Guys this Society is just for allottees and not for tenants or other people who buy flat here. I think it is better to write about this Army managed RWA/society on internet about their behaviour and discriminations towards tenants and civilians so that we can warn other people shifting to this society.
Recent development by RWA is simply not acceptable. They are now asking landlords to tell the tenants to vacate the house specially who raised their voice for justice.

In continuation of the below mails, Please find attached scanned copies from Times of India and Hindustan Times which mentions that Mr.Rathee who is the president of Sispal Vihar RWA - which we have now nicknamed as Rathee Welfare Association was arrested for assault on people residing in Sispal Vihar. You may zoom the picture of these attachemnts to read properly. So the news about mr.rathee being arrested for assault and other charges is true and not a rumour.
This is for the sake of all the members who are not aware of what this president is doing in the absence of all you honourable members not living in Sispal Vihar currently and is taking advantage of it for the welfare of RWA which in the case of Sispal Vihar has become Rathee Welfare Association.
A detailed account of what happened on the day he got arrested is given below:
After Rathee and his gundas in the form of the building security ganged up and beat up two resident tenants, about 200 residents got so angry with Rathee's continued atrocities that they all got together and went to the police station and complained to them. The police station was already aware of Rathee's doing since they had recieved numeruous complaints against him in the past also - One such complaint (lodged at sadar police station - gurgaon) in the past was from a pregnant woman who is also a resident tenant of sispal vihar - she complained that rathee used very bad language on her and also pushed her and asked the guards to throw her and her husband out of his office only becuase they went to Rathee's office to compalin about the water problems. She was hurt in the incident.
After all the residents complained to the police station together, Police troops marched in to Sispal Vihar and went to Rathee's house to arrest him, he was found hiding in the building. He was kept in the jail overnight with various charges against him and the court released him only on bail the next evening.
The most common complaint against Mr.Rathee is that he is a person who always uses very bad language while talking to people, he tries to threaten people all the time and acts like a goon. He thinks he has become the president of India, becuase when one starts objecting to his rude language the one thing that he says is " Do you know who you are talking to? I AM THE PRESIDENT "
I mean, seriously --- Mr.Rathee - Are you the president of India???
WOW.... I really cannot understand how such a person has been elected to represent this society . For him, I think RWA is not resident's welfare association but Rathee Welfare association.
He has appointed his own man as the designated broker of the society - so everyone who wants to come to sispal vihar as a tenant has to deal only with this broker and not any other broker. Other brokers also follow the same rules, same police verification, etc then why only one broker and that too the one selected by Rathee is appointed for this. I wonder why this is being done? Not difficult to guess, i think.
So Ms.Kavita Kharab and Mr.Amar - I am sorry, the mail forwarded by you is indeed true and it is indeed shameful to have such a president manage the affairs of the society. And I am really happy to know that there are people like you who are fair and just in their thinking. Hats off to you !

In your mail below, you are making a point that other societies are charging about Rs.6-8 per sq ft for maintainence. For him I would like to humbly state that please wake up and get the real picture and do not comment on something that you are not aware of - please calculate the total cost at this rate for a 3 BHK, it comes out approx rs.15000 Rs per month.
DO YOU WANT TO PAY 15000 PER MONTH FOR THIS PLACE?. I AM SURE YOU DONT WANT TO BUT I KNOW YOU WILL WANT TO CHARGE THIS TO TENANTS, ISNT IT ???
Which society charges this high? Societies across Gurgaon (Uniworld, Orchid Petals, Vipul Greens, etc) are charging maximum of Rs. 5k per month, which have beautiful infrastructure, with 3-4pools, 100% power backup, top of the line security, well equipped gym & club & other top facilities, ( all these charges are part of the monthly maintenance) which our society can just aspire to in future!
There are societies which are charging merely Rs. 500/pm for 80% power backup & similar facilities as our sispal vihar.

