushback on this.

Hello Ricky,
Do you have legal counsel at NEC that can provide some guidance? At Tufts, we have been in communication with counsel regarding various scanning and copyright scenarios. As long as campus reopens and there are in-person classes, counsel is not willing to support the library scanning of full books/scores, etc. that are in-copyright except for individual cases. If we return to remote learning due to the pandemic then we would go back to digitizing materials and serving them up through our CMS.

Have you reached out to any other conservatory libraries to see what their practice will be and/or what messaging they might be sharing with their faculty?

Hi Anna,

Thanks very much for your message.  Indeed, we have been talking to our compliance officer.  We, and NEC, have no intention of circumventing copyright but, as you know, faculty have other notions of what makes sense.  I hated to be the librarian always saying, "No" and was looking for a nicer way to do that.

I began with BAML before reaching out to NEMLA or other conservatories, figuring I'd keep it local first but have informally talked to others across the country.  So far, the responses have been basically, "Well, it's going to be unpleasant, but it's necessary."  I think what I'll end up doing is to draft a short explanatory e-mail message for the provost to forward to all faculty and that might preclude some requests.  The others will just have to be handled with an apologetic smile and a firm shake of the head.

Thanks again for your help, and I hope your orientation and start of the semester go smoothly.  I'm still wondering where summer went.  How could we have jumped from spring finals to now without noticing?

Hi Ricky.

Yes, I think you are right: a proactive explanation will help manage expectations and allow you to craft language that is more helpful than defensive.  At Wentworth, we included something about (our reference team) being available to help people identify alternate resources with similar content if they need something electronically but it's only available in print...
