LJ Thorpe admits Judges bound by the procedural rules

Semi victory on an appeal yesterday.

LJ Thorpe and LJ dyson admitted that Judges cannot go behind the procedural rules even if their reasons are unimpeachable.

hence Judges can only make orders of the Court's own motion by notifying parties in advance of their intention and permitting written and oral submissions if parties disagree with the decision.

Interesting Judicial reviw now been listed for December 18th 2007 at the High Court London.

Two cases one has already been given permission for JR and the other is for permission and JR to follow.

Both deal with the CSA not obeying Tribunal orders for disclosure not once but twice and when the CSA had agreed to disclose.

Tribunal admitted they had no powers to enforce their own orders.