Please understand that anywhere in the world - any capital expense of any kind in a residential building is always paid by the owner. every owner of a flat anywhere in the world buys the flat from his own life savings... SO YOU ARE NOT THE ONLY ONES TO BE DOING THIS. If you want to upgrade the gensets, its a capital expense and the owner has to incurr it. this is life and there is cost of living. You should have thought about this before buying this place.
But this doesnt mean that you extort money from someone using unfair means to make your life secure. If you cannot afford maintainence of clubs, etc then who is asking you to run a club.... dont run it but dont resort to unfair means like being partial.
If one day, All the flats get occupied by the owners, will you then say that charge only from others and not from me???
We tenants are also owners of flats in our respective home areas and we have always paid for any capital expense incurrred in our building. These are not passed on to tenants. The tenants only pay the monthly maintainence which are also charged in a very fair way and not like here where the maintainence for same size of flat is being charged differently to owners vis-a-vi tenants.
HOW IS THIS FAIR???? If people complain to the consumer court, please note that they will react very fairly.
You guys collect more than 30 lakhs per month as maintaience... where is all that money going??? You are saying that there is no money with the society....so where is all this money going? This 30 lakhs does not include the commissions from pool/gym/maids/iron wallah/children coaches/ property dealer/ shop rentals & charging for common parking areas (car parking etc) which is a huge amount in itself
Can you believe it....even the maids comin to work in the bldg were asked for a commission till recently. The car cleaners were asked for commission. Every vendor coming inside is asked for commisssion.... raddiwaala, paperwaala....etc.

You want annual charges from only the tenants for this fully functional club of yours and then over and above that also charge them for every usage everytime?????? Can you get more ridiculous than this?
You are demanding compulsorily this 5-10 K only from tenants for club charges and then saying that if we leave within one month or two month of paying the charges, 50% will be refunded but for this we have to give 3 months of notice before leaving else it wont be given.
Now, please apply your mind which I dont think you have - that a notice period for leaving a rented place is one month so how do we give 3 months notice for the refund..... This shows your intentions....
and after that tenant leaves you will charge that amount again for the same flat.... PLEASE WAKE UP RATHEE.... FEAR GOD !

The power situation is going downhill with the backup taking almost 30 mins to start, there have been numerous instances of kids/ elders having been rescued from the lifts! We have no clarity on the units & the amount being charged for normal & backup power, this summer the cuts are over 15hrs! 33kva has not given any reprieve as being propagated by RWA, Our power bills have gone through the roofs, we have only 1 AC working for max 8 hrs per day & we are shelling close to 8k per month on account of electricity only .
We are going to complain to the consumer court against you - Mr.Rathee, that you through the office do not share the electricity consumption details with the people who are paying for it. We have the right to know how many units we are consuming?? We will get an audit done and the meters checked and then it will be clear.
And for humanity sake Mr.Rathee, learn to live in a civilised society and in a humanely way. please learn how to talk to people, go and take classes if you have not learnt any lessons of living in a civil society. It is of complete shame that you had worked in the army. I had so much respect for the army before I came to know a person like you.
So when you say in your mail below that people who bring bad name and shame to this building and army should be asked to leave the building then you are the first person who should be thrown out of this building. You certainly do not deserve to be amongst this civilised society. There are so many army people living in sispal vihar and my god....they are so gentle, well behaved, well dressed that I just start respecting them the moment I talk to them. but this is not in your case.
Your actions have brought utter shame and disgust to the name of sispal vihar... and word has spread about what you do to the people living here and now there is general resentment amongst people all over gurgaon that Sispal vihar is a bad place to live... the word is spreading through the offices where people living in sispal vihar are spreading through word of mouth as to how sispal vihar controlled by person like you is ruining the peace of people living here and now people dont want to shift here..... this is ultimately going to bring down the prpoperty prices and even the rentals of this place.
Now when the meeting date is coming close, you are getting the bldg maintained like the government people do by cleaning the roads just before the minister is about to come.
You shuold see how this work is being done in the bldg - there are no lights in the lobby near the lift becuase the switches are bad and damaged....so your guys have taken off the switch and just did a temporary connection through open wires.... Anyone could get electrocuted.
AND YOU HAVE THE FACE TO INCREASE CHARGES WHILE THE MAINTAINENCE IS GOING TO THE DOGS?
In your mail below, you are saying that someone (tenants ) are enjoying at owners expense... with genset cost rising etc..... For your ifnormation, tenants are not living here for free, they are paying rent to owners so that owners enjoy more money and also paying maintainence for this building. So how are we enjoying at your expense?
The maintainence cost are decided based on certain parameters - facilities provided, amenities, etc... you cannot just on your whims and fancies and also on your greediness, levy unfair charges and that too only to tenants who are paying for the same zie of flats as yours or others.

