Obtaining possession can be a pain, but if we unitedly share information and take collective decision, we can protect our hard earned money which we have invested in this project

Looking forward to hear from you all and decide on further course of action .

May I know who all ( flat owners of UGF) have been asked extra amount to be paid to builder towards extended balcony area????

And How much amount has been paid by the affected owners???

please update for benefit of one and all....

further, I am not aware whether is it necessary to pay advance of maintenance charges for two years??

Sachin,
Its a norm for builder to collect maintainance charges in advance at the time of possession. Builder will provide maintainance till RWA is not form and handed over.

I have not seen my demand letter yet, but i am thinking of paying the dues realated to cost of flat and maintainace charges or any other component not related to cost of flat at the time of actual possession.

Any thoughts ?

In my opinion two things need to be resolved urgently
1. Interest which has been calculated on delay in instalment payments. Buildeer has never informed about accrual of interest amount till offer of possession letter. They should have alarmed from time to time.
They are also not mentioning anything about delay on their part in delivery of flats.
2.Builders should demand maint advance at the time of delivery only.

Hello everyone,

Hopefully, soon i will be the resident of A-19 flat. I have received the possession letter and its in the agreement that we have to pay the maintenance charges but nothing is present regrading the time period and amount. The builder is asking us to pay approx. 51,000 for two years maintenance and 25,000 for the electricity connection. 

Isn't  the amount quite much???  

secondly, it was in the agreement that the builder will pay 5 rs/ sq ft/ pm for the delay after December 2013, but nothing is present in the possession letter related to it.  please give your views on the same.

1)  To the best of my market knowledge, in most societies Advance maintenance is paid in advance for 2 years, but then why is there a separate component of IFMS charges. One of these two components i.e.,  either Advance Maintenance (INR 1.8 per ft per month for two years) or IFMS charges (INR 30/- per ft) should be applicable; and NOT BOTH.

2)  Electricity charges are very high (INR 28000/-), while it takes ~INR 5000 to take a meter connection.

3)  This entire payment (along with 5% basic cost) should have been asked at the time of possession only i.e., at least 90 days from now in July'14, when flats are ready for possession.

As per the discussion with GOWO, they said they are are going to have a word with MD - Meenal Housing to discuss the above issues; and asked me to wait for making the payment, till their revert.

Further, as per the discussion with the Builder (Nikhil - Finance); they advised to come to their office and have negotiation on the  final amount payable, where Interest cost and other charges can be negotiated. It does reflect an unfair play by the builder.

I suggest, we should better wait for making any payment till clarity is obtained on all of the above points and firm reply from GOWO/Builder.

               Builder can not hand over the flats to flat owner without obtaining occupancy certificate from GDA. We should ask the builder to obtain occupancy certificate from GDA before asking for payment. Since the builder has not intimated for delayed payment, therefore we should not pay any delayed interest and jointly protest before Builder.

I agreed will all occupants regarding interest calculation and advance maintenance charges. 
Builder never remind us regarding delay payment and builder had calculated delay payment interest from the date of issue of demand letter however many of occupants like me received demand letter after 5 to 6 day from the date of issue demand letter. I have leaved in Jabalpur (M.P.).
We should protest interest amount and advance maintenance charges at this time. we should pay advance maintenance charges at the time of actual possession. Why builder earn interest on our money for four to six month.Electric meter charges also very high. please update me about your views.

As pointed out by Sh. Deepak, separate negotiation by the builder with
the flat owner is somewhere reflects shortcomings at their end for
sure. We should take up & involve GOWO who has charged hefty sum from
the flat owner to safeguard their interest. Possession letters should
not be issued without the clearance from GOWO and clearance
certificate/completion certificate from GDA. GOWO can not act as a
mute spectator. They should be made responsible for all this. Charging
Adv. maintenance and hefty amount of Rs.28,000 in the name of
electricity connection is not fare.

Hello
In my view Mr. Vinay Kesarwani has pointed out correctly that before obtaining the occupancy certificate or completion certificate from GDA, builder can not issue the "Offer of Possession" to flat owners. I am trying to obtain a copy of the ordinance issued by GDA in connection of completion certificate/ Occupancy certificate.
About delayed payment interest, since there was no prior intimation given by builder, we very well can refuse for.
In the demand letter builder has always mentioned that ''payment to be made within 10 days of issuing the latter" but the legal language is supposed to be '' Payment is to be made within 10 days of receiving the latter".
There will be so many things of such lapses on the part of the builder, which can be easily challenged in the District Consumer forum and it will be more fruit full if done collectively.
