Just now I received a call from Mr. D. C. Sharma regarding payment of construction installment of my flat. With the discussion I have understand that the Managing committee is not interested in committing anything about the end use and completion timing for the building.  I request you to look at my below email dated 11 March, 2015 and please reply what is the problem in having a binding agreement.

Dear Sir,

I am in receipt of your demand letter, before paying the demand I have few issues in my mind so that the construction and transfer of title is smooth for all the members.  I request you to put my following suggestion in front of the members attending GBM on 22/03/2015 as informed to me telephonically by Mr. Goel. 
Please look at the following Suggestions:

1. There should be a binding agreement between the members and the FOAM so that each of the party should know their rights and obligations.  It will ensure smooth payments from the members so that the construction is not halted in future.  It will also ensure responsibility on office bearers of FOAM so that they spend the money so collected in time bound manner to complete the project.

2. A Clear strategy is to be intimated to all the members which the office bearers wish to adopt for completion of construction and transfer of title  of their flat and in what time frame in their opinion.

3. An estimate to be prepared in a logical and realistic manner for all the balance work which is to be completed and what will be the share of each members in proportion to his area of the flat.

4. A cash flow and fund flow statement is to be prepared for the period in which the office bearers expect the work to be completed preferably on monthly basis.

5. An excel sheet be prepared which is suggested to be as below:
a) Name of the member
b) Address of the member
c) Flat No. Area of the Flat in sq ft.
d) Contact Details
e) Agreement amount with Ajs Builder
f) Total Amount Paid to the Builder
g) Total Amount Paid to the FOAM,
h) Total Amount Paid to PNBHFL
i) Total Amount required to be paid on account of construction
j) Total Amount remains to be payable.

6.  Copy of Balance Sheet and Income & Expenditure Account for the year ended 2012,2013,2014 and as on date be provided to each and every member.

7. Membership certificate alongwith photocopy of bye-laws of Association.

8. Present list of Various committees and names of the office bearers.

9. Construction estimates as submitted by contractors.

This will not only ensure total transparency but also improve the confidence of the members.

I can devote my time in compiling the desired information and preparing the binding agreement if the team is formed.

As you know, FOAM now has to complete the remaining work at MMT. The construction committee has been trying to get some contractor who can do the work and complete the project. For that to happen, the association needs money.

As a first step, the association has identified members who have not contributed their share to the PNB no-lien account and the construction cost @Rs 304/sq ft. The payment of this amount will put all the members on an equal level. It will also be fair to all those members who had paid the amount four and two years back, respectively.

This letter is a demand letter for that amount.

As per our records, your calculation is as under.

It is quite interesting that you want to have binding agreement , whom you want to bind , yourself , The FOAM is not builder nor FOAM has sold the Flat to you . It is a group of people who have suffered in the hands of Builder and than squeezed by PNBHFL and we are all in the same boat . I hope you understand the situation why it is not possible to have a binding agreement .
Reg your advice to the office bearers : No single office bearer is taking any decision , all decisions are democratically taken in EC or GBM meeting which you have not attended any . Moreover you have not contributed any thing to FOAM by way of contribution . My sincere appeal to you to contribute your share for membership fund (500), Legal expenses ( 5000) and Maintenance for 2015 ( 6000) plus pay your share for construction . All accounts are transparent and you are most welcome to know them once you contribute . We have so far not included any amount which is not paid as legal or other expense earlier by some members , it will be accounted for when we are able to bring the system to track and have some money to run the affairs .
No share certificate can be issued by FOAM as it is not a Housing society but a society registered under Societies Registration act 1860 and have adopted the model bye laws of UP Apartment Act 2010 and as per the ruling of Allahabad High court is at par with RWA to manage the affairs of the particular project for which it is registered .
I hope this makes the situation clear and I look forward to your cooperation and contribution at the earliest .
You have discussed with me at length some more than a month back on phone and promised to come to my place to help me in the affairs of FOAM but I am still waiting for you .
Pl do not have any confusion , our line of action is very clear and we are bound to reach our target .

If an unfortunate situation arise due to unhealthy attitude of some members it will be decided democratically and legally .

Dear Mr. Goel,

The only difference between your thought and my thinking is that that you wish that nothing unpleasant happens with any one of us and I believe that nothing unpleasant will happen with any one of us.  Truly said that we are all law abiding and wise people and all of us know what is best for us.  I believe that nobody out of us is having unhealthy attitude, of course ,the difference of opinion and ways to achieve the ultimate goals may be different.  I believe that nobody has right to take the interest of other co-owners of the flats who have been cheated by the Builder and PNBHFL but before we want to proceed in right direction  it  is important to understand the thoughts of each and every co-owner who has come under one umbrella so that their hard earned money could be saved and project can be completed.  Having the approach of levying the penalties or calling them defaulters or threatening them with the threat of AUCTION of their valuable property may not serve the very purpose for which they have joined the FOAM.

I am still not convinced why the management committee of FOAM is hesitant in having a binding agreement with the co-owners defining their responsibilities and management committee's responsibility towards the FOAM and how it will be illegal.  In my opinion it will not only ensure the timely payment by all the co-owners but also put some sense of responsibility in our Team of Management Committee.

Please look at it again in a positive manner.
