My views to EC on above:
1) Specify the name of eminent legal person as per sl no 1
2) Our GBM it was clearly concluded that election will be conducted as per Bye laws only and association dues will be the criteria. Why now this change when nomination deadline date has come? why this was not conferred in the first meeting?
3)We need to have the signature of other 3 EC members also with their views as this is an important resolution going against the spirit of bye laws and unanimous decision in GBM
4)clause 3 (g) of Karnataka Apartment ownership ACT 1972 states
"(g) “common expenses” means,- (1) all sums lawfully assessed against the apartment owners by the Association of Apartment Owners, (2) expenses of administration, maintenance, repair or replacement of the common areas and facilities; (3) expenses agreed upon as common expenses by the bye- laws; (4) expenses declared as common expenses by the provisions of this Act or by the Declaration or the bye-laws:
5)Clause 17 of Karnataka Apartment Owner ship Act 1972
17. Waiver of use of common areas and facilities; Abandonment of apartment.- No apartment owner may exempt himself from liability for his contribution towards the common expenses by waiver of the use or enjoyment of any of the common areas and facilities, or by abandonment of his apartment.
6) Clause 6 of Byelaws talks about 60 days arrears to association/club house
7)Where it is mentioned on builders dues in The Karnataka Apartment Act or bye laws
8) When owners r coming forward on their own to give a full fledged board thru democratic means to serve the community, why mis-intrepretations of bye laws or apartment act to confuse & spoil the peace & harmony.
Request EC to go as per bye laws & last GBM for a smooth free & fair election or CALL FOR AN EMERGENCY GBM TOMORROW 10 AM TO EXPLAIN UR MIS-INTERPRETATIONS.

Dear Owners, Please find the attached MOM of our recent meeting.
1. Maintenance dues pending to builder will also part of overall maintenance due and would attract the disqualification clause as stated in the bylaws.
2. There will be alternate methods of voting beside online as was asked by residents over email.
