One Class-IV Employee got job from his father on Compassionate Grounds.
He was married. Both the wife & husband got diverse in the presence of Village Elders by writing a Document. Thereon, he was expired. His divorced wife not attended for his cremation. 
He had three Sisters, two Sisters married and his 3rd sister have 20 Years age and not married.  
His Mother had 40 Years. 
Who is competent for giving job to the deceased employee. 
Kindly specify the rule position along with connected documents. 
Early reply is awaited from any one of the our team members.

Dear Kishore Babu,

It was not stated by you whether the deceased employee had filed declaration about his marriage during his life time or not.  This aspect is very crucial in settlement of such cases.  Divorce before village elders by writing documents, if I am not wrong, has no legal sanctity.  Wife not attending his cremation has nothing to do with the case.  Therefore, please furnish full and complete information in all respects to examine the case by the members and to suggest / quote correct rule position.

I'm Siva Prasad, Sr. Acctt., DGP Office, Hyderabad.
 
I would like to have clarification on the following, please
 
A person in the year 2006 appointed on conditional appointment to acquire Degree with in
5 years and his services regularised and increments given on completion of condition.
 
The candidate fullfilled the same in the year 2010 and now requested for appot. to 6 yrs (SGP).
Is he eligible for releasing increments from 2007 on wards and appointing in the Spl. grade scale?  If so, the rule position for releasing increments from 2007 onwards.

Govt. in memo No.23377/12/A2/Admn-I/97, fin&Plg(FW Admn-I) dept,
dt.15-09-1997 have clarified that the individuals who appointed on the
condition of passing the requisite tests, examinations, for holding
the post to which they have been appointed, the period of service
rendered by them in the post would not be qualified for the purpose of
increment unless they acquire the said qualifications within the time
allowed to them. they shall draw minimum pay of the time scale only.
According GO 117 for puspose of computing SG service, all the service
counts for increments in the particualr scale shall be taken into
account. Hence, in the case the individual is eligible for AAS after
completion of 6 years of service from the date which he is fully
qulified i.e date of fulfilment of said condition only

Dear Mr.Chakradhar,
The clarification given by Mr.Prasanna Chakri is correct that the service which counts for increment shall be reckoned for the purpose of Automatic Advancement Scheme. The services of an employee who has appointed on compassionate grounds and conditionally have to be regularized from the date of acquiring the qualification and the probation will be commenced to complete satisfactory service of duty of two years within three years and the monetary benefit of second annual grade increment shall be allowed from the date of completion of probation period only.  Further, the Government have clarified that it doesn't matter whether the increments are drawn or not but the service which counts for increment is the criteria for reckoning the period for Automatic Advancement Scheme.
