The purpose of this memorandum is to clarify Federal-aid procedures for procurement of operational improvements using Federal-aid Highway funds. This memorandum expands upon the reference to procurement of operational improvements included in the general memorandum on Procurement of Federal-aid Construction Projects, provided at: This memorandum does not represent a change in policy. Based on recent questions from some Division Offices and State Departments of Transportation we felt the need to restate and highlight that many Intelligent Transportation Systems (ITS) and operations projects are not considered construction under 23 U.S.C. 112.1

Federal-aid statutes, regulations, and policies generally address traditional highway construction projects. The procurement of Federal-aid construction projects is outlined in 23 U.S.C. 112 and construction contracts must follow the regulatory requirements of 23 CFR part 635 (or in the case of design-build, 23 CFR part 636). Procurement of non-construction operational improvements follow State-approved procedures under the Uniform Requirements for Federal Awards. If an eligible ITS project activity is determined to be non-construction, then pursuant to 2 CFR 200.317, and 2 CFR 1201.317 for subrecipients, State procurement procedures are followed in procuring eligible ITS and operational activities. Some ITS and operations projects may be determined to be construction. If this is the case, those projects must be procured pursuant to the requirements in 23 U.S.C. 112 and 23 CFR parts 635 or 636.

As seen above, some examples appear in both construction and operational improvement categories representing discretionary judgment in ITS procurements to ensure system synchronization and reduce overall deployment risks. Some projects may be scoped as "systems deployments" that involve a combination of field (civil)infrastructure and ITS technology, communications, and systems integration work. Road weather information systems, tolling systems, and connected vehicle field infrastructure (e.g. roadside equipment) may be examples of these types of hybrid deployments. In these cases, the Division Office may take into consideration the relative proportion of the field vs. non-field costs (including project scope and level of effort) to determine the overall classification. Alternatively, the State DOT may consider breaking the project into distinct procurements with the construction elements procured via traditional competitively bid contracts, design-build or other approved contracting methods, and the non-construction elements procured per 2 CFR parts 200 and 1201.

However, in light of the context in which this phrase is used, as well as the separate definition of "operational improvement", we interpret the phrase to exclude those activities specified as "operational improvements" in the definition and in this memorandum. "Construction" includes those activities that involve the alteration of the ROW that are in the nature of the activities that are specifically excluded under 23 U.S.C. 101(a)(18). Note that some minor and incidental physical alterations may be involved with the operational improvement. Such alternations do not necessarily convert the operational improvement project into a construction project. Rather, the nature of the activity being undertaken must be of the type of activities that are excluded from the definition of operational improvement. [ Return to Note 2 ]

The purpose of the PAD 771 Capstone seminar is for students to demonstrate that they have successfully mastered skills developed during studies in the MPA program. The student develops a term project on a policy, oversight or public management problem by engaging in one of three types of analytical exercises - a policy analysis, program assessment, or research report. The program assessment and research report projects require special permission from the student's PAD 771 instructor and the Director of the student's MPA program. The project submission consists of three components:

Consistent with this rule, students in PAD 771 who have been doing satisfactory work and who become unable to complete course requirements may be given an IN grade. The student must then submit the completed project and submit the project for grading during the regular cycle of grading in course sections taking place within one year following the year following the end on the semester when the IN was assigned. The student should contact the faculty member who assigned the IN grade to arrange for the particular course section in which the project should be submitted for grading.

For example, if the students receives the IN during the Fall semester, the IN must be resolved during the next Spring, Summer or Fall semester or the IN grade becomes permanent. A student may not submit the project to more than one course cycle of grading. For example, the student receiving an IN in a Fall semester may not submit the project for the first cycle of grading in the Spring and the second cycle in another course section during the Summer. The student must pick a course section and resolve the IN within the grading cycle of that course section.

The above is not an outline of the memorandum, but the outline developed should provide for each of these project elements to be included. Further information about the organization and content of the project is provided in the medialectures presented in the course.

A program assessment maps and examines efficiency and effectiveness, and provides benchmarks and performance measures to assess the delivery of services or the implementation of projects. To undertake a Program Assessment project, students must 1) have attained a grade of 3.7 or above in both PAD 715 and PAD 745, and 2) have substantially completed a program evaluation which will be the basis for the Capstone Project memorandum. Permission to undertake a Program Assessment project must be obtained from the PAD 771 instructor and the Director of the student's MPA Program by not later than week three. Students are encouraged so seek approval for this option while completing PAD 745.

A research report summarizes a research project conducted by the student. The student must have substantially completed the research project prior to enrolling in PAD 771, must have attained a grade of 3.5 or above in PAD 715 and either PAD 745 or PAD 770, and the faculty member for the section, along with the Director for the student's MPA Program, must review and approve the project before the student proceeds. Students are encouraged so seek approval for this option while completing PAD 745 or PAD 770.

The purpose of your slides is to assist a brief presentation of the results of your project. The student should assume a presentation that generally supports the content of the 2-page cover memorandum. An operationalization of the assignment is: If you were reading your executive summary to a small group, how would us use twelve slides to reinforce and support your presentation?

What has the employee accomplished so far? What is going well? What are some of the challenges? How is the employee trying to overcome any of those obstacles? These are the issues covered in a status memo.

Another common type of memo you may draft is a status memo, sometimes called a progress report , which simply explains the status or progress of a particular assignment or project to a supervisor. For example, the project manager of a construction site may provide a weekly status report on the construction of an apartment complex he's managing for the company. A status memo will include the progress to date and what's left to be done.

If your employment sometimes involves working offsite, you may end up penning field report memos. These memos are often composed to document meeting clients offsite, inspecting offsite projects, or testing products offsite. For example, a marketing professional may go out in the field to test a new type of soda at various supermarkets in the anticipated target market for the new beverage. After the field test of the new soda, the employee will outline the outcome of the field test of the new soda and provide any relevant recommendations based on it.
