Dear All,

AWHO RWA is forcing club membership on tenants which is not logical at
all. Lets join this club and invite your friends who are residing in
AWHO as tenants to join this group.

It says that after becoming a member you can avail the club facilities
like Pool table, Swimming Pool, GYM and so on and at the same time one
have to pay for the fee also which is higher than the owners fee even
after getting the membership.
One have to pay the membership fee even if one don't want to avail the
facilities of the club which is not right at all.

We have to come together else this RWA will not listen us at all.
Today morning when I visited the Secretary to discuss the same and
requested him to reconsider this membership fee he simply denied for
the same. When I asked if all the tenants say No to the membership fee
then he start shouting and abusing me.

Friends we should come together and raise our voice against this
membership fee.

Wow.
I raised my concern in the morning  and told them that all of the tenants will come together and secretary threatened me that you will not be able to stay here.  Guess what its power cut at my flat H 806 all other flats have light.
When I called the maintenance they said to fix it in the morning.

I think we should raised this concern to landlord also and ask them to cooperate us to fight.
Worst we can stop the rent payment. This is absolutely discrimination, can't expect from army persons.

This is totally unacceptable .. With out giving any benefits they are charging so much . Let's hold a meeting with ourselves and present a case to president of the society .. If we come together they can't even think of charging anything with out any benefit.. Here there are more tenants than owners

We need to unite first to fight this. Legal will take time. If we don't pay rent AWHO can cut off power to trouble us. We need some more representation to show strength
Can we go to a consumer forum? Is there some guideline on RWAs. AWHO manafwmwnr has turned Resident Welfare Association to Owner Welfare Association. What protections do Tenants have? We will need to find out some of these answers so that we can do an informed resistance.

I am in guys. in March, around Holi - these guys wanted to repair
something. to do that they blocked the entrance to my parking, when i
complained, the President came and said I am one of the most negative
person and I keep complaining about things... since then i stopped
posting anything on the the society website.

this membership thing is ridiclous - while renting out the apartment -
the property dealer spoke a lot about the club and now when the Club
has started - they are imposing these huge fee. Considering the high
fee, i decided i would not avail the Club facilities - but still i
need to take the Membership - doesnt make any sense.

I am with you all. please let me know what step you plan to take and
how can i be a part of it. I am open to be a part of any meeting you
plan for this!

I'm in too guys..

Yesterday i went to the pool to enquire about swimming charges and
they told me all about it except the Club membership charges.

I don't know if they have been removed or still applicable. But
definitely RWA follows a descriminating policies against Tenants every
now and then.

I am living in this society for last 3 years and repeatedly RWA has always shown discrimination towards Tenants be it 1000 Rs for lift usage, parking issues,shifting charges ............list is endless

Time has come for us to raise our voice

Unfortunately, I'm out of town this and the next weekend. So if you guys are planning to hold a meeting on Sunday, I won't be able to attend. But I'm a part of this movement as well. If we can have a meeting in the evening sometime next week (or even today) it would be great as I would like to meet you guys as well.

As for a suggestion, how about getting a third-person (could be legal) opinion regarding what are the rights of tenants in a society (as per state laws) and if RWA can be the binding authority ? How about highlighting this in press (we have been reading similar news in newspapers about Mayfield Gardens these days) ?

I have been against the RWA since the beginning. Its good to see that
all the tenants are finally getting together as one against all the

Hi ,i think ,its true that RWA is taking benefit from tenants from the
start ,but its a lapse on our side as well ,we only wake up during
these type of issues and then sleep back ,i have seen some good things
done by this RWA which include open meeting every last sunday where we
can go and raise our concerns ,but the fact is that not even one of us
attend those ,anyhow coming to the point .

These are not our own houses so we are little weak and if we will go
alone and fight we stand nowehere ,so unity is required for sure ,lets
get together on sunday , i am afraid how many of us turn out ,we need
nos to fight on this .i even dnt think approaching owners will be of
much help as there is no impact to them .

So first step should be no's ,second plan and strategy and then
meeting president with a formal signed letter from all of us and a
copy to AWHO on this .

Next big steps can be seen later .

So this is final that we are meeting this Sunday at 10.30 am at central park. RWA should act as Resident Welfare Association not Owners Welfare Association. I think we should have the agenda in place for this meet.

 

My suggestions are as following:-

 

1.       RWA Should withdraw the Club membership fee (One time + Monthly).

2.       In case RWA wants to charge this fee they should give the facilities for free or at the same rate as applicable for the original allotters.

a.       I will prefer free

3.       We are 600 + tenants staying in the society and should have equal rights and RWA should stop it’s discriminating policies with Tenants.

