A land use decision is an action taken regarding a land use application by a land use authority.Who the land use authority is, varies based on the type of application, e.g. staff, the planningcommission and the county commission all act as land use authority.

All appeals of land use decisions are submitted to the Planning Division prior to the expiration ofany appeal period, along with the appropriate fee. Generally, the appeal is a letter with anarrative explaining what land use decision is being appealed and the basis or why it is beingappealed that addresses the ordinance approval criteria. The County has determined who the appealauthority will be for the different types of land use decisions.

Yes. There can be a judicial review of the records of the appeal authority decisions. No newinformation will be accepted as part of this review. To find more information on judicial review,consult Utah State Code.

Applications to the Planning Commission need to be submitted 45 days prior to the PlanningCommission meeting. The Western Weber County Planning Commission meets on the second Tuesday ofevery month and the Ogden Valley Planning Commission meets on the fourth Tuesday of every month.

Most zones in the unincorporated county do not allow single family dwellings to be rented on anightly basis. To find out if you are in a zone that allows nightly rentals as a conditional use,please contact the Planning Division at (801)399-8371. If your zoning allows nightly rentals, pleaseask about the application requirements.

The state program is the Government Records Access and Management Act (GRAMA). To obtaininformation that is part of the public record a GRAMA request form needs to be filled out,with the amount that you are willing to spend for the copies and in what format you want therecords. Many of the records are online such as minutes and agendas. There are records that are copyright protected such as drawings from engineering firms. Fees for GRAMA request can be found on thefee chart.

At this time the Planning Division does not have the ability to accept applications and supportingdocuments electronically, nor does the Planning Division have the ability to send out updates onprojects. This capability is being developed. Planning Division application forms can be found at here

Permitted uses are uses allowed in a zoning district, but may require a Design Review of theproposal. Conditional Uses are uses that have been determined to be a desirable use in a particularzone; however, these uses may be subject to discretionary requirements to mitigate impact created bythe use. The Planning Commission has the authority to issue Conditional Use Permits.

A Land Use Permit is a verification of zoning standards for building permit, business licenses etc.The Land Use Permit indicates zoning setback requirements and conditions that may be associated withthe use. A Land Use Permit is required prior to a Building Permit being issued.

Yes. Any structure that requires a building permit excluding remodels is required to have a LandUse Permit. Examples are such things as a sports court, parking pad within a side yard setback,covered patios, shed, etc.

There is no requirement in State Code for notice to be sent to adjacent property owners. The countypolicy to send a courtesy notice on most application types to property owners within 500 feet of thesubject property.

Applications are available at the Planning Division office and on line. Generally one or two termsare up for consideration each year. When vacancies arise, the County Commission will acceptapplications to fill the vacancies. The applications can be found online. The applications arereviewed by the County Commission; may be interview applicant. The County Commission then makesappointments to the Planning Commission.

Two Planning Commissions serve the unincorporated areas of Weber County. Communication to the Planning Commission can be addressed to the Planning Division. Letter, fax, ore-mail must be submitted and arrive 8 days in advance of the Planning Commission meeting to ensurethere is time for review and to place comments in the Planning Commission packets.

Rebuild Letters are a service provided to homeowners and financial institutions seeking to know ifa property is eligible for a Land Use Permit and a building permit. This information can help ahomeowner when considering a sale or refinance of their dwelling. Many lending institutions requirea letter indicating the ability of a home to be rebuilt in the event it is destroyed. They will notfinance or refinance a loan without it. Rebuild Letters only confirm the legal existence of a lot,not the existing structures or uses on the property.

You can obtain a rebuild letter by contacting the Weber County Planning Division for an appointmentto meet with a planner and request a GRAMA form requesting a Rebuild Letter. There are feesassociated with the research that is required in determining if a Rebuild Letter can be issued.Rebuild Letters can take a couple of weeks to finalize.

Utah State Code defines any division of land is as a subdivision. The Weber County SubdivisionOrdinance gives the requirements for a subdivision. Many variables affect process times forsubdivisions, such as the number of lots, required improvements, and County agency requirements.

Zoning is the basic tool for community general plan implementation. Zoning is an attempt to assurea compatible interrelationship of land uses in such a way that the community goals for health,safety, morals, and general welfare are promoted. Zoning laws identify how land may be usedincluding a list of allowed uses and development standards, e.g., building setbacks. Zoning in WeberCounty is categorized into agricultural, residential, commercial, and manufacturing zones. The WeberCounty Zoning ordinance can be found here.

South Ogden City is accepting applications for full-time Firefighter III. Applicants must be at least 18 years of age, have EMT-A, Hazmat awareness and operations, Firefighter II Cert, and a valid driver's license.

Firefighters provide a variety of entry-level firefighting duties related to protection of life and property by performing firefighting, emergency medical aid, and fire prevention/education duties. This position also performs minor maintenance efforts with firefighting and medical equipment, apparatus, and facilities.

South Ogden city is recruiting for a City Planner. This position conducts research on issues, policies and concepts pertaining to planning, zoning, and community development; presents findings to the planning commission and/or city council; prepares written reports in response to public requests for zoning applications and various ordinance changes. Prepares proposals in draft form for amendments to zoning ordinance or policy governing local planning, zoning and development.

Conducts feasibility studies, prepares a variety of reports related to project progress; reviews and updates ordinances affecting planning, zoning, signage, traffic, development and related departmental areas; assists in coordination of projects with other department or governmental agencies.

Prepares and updates various land use and planning maps; operates computer to generate computerized maps; utilizes computer to conduct various research and solve planning problems; assists in maintaining effective software. Meets with the general public to discuss planning, zoning, and development issues; assists the public to define concerns and presents public questions to management; follows up with public to apprise city of decisions.

Reviews commercial and residential building plans and specifications to assure compliance with city zoning ordinances; provides signature approval for compliance, denies issuance of permits for non-compliance; cooperates with builders and developers and assists by identifying actions needed to secure compliance. Reviews commercial and residential subdivision plans and applications, provides professional planning analysis for subdivision design and assures compliance with development codes; interacts with professional design consultants to convey development policy and codes.

Conducts field inspections of completed commercial, multifamily and residential construction to further verify zoning compliance; issues signature approval for final certificates of occupancy; initiates sanctions for noncompliance. Participates in project review meetings with various city department and developer representatives and identifies problem areas related to zoning and negotiates options for compliance.

Reviews and approves landscape plans for compliance with city landscape ordinance; monitors building setbacks, signage requirements, driveways, parking lots, dumpster placement and related site compliance concerns.

Applicants must have graduated from an accredited college or university with a bachelor's degree in urban planning, public administration or a closely related field and four (4) years of responsible experience performing above related duties or an equivalent combination of education and experience.
