Dear Sir

I am Sachin Bansal and I have booked flat no B-02 in your esteemed Rajnagar Ext project in Feb 12.

Today I have received a mail from m/s Meenal Housing Pvt Ltd saying that My flat's balcony area has been increased by 138 sq ft @ rs 3000.00 and asking me to pay an additional amount of Rs 4,14,000.00.

I would like to request you that this allotment was not intimated or envisaged by the builder at the stage of contract and at this stage this is like an additional burden on me that too by force but not by choice.

Please clear my following doubts:-

1  How can the builder  force me to take an additional area if I am not interested??

2  Why it was not envisaged by the builder and being enforced by him just before the time of possession?

3   Due to financial constraints, What if I am not in position to pay for the said amount and even not at all interested to take that?

4  If GOWO is aware of the same??

5  Is this addition only to my flat or to all my neighbours??

6  Why builder is asking current rates and not @ Rs 2100.00 at which we concluded the contract?

I request you to please intervene in this matter and please bring out some way ahead to all your customers.

Hi,

I have not received the additional amount email yet but I know that they have increased the balcony space for 1st floor flats. Have anyone else has received email regarding the demand due to area change in their flat?

I am posted in Vizag so cant make a visit to the site.

Well in my mail to Mr Gaurav/Mr Anuj, I have clearly told them that I am not paying a single penny and even builder cant force us to pay for any area which is not mentioned in the contract.

He is just asking us to pay for the area which as such he has to build as a part of stilt parking and now just to fetch extra bucks, he is forcing us to pay for that area which is no where mentioned in the contract .

So unless we want, He cant force us to pay for the area which we don't want.

Else we can take legal action.

I spoke to GOWO yesterday . They told me that they are not aware of the issue and he asked me not to pay anything to MEENAL as its not legal.

1  I have booked flat no B-02 in your esteemed Rajnagar Ext project in Feb 12.

2   I would like to bring to your kind attention that any extension in flat area is not mentioned in the contract signed between self, Meenal and GOWO.

4   In view of the above, I would like to submit that I am not at all in any financial position to pay extra amount and therefore I strongly refuse to pay any additional amount being asked for any construction which is not part of the contract. The same thing has been communicated to GOWO also.

Kindly read BBA throughly, there may be a point in which builder might have mentioned that there may or may not be an increase or decrease in the ultimate  covered area at the time of possession and at what rate this increase area will be charged.If there is no such clause exists in your BBA then one can flatly refuse to take that area  provided GDA doesn't impose some compulssion.

But in my view, this aspect can be bargained with builder collectively 9 by effective owners) and an amicable amount can be decided.

Possibly this is an added advantage at this stage to have an increadsed balcony , which may be used as a store in future, provided if bargained for lowest cost.

Well, still to be frank I am not financially in a position to pay any additional area which I have not asked for..

So let it be there in contrct or not but the builder cant force to pay for it without any prior intimation well in time.

Still I fully agree with you that we together can negotiate with the builder and pull him to a lower cost with our best efforts.

Note: this increased area suffering will only be for the UGF flats

Dear Umesh Ji,

With all due respect, this is not an added advantage because it simply increases the balcony area (not the carpet/covered area) for which builder has to just extend the balcony "'lenter" at negligible cost. This reduces the carpet area ratio; and most of us might not have booked flats for such lower ratio, if were aware earlier.

Now, builder is asking for enhanced balcony area at current price, which further adds to the pain.

Please review this carefully and take collective decision against this unjustified demand of builder.

Dear Sachin/Umesh ji, I agreed that this extra space can be used as a store in future, but every one is not in such financial position to pay this amount. Secondly, as per BBA any increase/decrease in area can be calculated at booking rate i.e. Rs 2100/sq feet. According to BBA we r bind to pay for any increase in lay out area, but whether it is an increase in layout? Builder just attach approx. 13% of the total area of the flat to the balcony. Is there any upper limit for % of area which builder can increase in society act? Otherwise builder may attach 1 BHK with 2 BHK and demand for extra money. Why we pay Rs2100/sq feet for an open space (area approx equivalent to our master bed room size). At last, I can pay only nominal amount against tiles, wall etc as suggested by Mr. Pulkit ji. Any update on matter of increase in area of flat ? Today I have conversation with Mr Ashok choudhary of GOWO. He told me that GOWO already fwd a letter to the builder stating "our members are not ready to pay the demanded amount". Reply from builder is awaited. Regards Yogesh chadha

Hi to all.
1. I had been on site yesterday. The so called extended area seems to be of no use. The builder should have actually spoken to us when he realised about this and not arbitrarily ask us to pay. This is s result of construction of stilt parking and not due to any extra expenditure incurred by him.I have spoken to MD GOWO today that none of us are paying a penny extra.
2. The finishing work is going very slow and I feel we cannot get possession before june. We all need to pressurize builder and GOWO.
