 Dear Mr. Gupta

My membership no. in the society is 348 and I opted for option 2 for the refund of my money. I have been consistently writing mails and calling the society office for my refund but unfortunately there is either no response or sheer empty promises. I hope you understand that if the society is not able to give us the flat that it offered us originally against our investment, the money should be returned to us immediately, something that has not happened for the last more than six months. Sir, I may also underscore that I have a son who is suffering from cerebral palsy since birth and requires sustained and quality medical intervention on consistent basis. I hope you will empathize that my money that is lying with the society for the last more than three years and particularly since the last six months when I opted for the refund, could be of crucial significance for the treatment and rehabilitation of my son. I hence urge for your compassion and request you to refund my money without any further delay so that my sons's medical requirements are not compromised, which if happens, can have serious ramifications for his health.

The First installment of Rs. 288890.00 was paid on 11.05.2015 through NEFT. I request you to refund my balance amount of Rs. 351110.00 without any delay.

Dear All,

Its been difficult to recall if there was any progress on the refund after the society was scrapped. All the main frontend people like RK Gupta, SP Yadav are absconding and not responding anymore to the communication or phone calls. 

Does anyone have any whereabouts of the FIR lodged, or the case that was in court? I understand that RERA didn't exist in those days, but can we approach RERA or any Real Estate Authority to bring some momentum to our plight. Nobody is gonna come and return the money on their own.

Any clues or thoughts are welcome.

Hi All,

My brother in law who also happens to be a member spoke to the society official and his response was if the builder gives the money we will refund the same to the members, also advised to contact the builder regarding the money. Advising such action clearly indicates that they want  themselves to be relived  from any further action against the builder.

Friends let us all recollect that we had paid the society not the builder, hence society is completely responsible for my money and the prime responsibility for the refund lies with the society, they just want to divert the focus from themselves to the builder to save their skin.

I suggest if we can meet and plan a suitable action against the society office bearers & the builder to get our money back.

Hi All,

Looks like court is taking the problems of home buyers by defaulting builders seriously. We can try again to get our money back from the builder and the inactive Apni Sehkari awas samiti.

There is a UP government grievance redressal system at - http://jansunwai.up.nic.in/HomeE.html

I have raised the grievance request on the portal. Encourage all of us to do the same. I am sure, if we all do it, action will be taken.

I am also logging a case in the portal. There is an option to log that case as Group Grievance. I would like to know under which department the complaint has to be filed.

Let me know, or else I will call you if you could share your number. Also I would request all to raise a complaint, as more numbers will draw attention towards this case. Also courts are taking cases seriously and helping people get money with interest. Please use this opportunity.

First of all thanks a lot for the initiative and sharing it with us all. 

I think a lot of us would like to follow suit but I and guessing like me there would be others with a little confusion regarding this process on the Application you have mentioned. 

I personally got stuck at the very first step, the department to which the complaint should be addressed. 

I think that we all would be grateful if you could share some such details of the complaint lodged by you. 

The idea is for all of us to reach out to the same department so that there are numbers enough for the authorities to take cognizance of the issue. 

I understand that this is a big ask as it will take time and effort, but it will in a way unify our effort on this platform.

I request you to please give latest position about the refund of our money of Rs. 750000/- deposited in Apni Sehkari Awas Simity Ltd. Rs. 500000/- deposited in September 2011 vide receipt no. 1297 dated 27-09-11 & Rs. 250000/- deposited in December 2011 vide receipt no. 1449 dated 31-12-11.

It is sad to inform that even you are not picking / answering our phone calls.

It is to point out that I am a retired person since March 2009 having no source of income and in addition to this my wife is a cancer patient.

Would you be kind enough to refund my balance money with interest on humanitarian grounds.

They will not pick up phone ...as the fraud they did intentionally...

If you want refund your money ...only way to file FIR and court case ..

They know you have waited till now and not going to file any case that's why they r taking benefit of this ...

File a case of 420 and send legal notice to all directors of apni society and their office ...where they r working ...to suspend from their govt job ...on ground of case of 420
