Hi Juan, Javier, et al,

Yes, I agree, the lawyer's charges are too high. Even 10% will amount to around 8,000 Euros for most people! If more buyers join the case, the cost should come down considerably as it's easy for the lawyers to add more names to the same case. I would join if the charges are reduced to ~4-5%

Also, what about if we won the case, will the developer pay the solicitor's fees?

Buenas tardes a todos, estoy de acuerdo con Antonio, el 15% me parece demasiado. Lo normal es un 10%, pero en nuestro caso, teniendo en cuenta el número de clientes y que el trabajo para el abogado es prácticamente igual para todos los expedientes (casi es un corta y pega), creo que nos deberían hacer un descuento extra. 

Es cuestión de negociarlo.

so you get a judgement in court in your favour that does not give us our money back have you any idea how difficult it would be to extract that money from them its been 7 years since I paid my deposit they simply don't care they are even trying to get more money from us to finish the building  we have had all the excuses the most laughable one was the weather they are totally corrupt that's their nature we should have been able to have our deposits returned does any body know  one person who has come close to doing that   it must have  sickened a lot off buyers to have endured this whole saga to the point where they would never want to set foot in morocco for the rest of their lives  we  need a lot of the people who paid deposits to come together

Hi Chris,

There is no consensus amongst British investors but a fairly large number of our Spanish friends decided to follow the legal route. A group of 15-20 people have already got a court order by which they are entitled to get their deposits back but I find solicitor's fees are quite high.

Solicitors offered a reduction if more people join in but not sure how many people have decided to go to court. They need to send the list of names by Friday.

I am still unsure whether the court can force the developers to complete and deliver the apartments if people prefer that instead of paying back the deposit.

I think if we can get a dozen or so together and agree a price and action, with the solicitor. Possible then give the developer the option of some sort of out of court offer, apartment or money, Before we proceed. He has already lost one case would he want to chance another?

That is a good idea and would be willing to go down this route,I must admit I am a bit reluctant to throw more money at this project and wait years for an outcome.

Also could we explore the route of legal proceedings with payment out of the settlement at the end when/if we win?