Do you know, any notice related to charges, or meetings are pasted on the board without any signatures from anyone. Its only written ' Sispal Vihar, RWA" . This is illegal if you must know.
Other type of notices like celebrating a festival, camps, etc are properly signed by the concerned authority.... so then why not other types of notices.
For your information, no tenant was askng for voting rights, but after seeing the hera pheri done by this president, we wanted it but if everything is going fair and equal treatment is given to tenants, we do not want such rights.
This RWA has disabled the login ids of tenants on the sispal vihar website..... for your information these tenants are the residents for whom you have taken up this presidentship to serve them with honesty.... What are you trying to hide by not giving access to tenants???
Mr.Rathee is saying that tenants targetted only the president which is him but did you or the other esteemed members notice that the people have only complained against rathee's behaviour, hooliganism etc and not against the RWA. It is becuase of your behaviour with people that you are being treated with the treatment you deserve. All the complaints against you in the police and court against your actions, gundagiri, voilence etc and no complaints are regarding anything civil or society affairs related.

Did yuo know, on the orders of Rathee, the guards accompanied with gundas from outside knock on the doors of the tenants when the men are out for work and ask all sort of embarrasing questions to the women in the house under the pretext of finding out who is living where,etc.... The women just dont feel safe anymore with these guards...
So what kind of security is Rathee talking about when his security people themselves are a big threat to the people residing here.

- In the past inadvertently the maintenence charges/other expenses like AMC charges for DGs etc were kept low & large expenses had been written off from Capital which is mere 2 cr, and has been contributed by all allotees from their life savings.
The above anomoly has been corrected to some extent by the present RWA.
What instead should have been done, that all current expenses like maintenance/AMC etc should have been recovered from current users be it allottees or tenants so that Assetts for which all we have shared in the past for their replacement you always have equivalent amount deposited in capital.
Secondly we need to create sufficient capital for our future needs when the time comes for replacement of these assets & also with the aim of creating new assets to make life worth living for long term users. The resources can only be generated from some assets the society collectively has ie., Shopping centre rentals, rentals from club, school etc....if these asstes are not utilised today..we shall never be able to generate funds for our long term capital requirements.
By subsidising our today we can all create problems for our future...the choice has to be excercised by us all allotees. As the time passes more & more of our brothers who are currently serving shall come to reside in the houses & what they are going to face is no worth while funds as capital..a detoriating asset base requiring immediate replacement no worth while fund generating mechanism.
Do excercise your vote for starting this today...or postpone this at our own peril..the choice is ours to make...so make it...but be delibrate...
The maintenance charges in similar colonies..nearby is 6-8 Rs per squarefeet. Where as we pay less than Rs 2/- per sq ft.

SHOW UNITY TO FACE WITH PROBLEM AND NOT TO WASH OWN DIRTY LINEN. FORGET PERSONNAL PROBLEM AND HAVE FAITH IN RWA WHO IS TAKING BULL BY ITS HORN.
RWA CONTINUE GOOD WORK BUT SLOWLY AND STEADILY. CANT GIVE VOTING RIGHTS TO TENANTS BUT WILL LEASEN TO THEM.
PLEASE GIVE VACATION NOTICE TO TENANTS WHO WANT TO BRING BAD NAME TO SOCIETY AND TO ARMY IN PERTICULARS. DISCIPLINE HAS BEEN THE SENSE IN ARMY , DEAL WITH IT.

As for seperate charges for tenants and owners ,this is something which i too as an owner did not acceed to and hence resigned as an RWA member after the very first elections .
All are same and we have a huge kitty which can be utilised for all work and not look for fleecing anyone or as a profit making venture.Ideally all accounts should be audited from an external agency closed by residents and any society member can check accounts anytime.
Last year balance sheet had too many loopholes .
Lets be honest ,to others as well as to ourselves

It is with utter disappointment that I am writing to just let you know how
one man - a retired army officer who became the president of a residential
society is bringing shame and bad name not only to the residential society
but also to every institution concerned with this society.
Mr.Rathee who is the president of RWA of Sispal Vihar, AWHO sector-49,
Gurgaon has been harrassing the tenants living here since long, to the
extent that he thinks he is above law and considers himself the president
of India. He has the guts to go about hurling worst abuses to ladies,
hitting them, etc.
Just yesterday, he was arrested by the police because he ganged up with the
guards of the building and beat up a tenant with baton and chairs.
When the building members got to know about this, they gathered in big
numbers and called the police and had him arrested.
I was shocked and found it difficult to believe that Mr.Rathee is a retired
Army officer. Shame on him !!!
Does he think that tenants are poor homeless people that he can treat them
like this? I think he should know that all the tenants living in sispal
vihar are well to do , well educated people having their own BIG homes in
their home towns, who happen to be here in gurgaon for work only. They also
have rented out their own homes and treat their tenants with respect.
All this is happening becuase Mr.Rathee has been devising new ways to
extort money from the tenants somehow. The latest issue being charging a
mandatory club membership only from tenants. Why this step motherly
treatment towards the tenants?
every facitilty has more charges for tenants than for owners. The tenants
in Sispal vihar constitute about 95% of people living there.
When RWA doesnt invite votes from tenants living here for electing their
president becuase they dont consider tenants to be members, they dont give
any right to tenants to even discuss the unfair charges, then why shuold
they even talk to tenants or ask money from tenants for club charges. they
should be talking to the owners and not tenants.
By the way, the owners have already paid for club membership. So why double
charges from same flats for one thing?
the list of complaints against this Mr.Rathee is unending.
I AM WRITING TO YOU TO JUST COMPLAIN ABOUT THIS EX ARMY OFFICER, WHO IS

