The future of pay television in Australia?

Matthew Kidman (Sydney Morning Herald, March 31, 1997, p.29) reports
that Optus Communications' chief executive, Dr Ziggy Switkowski, will
push ahead with plans to rationalise the pay tv (and local telephony)
industry in Australia. Dr Switkowski's wish list is to:

1. Restructure Optus Vision;
2. Come to a deal with Telstra on sharing cabling; and
3. Come to a deal with the other four pay tv operators on sharing
programming.

The first of his wishes came true on Good Friday, with Optus
Communications announcing it had come to an agreement with their other
partners in Optus Vision--US West (formerly Continental Cablevision),
Pay TV Holdings (Publishing & Broadcasting Ltd), and Tallglen Pty Ltd
(Seven Network)--to buy them out. Dr Switkowski is working on the
second wish with negotiations continuing with Telstra for a cable
sharing accord. The new ownership of Optus Vision should help with
the negotiations. The third wish of programme sharing, or as Dr
Switkowski calls it, 'an understanding on content management', remains
to be decided. Initial talks are taking place that could see all
movies and sports shared between all the pay tv operators. Dr
Switkowski also wants all the pay tv companies to sit down with the
Australian Competition and Consumer Commission (ACCC) and the Federal
Government to decide whether mergers of the pay tv companies will be
allowed.

Deregulation of Australia's telecommunication industry begins on July
1, so pressure is on to get things sorted out before then. Also, both
Optus Communications and Telstra will be floating on the sharemarket
this year, so time is of the essence.

Foxtel enters PPV arena

Foxtel have announced their own pay-per-view channel and the Pernell
Whitaker v Oscar De La Hoya WBC Welterweight Title Fight from Caesars
Palace on April 13 will be the first event. EVENT TV can be found on
channel 33. Foxtel are charging customers $39.95 for the fight with a
$10 discount if purchaced by April 11. Optus Vision's MAIN ATTRACTION,
which has been on air for a couple of months already, will also be
screening the event.

Musical chairs

Both Optus Vision and Foxtel have relaunched their main music channels.
MTV AUSTRALIA commenced on Optus Vision channel 4 on March 20 replacing
ARC MUSIC TV. CHANNEL [V] will commence on Foxtel and Galaxy on April
18 replacing RED MUSIC TELEVISION. Both new channels will have new
programming mixed with some programming of their replaced channel.

Optus Vision strike deal with Warner Bros and Turner

Optus Vision has struck a deal with the merged Warner Bros and Turner
companies in the USA to provide a general entertainment channel to
subscribers which will include the best programmes from Warner Bros
and Turner. This channel will replace the previously announced WBTV
channel which was to only include programmes from Warner Bros. The new
channel will be available from mid year, together with a documentary
channel and a performing arts channel.

Advertising on pay tv

From July, all pay television channels will be allowed to carry
advertising, currently only available to the narrowcast channels.
Deborah Brewster (The Australian, January 28, 1997, pp.19,24) reports
that Foxtel and Optus Vision last year appointed sales directors, with
Austar to make an appointment soon. To help potential advertisers in
selected which channels to advertise on, Optus has signed a five-year
deal with AC Nielson to provide it with pay tv ratings from April.

Pepsico became the first Australian company to advertise on pay tv.
Two Pepsico brands, Pepsi Max and KFC, aired on MAIN ATTRACTION on
March 2 during the pay-per-view boxing match between Sugar Ray Leonard
and Hector Macho Camacho. MAIN ATTRACTION is classified as a
narrowcast channel and can advertise before July 1.

Foxtel and Galaxy subscribers rate their channels

The Sun-Herald (January 26, 1997, p.13) reported that an independent
survey was conducted with Foxtel and Galaxy subscribers asked to rate
the channels they receive. The survey was conducted in November last
year by researcher Jigsaw, using 5000 subscribers as a sample and was
commisioned by XYZ Entertainment which provides ARENA, RED MUSIC
TELEVISION, NICKELODEON/NICK AT NIGHT, and THE DISCOVERY CHANNEL to the
pay tv carriers. The percentages for each channel with subscribers
aged 25-54 were:

Hello and welcome to the April edition of pay tv and sport. In this
edition, we will report on all the lastest news and list some of the
highlights in the sporting world of pay tv.

Our April cover story is Not Quite the Mainstream. We feature all
those sports which although have struggled to gain attention on free to
air television, have found a timeslot for their sport on pay tv.

