Trial Attorney
A Hong Kong law firm has retained me as trial counsel --
defending an attorney in a legal malpractice case. The
jury trial is scheduled for next month. My practice also involves
handling other trial preparation assignments for many
California law firms.
My experience includes singlehanded prepartion and trial of
a breach of contract (joint venture agreement) case for
a California corporation before a jury in Napa County
Superior Court. I also filed a breach of contract
(royalty agreement/idea protection) suit against a
$200 million corporation and prevailed on summary judgement
in Federal Court. This intellectual property case required
me to distinguish invention and writing claims from another
product that the defendant had marketed. The case settled favorably.
Additionally, I have experience appearing before an arbitrator in
many commercial disputes.
The significant responsibilities of a sole practitioner have
required me to take and defend more than 100 expert and percipient
witness depositions and my appearance in court on hundreds of
occasions. This hands-on experience has honed my client
interaction, case management, business and computer skills.
My internet, computerized legal research and word processing
skills have also improved. These skills enable me to work
efficiently and, if necessary, independently.

Professional Liability Litigation Associate
I was recruited away from Lewis, D'Amato, Brisbois &
Bisgaard to work as a trial attorney in the professional
liability group of this 150-attorney San Francisco law firm.
As it turned out, the firm did not have enough work to keep
me busy. During my brief employment at Long & Levit, my summary
judgement work resulted in a victory in favor of two tax
accountant clients. I also obtained a judgement in favor of
one one of my clients in a legal malpractice case.

General Liability Defense Litigation Associate
As an associate attorney in California's fourteenth largest
law firm, I always exceeded the firm's nineteen-hundred per
year billable hour requirement. My litigation practice areas
included trademark and copyright, professional liability
defense (corporate officers and directors, real estate
brokers, stock brokers, attorneys, etc.), various commercial
disputes, real estate litigation, products liability,
corporate shareholder actions, construction defect,
insurance defense, insurance coverage, etc.
These years developed my persuasive writing ability by
requiring me to draft countless motions and honed my oral
advocacy skills through my regular appearances in the
California state and Federal courts. I investigated,
discovered and prosecuted many fly-by-night subcontractors
by way of cross-complaint, as part of my total responsibility
in defending general contractors. Upon my investigation and
discovery of insurance fraud in one case, the carrier forwarded my
arbitration brief to the authorities which resulted in
criminal convictions for the plaintiffs.
This work also required regular appearences before settlement
judges and special masters in many different kinds of litigation.
In one case a developer sued my client, a window manufacturer, for
hundreds of leaking door and window units that had allegedly
caused water damage throughout a large development. The
plaintiff claimed damages greater than $1,000,000, and I
obtained a $7,500 settlement. I settled a $100,000+
insurance benefits claim against another client of mine
for $2,500, a probate and breach of trust matter
against another client, a bank, for $1,000 and defended
a real estate agent and her errors and omissions
carrier, and settled the case for nothing.
My responsibilities included general appearances, settlement
conferences, taking and defending depositions, research,
drafting of briefs, motions, memoranda of law and trial
preparation and assistance. I learned from some of best
legal minds in the Bay Area. My articles in Insurance Case
Commentary appeared regularly, provideding accurate, concise
summaries and analysis of new appellate court decisions.

I started this residential landscape development and
maintenance business to pay my way through college and law
school. Principal business activity was residential site
planning and design, and the execution of site development
(e.g., construction site preparation, brush cutting, chain
saw work, brick and stone work, landscape and lawn
construction).
Company management required the supervision of design
professionals, heavy-equipment operators, subcontractors
and employees, contract negotiation, general contracting,
contract administration, preparation of presentations,
cost estimates, accounting, advertising and customer
service.
