Where does it say in our lease that the Atrium can also fee the unit
owners for ENERGY SURCHARGES per guest per day? There has not been any
discussion on this matter but if you read your contract it clearly
states in paragraph 10 "Said annual maint. charge shall be utilized to
pay taxes, maintenance, furniture replacement, insurance UTLITIES
and . . . ."

Veeerrrry Interesting. When we received our first notice mid-October
2006 Festiva described that special assessments were noted in its
revised Rules and Regulations that was supposedly distributed
throughout all the owner suites. When I called them on October 31 to
discuss this alleged Rules & Regulations (which we did not ever
receive a copy of) they said that they would e-mail it to me.
Throughout our conversation? she numerously cited that the Rules &
Regulations specifically stated that they can do this and that I
should have received a copy. When I tried contacting them later that
early afternoon I could not reach anyone there. [Their phones were
tied up?] Subsequently, I received their Rules & Regulations .pdf
document e-mail from Debbie Shroyer sent at 5:29 pm. The topic of
special assessments conveniently appeared at the conclusion of the
Rules & Regulations. SPECIAL NOTE: When I further investigated
this .pdf document I looked at the PROPERTIES of the document. The
creation date was (you guessed it) October 31, 2006.Draw your own
conclusions. I have mine.If you would like a copy of this e-mail
please advise and I will forward ASAP. Glad to help.
