Regarding extra vat charges and registry of flat

Hello all,

I am allotee of flat A19 and registry of our flat is due on 30th july. But builder is asking us to give a cheque of Rs 23000 as VAT charge without which they are not moving forward with registry.

Kindly let us know what all u pepole are doing. Are u giving the VAT charges or postponing the registry.

Hi,

We plan to postpone the registry, bcs this extra VAT amount is more than increase in registry cost (estimated increase from 25000 to 26000 per sq mtr).

Hi all

Can somebody please let me know the following ::

1 I am posted in Visakhapatnam and will not b able to make my presence for registration till end dec 14 .So Wat are the other ways to get registration done ??

2 how much will b the burden amount of increase in circle rates by GDA wef 01Aug.

3 if M/s Meenal will give me the possession of flat on making full payment but without registration.

I will be thankful of clearing the above mentioned doubts.

I just know answer of ur  3rd question:

3) Yes builder will give you possession even without registry after full and final payment .. but you need to get registry done in a partcular period of time which i am not sure right now,

Hello everyone

First of all the question is whether the builder has documentary proof by
which all allottees have to pay.... tax if so ask for a copy of the said
proof as it is the right of the citizens of India. I spoke to Mr. Gaurav
builder about this tax, he said , he does not know about this you ask Ms.
Shama. Then I talked to Ms. Shama who said that they hve receive a notice
from GDA about this tax, I asked her provide a copy of the said notice.
But I came to know from Mrs. Chanchal that there is not such tax to be
paid by us as it is not applicable to Delhi. I think we should all write
to GDA and other authorities and GOWO officers about this instead of
paying.

So ask for a copy of the document under which they are asking for tax.

As regards myself ,I have not yet received NOC and was just reading mails
but was not aware. Then I talked to Ms. Shama and accordingly I have yet
to collect NOC then I would come to know about this fanda.

                 If Builder is not doing registry and asking for VAT without any government notification or proof, then it is case of deficiency of service and harassment and we should all file complaint against builder before Consumer forum and ask for penalty and compensation.

Hi all,

The attached letter is penalty fined for cross-state border purchase (Haryana to Utter Pradesh) on which due to incomplete form filling, the authority has penalized Meenal Housing for Rs 70,000 only.

This has complete binding on builder and is a part of raw material cost, already included in cost of furnishing ( cost of flat ).

However, the penalty amount is Rs 70000; which turns out to be ~Rs 350 per flat (approx 200 flats); which we should have no issues to pay :P

I do agree with Mr Puneet Bansal and propose that an Advocate should be appoint for this.

Who so ever is the Subject matter expert amongst us should come forward and extend the help.

The fee what so ever shall be shared equally and which later on will be refunded to us by the consumer forum towards the litigation expenses.

Hello,

I visited site on 23 august and  as per interaction with people living there , they have given PDC(Post date cheque ) for this VAT amount .
I don't know why our builder is demanding it . I asked my relative who is working with one the builder having project in RNE only . He called his colleague and confirmed that 
there is nothing like this which they are charging . 

if all of us will not take a collective decision then most of us will end up  paying this extra amount to Builder .

Everyone , Please share your views at least.

One more update for all who have not got possession till now . I was told that after 15 August , any day i can come for possession. when i reached on 23rd August , i found few small things to be completed  like  kitchen was not set up completely  But i was told that electricity related fix charges are applicable from July 14 hence its already 1000 + amount which is due .


I request you all to check if this is the case with you also . What ever reply you get , do let me know so that i can proceed accordingly.

You need to communicate same to gowo too as they are also planning some action against builder .

Dear All,

 I am Ar. Titash Talukdar got possesion of my flat A-96. I asked for possession of my flat till 3rd of August, 2014.
I had to stand here at the site and complete all the works related to my flat. Till the last day the Glass Panes
were not fixed.

These are the things which are needed to be considered on a priority basis.

1. I request everybody to come to the Site, see your proceedings at the site then only fill the Possesion letter
form.  If you guys want your possesion then you must priority wise first talk to Mr. Anuj/ Ms. Shama. 

2. Please do not rely totally on Ms. Shama as well, she will call you and say that your flat is ready
for possesion,  but when you go to your flat here you will see 50% of your work is pending.

3.  I feel if you guys call Mr. Pinku/ Mr. Anupam at the site for possesion. The first thing they do is Install your meter.
They install your meter from that day Rs. 600/- + everyday's Rs. 20/- starts getting added to your bill. The bill goes
negative.(I think ask them to complete all works then install the Meter not before that)

4. Grouting is very important, The floor tiles are all in bad shape.

 Regarding the extra amount. We a group of around 5 families went to do registration on 25th of July, after the first round
of Paperworks and the signing of all documents, the stamp paper for the registry was bought to us, we had given
all the money, then only they said that Mr. Khanna  will sign the registry only when you guys will pay the extra
amount of UP-VAT Tax   Rs. 22/sq. ft.. After giving them Post Dated Cheques Mr. Khanna signed the documents

Thats how our registry was done. :)


The guys living here also are very concerned about a lot more issues, for that we are thinking of organising a meeting
As our society is very small most of these things can be easily taken care off, if we unite together, and do a meeting.

Dear All;
While going thru the mails of the occupants & the issues raised by
them, it is suggested that we should chase GOWO rather than builder.
Lets GOWO come into the picture. After all they have promoted the
project & charged almost 10% of the Flat`s cost. We Should ask GOWO
to initiate legal action against the builder if the builder forces for
VAT@22/sQ.FT.
GOWO should be asked to resolve the matter within a time frame or file
petition against both of them. Recently lots of judgements have come
up in the favor of consumers where builders & promoters have been
penalised for malpractices.

We can plan a meeting on the site this Saturday. We all know that there are concerns and the only solution is if we stand together.
