Dear Friend,

 

I would like share that few of active members have taken legal opinion from lawyer and managed draft copy as attached of Legal notice to be served to all concerns towards present uncertainty of our society.

 

Now as informed by our active members, we have to pay Rs.10,000/- to advocate for preparation of legal notice and further have to discuss cost for individual notice to be served to concerns.

 

Further we also like to discuss our future strategies for fighting our case and we shall request all members who are in NCR(Noida, Ghaziabad, Gurgaon, Faridabad, Dadri) & Delhi to meet on 15.08.13 at 1 PM outside our Plot at Sector -75

I am not sure why society is not showing us the correct direction.

If AMG is not treating well to our society secretary & president and not given the response to our torchbearers then what treatment they will give to us.

They got the land from authority in much cheaper price and they have sold it to us on escalated price. Yes they have deposited the money to authority but that is after keeping their promise.

In my opinion society need to call weekly protest in front of AMG. If requires then call then media, police etc.

If things wont sort out then we can go to court. In the mean time lets keep all documents ready.

Because this is clear cut case of cheat and fraud as :

1.  They ( AMG  Directors ) have our hard earned money which amounts in crores.
2.  They ( AMG  Directors ) are not responding at all.
3.  They ( AMG  Directors ) are never available to meet us.
4.  Now even AMG  employees do not behave properly as they are trained accordingly.
5.  The land meant for us is not even acquired and not sure whether it will be acquired.

This clearly indicates the malafide intention of cheat and fraud by Directors of M/s AIMS Max Gardenia and currently we are left with no other option then dealing it legally. We have already lost lot of precious time without any progress and it appears that same is likely to remain until we act.

If Directors of M/s AIMS Max Gardenia would have been sincere, then they would have met us many times and would have responded in writing and would have provided the updates. Unfortunately nothing of that sort have happened and nor it will be.

Let us choose the best course of action now without any further delay.

Send a notice to Notice (Not Legal) to AMG and keep Media, Noida DM, Noida authority in CC.

Remember that we have signed the MOM with AMG....they can not betray us so easily.

If nothing happens then go to court. 

I do not see any harm in taking legal proceeding after 2 months. But utilise these 2 months.

AMG do not have any concern and any sympathy with our case.

its now limit of our tolerance and we should get to gather on coming Sunday at so called society site at sector 75 and member present may sign a complaint address to SP of Noida in Hindi (draft may be please be prepared by some member who is good in Hindi) and we should submit the same at HQ of police at Noida on same day which may be followed by serving a legal notice to Society with in weeks time by making Gardenia as party along with Noida Authority. (Individual contribution of Rs. 1000 to 2000  may be  required and members are requested to come prepared in case attending meeting)

 

By communicating with each other and calling individuals will not serve any results as we are all members  & were never involved into dealing with Gardenia and it seems that our society governing body is not interested in sharing our concerns and dealing with Gardenia and even don't have future strong planning to deal with them or avoiding us to share the threat towards their non performance and not able to spend time on such important issue of hundreds of members dreams and not behaving towards their duties to expectations of such supporting members.

 

Please confirm your presence by coming Friday and take individual responsibilities to move the case forward.