 

In case RWA do not withdraw this membership:

1.       Can we form an AWHO Tenant Welfare Association? Need some legal advice? Any lawyer here?

2.       We are 600+ Tenants and we should get equal say in the management and I think legally this should not be a problem and we should force the RWA to accommodate equal members from Tenants.

 

We are looking forward for suggestions from other members as well. Pls feel free to provide your inputs/suggestions.

Just to add my view, I have different opinion on your Point # 2 below.

I believe this Club Membership fees should have been charged from Flat Owner for once or Landlord should be paying this everytime a new Tenant comes to their flat, as they are earning from tenants. As all tenants are here for limited stay so putting tenants under manadatory cap is NOT AT ALL LOGICAL, it has to be option for those who are willing to avail the club facilities at these charges.

Congratulations to all the tenants who showed up in the tenants meeting today at 10:30 AM.

I felt the pain of injustice to me as a tenant in AWHO and thought that the others had no issues with the RWAs discriminatory policies towards tenants, but  with today's get-together i was proved wrong. 

Let us not let the spirit die down like the Anna Hazare moment which was planned by the opposition, and keep the discussion on till our concerns are met and a solution reached. 

Try including all the tenants who could not make it  today for future meetings and everyone is requested to coordinate with their neighbors and ask them to attend the future meetings. This would make our movement stronger and help in bringing justice to tenant's cause.

It was indeed a pleasure meeting all and appreciate the concern for the common cause that brought us together.

For all those who are not aware.. Following is the notice just posted on society portal

1. A BD OF OFFRS HAS BEEN COMPOSED TO STUDY THE AMOUNT OF INCREASE
REQUIRED  IN MAINT CHARGES DUE TO INCREASE IN AMC/ MAINT CHARGES OF
THE SOCIETY AND A SHORTFALL IN MONYHLY COLLECTIONS AND EXPENDITURE.
2. TILL THE TIME EXACT MAINT FUND ENHANCEMENT IS WORKED OUT BY THE
BOARD , AN INTERIM MAINT CHARGE OF rS 500 /- WILL BE LEVIED WITH IMMEDIATE
EFFECT

Also, as pointed out during the meeting that the removal of mandatory charges of Rs.5000 required approval in the General body meeting, can increase in the maintenance charges happen without the General body meeting?

We will need to verify. I heard someone say that RWA maintains two registers for recharging and maintenance. I wouldn't be surprised to know there are different maintenance charges for Tenants and orginial allottees.

J Me too have received my newspaper.

 

I think we need to be focused on the key issues else it will result in frustration. As of now we have 3 points to deal with –

 

·         Stop discrimination with Tenants

·         Withdraw membership fee (One time + monthly)

·         Club facilities – Use & Pay mode

 

Guys we have to be active in Last Sunday meets to put our voice in the open forum.

Hi Gaurav i live in A 302 and we have gone through a bad exper with
the AWHO i was hoping to share it with all of you at the meeting but
could not make it for the meeting, but am happy someone has taken on
the awho, the new people who have taken over are making like hell
for the tenants with all the increase in everything, seems like we the
tenants are having to make up for the lack of income of the complex
expenses of the which even the owners are enjoying, we are not getting
a fair deal,

Appreciate all the efforts taken . It is good to see a tenants'
forum . Whone should make the club membership compulsory. Why should
there be two different charges for the same facilities to be used .
Why should tenants subsdise allotees charges . Very discriminatory .
We should inform our land lords and also get them into the fold.

Hi All

Pls inform how is the membership money being charged? Is it directly
thru the smart meter or we hv to pay separately?

Wht is the exact amount of one time pymt and monthly pymt..pls advise

Let us all ban the swimming pool. I am not going to renew my swimming
pool membership in the coming month. Let us all stop using it. Let's
see how they maintain it then....
Lets give them a jhatkaa parallel to our fight.

Is there a way to reach out to all the people using the swimming pool
and tell them to support us and stop using the pool.

Have the increased the maintainence charges already?
If so, we should all infrom our landlords (all at once) that we intend to leave because of such indiscrimination . This will put pressure on the owners and they will in turn talk to the rwa.

from her was,that these people were spoiling the name of the army she

i too have spoken to my landlord and he was horrified to the activities happening here. I did put in lots of concern pertaining to Owners renting out as negative feedback of sispal is rolling out in market through word of mouth which will directly affect not only the rentals bit also the quality of hirers. The rent amounts will spiral southwards owing to increase in maintenance charges & mandatory charges to tenants.