In our news section, there is a report on the fight between pay tv and
free to air tv to gain rights to major sporting events and much more.

As well, we will highlight all the big sports on pay tv this month.

Cover Story

Not Quite the Mainstream

In summer it is the cricket, in winter it is AFL, Rugby League and
Rugby Union. It is the cricket, AFL & Rugby League, and to a lesser
extent the Rugby Union, that fill our sports pages in our daily
newspapers, on our television screens, and on the radio.

However, besides the sports mentioned above as well as other major
international sports like the big tennis and golf events, there are
sports which are relegated to late night timeslots or short segments on
Channel NINE's Wide World of Sports.

These sports are usually the ones which appear in the 'in brief'
section of the sports pages or in the last five minutes of ABC Radio's
Grandstand show on the weekend. Sometimes these sports don't even get
any coverage.

The sports which we talk about here are things like the Extreme Sports,
Squash, Wrestling and Billiards and Table Tennis. There are sports
which although may be popular elsewhere in the world, do not get much
attention from Australian free to air tv. Sports such as Ice Hockey
come to mind when thinking about this. As well as the other major US
Sports such as the Baseball, NBA and NFL.

During the Olympics, we cheer at our Aussie athletes such as Freeman in
the running and Perkins in the swimming. However, their progress to
get to that stage is rarely covered by free to air. However, pay tv
seems to cover it. The same deal is with the tennis and golf. We know
about Wimbeldon and the French Open in the tennis and the US & British
Open's in the golf, however the tournaments for the rest of the year
are rarely covered.

Even some of the more popular sports have managed to appear on pay tv
due to the lack of interest from free to air. Netball is considered
one of the most popular sports yet has only managed highlights packages
on the ABC. Pay tv has seen it gain live games in their new revamped
league.

Sure, there are those critics of pay tv sport. You may hear people ask
how many times you have seen synchronised swimming and turtle racing or
something along those lines. However, pay tv has given the opportunity
for people interested in a particular sport to have the opportunity to
see their sport on the box instead of being confined to the staple diet
of sport given by free to air television.

Pay TV Sports News
=======================================================================

Free to air scores victory in fight for sports rights

Free to air television has scored a significant victory over pay
television with a Federal Court ruling stating that pay-tv operators
could not buy greater rights than free to air television for major
sporting events.

The decision means that pay tv operators will not be able to bid for
sporting events which the Federal Minister for Communications (Senator
Richard Alston at the moment) feels are important. So, the deal means
pay tv will have to negotiate with free to air for broadcasting rights.

One dayers live on free to air

Channel SEVEN will be televising live the one day cricket series
between Australia and South Africa. Channel SEVEN will show three
entire matches live and three matches live from the second innings.
One other match will be shown from early in the first innings.

FOX SPORTS manager Gary Green said: "after a meeting today we can
confirm the Seven Network will be screening games live, either in total
or just part of it."

Seven had already acquired the rights to broadcast highlights of the
South Africa-Australia one day series.

Channel TEN reporter rumoured to join SPORTS AFL

Channel TEN reporter Peter Donegan has quit his job as a sports
reporter at Channel TEN. Donegan, who played a crucial part in helping
Channel TEN regaining the rights to the Melbourne Cup filed his last
report for Channel TEN in late March. Although Channel TEN would not
comment on Donegan's resignation, it has been rumoured that Donegan was
not happy with his job at TEN. Further rumours say that Donegan will
be joining Optus Vision as part of its SPORTS AFL channel. Donegan is
one of several reporters to have quit free to air television to join
pay television. The list includes Cameron Williams, who hosts Fox
Sports News Australia was a former Channel Seven reporter.

SUPER LEAGUE

Super League kicked off in March with the Brisbane-Auckland match. The
pre-game entertainment was an expensive affair with Jon Stevens and
Belinda Carlise making appearances. Since that first game, Canberra
have struggled and are yet to score a victory at the time of writing.
Of the other teams, Penrith, Brisbane and Cronulla are doing well while
the Mariners are at the bottom end of the table.

Once again, the Foxtel Programme Guide fails to give us details about
match coverage. Foxtel viewers are asked to see FOX SPORTS TWO for
programme details.

The ARL started their 97 off one week later than Super League.
Although it probably wasn't as glamorous as the Super League start, the
ARL has produced some good games as well. Manly have shown that they
will be the ones to beat this year, winning all games except one which
was a draw against the Steelers.

