Senate Bill 1196 is an attempt to eliminate the right of homeowners to hold builders and developers responsible if the neighborhood improvements (i.e.: roads, stormwater ponds, gates) are defective.  This bill, if it becomes law, will eliminate all rights that homeowners have to protect their property values, if the developers and builders walk away from their responsibilities.  The law will apply not only to future claims, but also to existing claims.

Senator Audrey Gibson, Senator John Thrasher, and Senator Steve Wise all voted against the rights of Florida homeowners and in favor of this bill.   Consider the impact on your home and community if this becomes law leaving homeowners paying for defective work through higher assessments.

The Florida Legislature when faced with defective construction, poorly built homes, and crumbling roads has chosen not to address the problem through better enforcement of building codes.  Rather, their solution has been to protect builders passing laws, year after year, which transfer the financial burden from those responsible to Florida’s homeowners.

What do you think?
