Loss of rights to unit

I am concerned about the possibility of losing my rights to my unit for
next year if I don't pay the special assessment. I have already paid
$910 and would owe another $1820 for my two weeks. We are going at the
end of February, which doesn't give us much time to settle this
lawsuit. Does anyone have any information as to how soon we can expect
this lawsuit to end? Is anyone else worried like I am?

I received my threatening letter via certified mail today. All very
polite, but to the point: pay up or else. I certainly hope the courts
in Sint Maarten move quicker than they do in the U.S.

I have just been informed by "Claire" at Festiva that members will be
denied the use of their units if they haven't paid in full the
assessment and the maintenance fee as billed. Alternatively, Festiva
will accept non-cancelable automatic monthly payments (January through
May) via credit card or bank draft. Previously, before I asked to
speak to a supervisor - that's Claire, I was told by "Sara" that the
automatic payment option wasn't available to those without a "zero
balance" upon check-in (i.e it wasn't available to those with weeks in
the months Jan. to May. I wonder whether others have received the same
message.)

Members should be sure to read Rowie's latest litigation update. From
now on it will be featured on a page "Recent Litigation Messages from
Rowie" as well as in the discussion area. It should be clear that all
owners who have joined the lawsuit - at minimal cost (there's strength
in numbers) - are making their payments under protest. All members are
advised by counsel to apply the term "in dispute" to
their payments.

We're at the Atrium right now. There was a note in our apartment
advising us that the annual "owners update" would be a mandatory
meeting, otherwise a waiver would have to be signed. We haven't had the
meeting yet, but we're expecting the demand will be made of us to pay
up or else. We'll keep all advised.

To date, no one who has paid the contractually obligated Maintenance
Fee has reported to us that the use of his unit has been denied.

We went to our "mandated" meeting and came away scratching our heads
why Festiva would insist on signing a waiver if you refused to do the
meeting. All it was was the typical update and pitch to sell unsold
weeks. A real bunch of nonsense.