Melbourne's shock win over 96 Premiers North Melbourne was the game
which started a brand new AFL season. North Melbourne are in early
trouble losing key players including McKernan and Carey in the first
round for several weeks. Teams which should be in a finals spot come
the end of the season include the Roos, Blues, Lions and Bombers.

SPORTS AFL has now gone 24 hours a day. This month there will be games
covered live and exclusive on SPORTS AFL. There are also all the other
news, reviews and interview programs on throughout the week.

Super 12s Rugby has begun and has probably found themselves with bigger
crowds due to the fall out in the ARL/Super League battle. FOX SPORTS
have an extensive coverage of many of the matches shown during April.

SPORTS AUST will be broadcasting the NSW Rugby Union Championship (The
AAMI Cup). Considered the 'lifeblood of Australian rugby union' this
season should be a highly entertaining one.

NETBALL

Although one of Australia's most popular sports among females, netball
has received little coverage on the television. Netball has struggled
to find sponsors and to have an organised league. This year, though,
there is an eight team competition and there is the Commonwealth Bank
as a major sponsor. Netball will be getting television exposure
through SPORTS AUST.

CRICKET

Australia have won the test series against the South Africans. Now, it
is the seven one day internationals. Can Mark Taylor actually make a
score past fifty? Will Australia's bowling be able to handle the
pressure without McGrath? Will Ian Healy be able to control his
temper? Although Channel SEVEN will be convering each match
extensively, FOX SPORTS will be covering all matches in full-commercial
free.

South Afica v Australia

BASKETBALL
----------
The NBA Playoffs begin late in the month. Chicago are still as
dominant as ever and are favourites to take out the championship.
Interesting to note that Dennis Rodman will be appearing in an action
movie which opens in the US this month. On the court, ESPN and FOX
SPORTS will be covering the rest of the NBA season as well as the early
playoffs.

In Australia, the NBL and WNBL seasons also begin with coverage on FOX
SPORTS. The first match to be covered is the North Melbourne v Sydney
match. Other games include Newcastle v North Melb and Sydney v Perth.
Australia's female basketball team, the Opals will play Japan this
month. The Opals series will be covered on SPORTS AUST on Apr 2,3,6 &
7.

College basketball reaches its climax with the men's NCAA Championship
Final on April 1 and the women's final on April 2. Both are on FOX
SPORTS.

News Corporation, Telstra -v- Australis Media, Optus Vision

Foxtel partners, News Corp and Telstra, are suing Australis Media
(Galaxy) and Optus Vision (OV) over their satellite pay tv partnership,
alleging that it breaches the programming-based joint venture between
Foxtel and Galaxy.

Seven Network -v- Optus Vision

Court proceedings commenced where the Seven Network sued, claiming that
an options deal between fellow Optus Vision (OV) shareholders, Optus
Communications, US West and Publishing & Broadcasting Ltd (PBL),
improperly disadvantaged them. An out of court settlement was reached
where Optus Communications bought out the other shareholders in Optus
Vision. The other shareholders will pay for convertible notes which
will give them shares in Optus Communications' $4 billion dollar public
float. The float is expeced in the second half of this year.

Mr Hadid is suing Australis Media (Galaxy) and others, claiming
$158,000,000 in damages over disputed MDS licences.

News Corporation, Telstra -v- Australis Media, Optus Vision and

Foxtel partners, News Corp and Telstra, have lodged a statement of
claim in the Federal Court arguing that alliances between Australis
Media (Galaxy), Optus Vision (OV), and Publishing & Broadcasting Ltd
(PBL) will lessen competition in the pay television industry.

United International Holdings (Austar) -v- Australis, Optus Vision

One of Galaxy's franchisee's, United International Holdings (UIH), is
suing, claiming that the Australis Media (Galaxy) and Optus Vision
alliance is in breach of its own arrangements with Australis Media.
Out of court negotiations are set to commence to allow Optus Vision
channels to be made available through Austar.

East Coast Television, Continental Century -v- Australis Media, Optus
Vision

Galaxy franchisee East Coast Pay Television Pty Ltd (ECT) and one of
its affiliates, Continental Century Pay TV Pty Ltd, have begun legal
action against Australis Media (Galaxy) and Optus Vision (OV). They
are seeking injunctive and declaratory relief and damages in relation
to alleged breaches arising from Australis' satellite joint venture
with OV.

less money in our pockets. So what is it all about? This is the
