NSW RTA forces you to take all Tests from scratch after DISQUALIFICATION?

Hello.

I am trying to find this on AUSTLII but could not.

Can someone assist?

I am 45 years of age.

The NSW RTA told me that if a person has 12 MONTHS OR MORE period of *DISQUALIFICATION*, they must sit all their RTA Tests again from scratch. Like when you were 16 years of age!

I have just completed my 12 month Disqualification in June 2012 (started in May 2012), and the RTA today (July 2012) told me that I must sit all my Driver Knowledge Tests, P1 and P2 & Motorcycle tests from scratch if I want my Licence back.

Can someone (Sylvia Else and others) please point out where this is stated in AUSTLII, for I could not find anything in the NSW ROAD TRANSPORT ACT?

Sounds like a brilliant idea to me. Particularly for the losers out
there who manage to get disqualified. How exactly DO you manage to get
disqualified without good cause? I've been driving for about 32 years,
I drink, I even speed a bit... okay, quite a bit... but never lost my
licence. And I've lived all over Australia, it's not a case of me
being lucky and living in an area not heavily policed/enforced.

I'm wondering what kind of irresponsible arsehole you need to be to
get disqualified...

In fact, I wish ALL drivers had to re-sit their licence once a decade.
If I had to sit the test tomorrow, I know I'd never pass... not the
written test, at least.

Very good question.
I know a few who have and its usually multiple drink driving offences so
any who does that deserves a very long disqualification.

In 2003 I upgraded my truck license to semi and had to do driving test
but no written test since I already had a heavy rigid license but I'm
confident I would pass, the Vic Roads web site has practise tests on line.
Daughter in laws sister failed her driving test recently because she
merged onto a freeway along side a car that was in the next lane, when I
was told that my response was WTF?
I can't find anything in the rule book that says you can't do that and
apparently the instructor hadn't heard of it either, sounds more like
the tester was just being an arsehole.

Does anyone actually know please point out where resisting Tests is required on AUSTLII.edu.au, for I could not find anything in the NSW ROAD TRANSPORT ACT?

I'd be challenging that if it were me, as it's part of normal freeway
discipline.

next time yer disqualified, make sure its less than 12mths :)

Seemed perfectly acceptable to me and apparently the instructor has made
a complaint so I'm waiting to hear what happens.

No, there was no one in her (left) lane, it was a 3 lane freeway and the
other car was in the middle lane.

Why is this so

If a TTO Grants a license and blogs later is proven to have been
improperly trained and or tested
Even worse if there is injury or death
The instructors and TTO can get called in and they wear a charge
also . (if deficiencies in the system are found )
This is as it should be and modification of the training methods and
manuals are corrected .

A Classic example of this was when ARMY got all wheel drive landies
(as opposed to 2 or 4 drive by choice)
Suddenly diggers were rolling the new landies left right & centre .

The system was flawed as no or little CONVERSION training was
undertaken on existing ECN holders for landies .

In a perfect world some of the civilian driving instructors I have
seen Especially in WA would not last ten seconds .

He told me about doing a de bogging training exercise in Townsville
during a period when there hadn't been much rain so no bog holes, the
trainee's thought they wouldn't have to get dirty but my brother and his
mate took a large Mack water tanker out the night before and dumped the
lot in the middle of the training track:-)

Its certainly too easy to get a drivers license but failing someone for
a rule that doesn't appear to exist is ridiculous.