I have been staying in this society for 2 years plus. I can say for sure that a lot has happened in this society for good in last 7 months. To begin with HUDA water supply, 33KWA sub station, swimming pool opened, badminton courts on podium, Club infrastructure ready to be opened etc. However, when things seem to be going fine there is always a trouble lurking to just happen. Let me put a few things in perspective. The current RWA has not been charging tenants anything exorbitant. They are just being charged the market rate for certain services. Yes, the owners have been given a discounted price for the same services. Otherwise, the General maintenance charges are the same for everyone. The differential prices are only for the Club facilities. Club membership is Non-transferable. Therefore, the Tenant needs to pay an amount to use the club facilities. The rates that are being charged to tenants by RWA for these club facilities are by any standards less than what is being charged elsewhere. As far as Club membership is considered, this has been discussed in last GBM that club membership is mandatory for all tenants. Now the onus of communicating the same to the tenants lies with the owner. What I would suggest RWA is that they deal with owners directly. RWA should collect Club membership charges from the owner, whenever the house goes on rent. Let the owner collect the same in form of rent or whatever way from the tenant and allow the tenants to use Club. It’s a win-win situation for all. Some of the tenants have no respect or bonding to the society or its RULES. They use foul language while dealing with the maintenance staff. They have even beaten them in past. They argue with the security staff at the gate for petty reasons and for every reason start abusing army people and their ways. It is invariably the President that gets to hear all the cheap adjectives. A few weeks back, one of these kinds of tenants removed Complaint phone receiver from the cradle and was fighting with the maintenance staff. Now, others start cursing the whole set-up for not answering their calls. There have even been instances where the tenants have sub-let the house without the knowledge of the Owners. Then the same owners run to RWA for help. Col Rathee and his team have tried to curb this nuisance. I have attended all Interaction meetings with RWA. I know they have worked very hard to get the society where it is today. This RWA has interactive sessions on every last Sunday of the month. None of these so called cribbing tenants ever turn-up there. These temp residents (tenants) are not interested in what happens in the society. The ones who turn-up on these interaction sessions return satisfied with the logic and reasoning provided by RWA. Yes, there are shortcomings aswell. However, present RWA team cannot be blamed for the deficiencies that they have got in inheritance from AWHO and or previous RWA. (Leaking pipes, low standard Gensets, not 100% power back-up, still no primary school, No software to service Gensets, and the list is long.) |

Great job. We all must thank the Rathee team for such a wonderful work. let the residents see for themselves, the facts as brought out deserve to be appreciated. I do agree that if someone is sincere and genuine then it is a social service to actually work for the collective benefit of the society. We all know that the person in authority has to take hard decisions sometimes for the overall well being. Lets support the RWA in its efforts, but certainly we would expect it to be transparent in its dealings to gain the confidence of all. A genuine person will have least trouble coming clean... |

My Point Is that society does not belongs to him, Society belongs to people who live in it (in reference of any celebration) , Tomorrow is a day of celebration so let us celebrate, now question is who is organizing it ?
this is disturbing and Vivek is right on that part that conscious might have a problem specially after knowing the “Zahar” he has for tenants but if you see todays’ post it seems he has a discomfort with anybody who is in opposition, he feels AWHO is corrupt or do not know how to design the buildings , old RWA’s are corrupt and inefficient , Lift company is chor , Generator company is chor , diesel utility people are chor, AWHO employee who is a watchman is responsible for electricity problem in our society. Basically he is making an environment that whole world is problem and only he is going to control the problems.
Bottom line is, his thinking orientation is wrongly directed and his thoughts are also misleading to people , let us not spoil our Independence day and not boycott at least flag hosting (Y’day is a day to wear TIRANGA, why to wear Black for a sick man if that is the case).