Well even my landlady was shocked when i told her about all the things
going on, but just to give you a idea,when moved here to my flat in
june 2010 i was paying 15000. then after 11 months 16500.now she has
jumped from 16500 to 22000.so you see what going on here even the
landlords are playing up,by increasing the rent by thousands,not 10
percent like it should be,

Yep same here, mine has gone up from 17k to 23k in less thank 2 yrs. But the thought of the rent being lessened due to negative publicity n exorbitant charges should move their 'conscience'

Guys we all know that rents in AWHO is lower than other apartments in the locality.

I talked to my landlord and he said clearly that RWA can not enforce this mandatory membership. It's very unfortunate that they are dong this kind of discrepency with tenants. Got to know few points from him -
  1. First thing - He was not sure that when last General body meeting (GBM) happened and owners are not aware of this club membership rule. i.e. it's not discussed OR conveyed to them at all.
  2. He asked to get in touch with General Secretary (Mr. Sharma) rather than Mr Rathi and get a copy of by-laws also. There is no such rule that GBM can decide it for tenants
  3. Owners have already paid 20K for this membership earlier OR some other amount
So I believe, we need to ask our owners to put pressure on RWA.

Chintan - this is actually not true. rent is quite similar in the societies around. you get an equally big flat in the similar rent. if you compare the services and surroundings - those societies are still better than ours!!!

My understanding is that once the complex is prepared by the AWHO, they hand over the reigns to the society RWA and thereafter don't have jurisdiction in admin matters of the society.

Thanks for the leaders who are investing there valuable time for all of us , I am sure you are selecting best for us but still I thought to share my thought process for the issue, AWHO may not have any Process for such cases but to forward the mail to RWA, I personally feel our concern is quit genuine, In present RWA few people may be unreasonable but should not be all.

If we find all military people unreasonable then this is a serious concern of coexistence and nobody will have solution for that , I mean in that case movement or agitation of few tenants (considering all tenants in Sispal vihar are part of this) will also be too small as it will be a national problem however I feel that this should not be the case, we are living together with them and I found them equally reasonable in day to day life.

If we agree to above then problem comes for RWA now in RWA few people may be unreasonable but rest can support us plus there should be an anti group as they have elections for RWA also. We should first raise our concern to all RWA position holders personally (I mean group of 2~3 tenants from each block can go and meet block representative and check there personal feeling as well as logic for putting unreasonable burden on tenants) I hope we will get positive feedback from them and then after heaving a general feeling we can escalate the issue further with process and people in place as suggested by RWA members in our favor.

If we found all of them convinced that this decision is correct then we can explore anti group of currently position holders , if still same result then case one of coexistence problem applied.

In that case way out is pressure of tenants, media or whatever best each can contribute.

This is nice ,if can get contact details of this reporter, we can request
for a new story on our Society , they will be interested as it will have lot
of Masala due to Military VS Civilian coexistence issue. Though this should
be last recourse as this will damage relationship further and spoil the

As far as dealing with issue - I strongly feel we should inform the owners (that most of us have already done) and NO BODY will pay the membership. Let's see what RWA will do but we need to spead the work across to all the tenants who are not able to follow the thread due to any constraint.

Well I think its a good platform to take things to next level. I think at the moment focus should be on
(1) Club membership (optional)
(2) No discrimination between tenants and owners
(3) Tenants should immediately stop using any of club facilities like gym, swimming pool etc so tht they feel the pinch when these vendors won't get enough money to maintain these facilities. This could be extended to not buying even groceries and other material at all from shops inside which will lead these guys to go to RWA and I am sure they'll feel the heat
(4) If we don't get definite reply from mr president, I think then we should start sending "GET WELL SOON" card to him and start wishing him so, whenever we see him

Above all we should maintain all the discipline so tht they won't get any chance to point finger at us

we need to meet every week in the central park in order to maintain the pressure on these unwanted RWA.

However,. this will also give us opportunity to meet and discuss the future course of action.

Just a request to all since we know the issue, its better not to go to RWA office alone to discuss this with any of the official of RWA. The issue is communicated to them so they are aware of this. So as far as this topic is concerned let our representatives meet and propose changes else we'll be harrassed if we'll take this up individually. We made our stand clear...so let's stand together, even if any official tries to raise this issue with any of us we should politely ask them to speak to our reps

Dear All- we need to fix a date for RWÀ to withdraw the terms as per our demand like they have given a date for us to pay the fees (15th may). We should be. clear on next action post this date. RWA will soon start sending people to our houses to collect the fees and we all should be on same page while responding to them.

Its Residents v/s RWA

I also read the article in the news paper post Sunday event for AWHO and it
seems that we were culprit not the RWA.
