15. The Georgia legislature was successful in expelling its black
members because of the way they interpreted the Fourteenth Amendment.
16. The main argument for nullifying the Civil Rights Act of 1875 was
that it regulated individual rights rather than the actions of the
State. Supreme Court Justice John Harlan, however, felt that the
banning of private discrimination was constitutional. He said that the
13th Amendment applied to the state as well as the plantation owners.
Harlan also pointed out that the 14th Amendment says that anyone born
in the U.S. is a citizen, therefore entitling them to all the
privileges and immunities of citizens.
