we dont know who is gardenia or who is Noida authority. we have given
our money to APNI CGHS. we want to see progress and no further lie on
this matter.

I think filing FIR agaist APNI CGHS for cheating us would be the
smallest move we should defenetely take.

please please unite for this cause. lets meet in hudge number on coming Sunday.

I definitely agree with all who are in favor of immediate legal action in our case. Lets meet with a good lawyer and see all the possibilities. Also estimate the       

Expense for all these. I know there is little lack of faith when it comes to handover money. But we have to identify few people among us who will own this activity and spend money where necessary. I am not in India but I know personally Gyanendra and Rahul who can very well handle this honestly.    

Others can come up with their recommendation for right candidates for this job. For those who are not in NCR should atleast support with opinions and money. Lets estimate and pool money for legal action. Also it's time to change new office bearers who work in our interest  rather than builder's. 

I am ready for pooling the money, others plz speak if you think other wise.

I am 100% agree for legal action but in my opinion we shud go via consumer court as its impact is high as it put builder at risk of default list and it is very cost effective .

I have personal experience where I won a case against builder who refuse to pay but after the court verdict he paid the entire amount with interest becoz court seize builder property untill he cleared all dues to buyers.

Different people have different suggestion uncleji.

Protest will not bring any thing negative. Evenly you will get public support.

Protest, Media awareness is equally required to make Legal department work.

I spoke to SHO and he have said diplomatically that FIR will be lodged and he will nail down the all middle men but he wont be able to get Gardenia director easily. He have said clearly that dont worry about the rest of people.

He was surprised that Gardenia have sold the land which is never acquired and Samiti brought the same land for which there is no paper.

To every flat owner they have communicated that only registry is pending and never told what is the ground issue. Scam is so big that they have demanded again and paid the money to Gardenia.

Gardenia brought the assumed land at price X and sold it on price 10X. Beauty is that only Gardenia got richer and office bearers got their big commissions.

We all are looted.

Dear All

We have waited for this since long...first we thought that our case is geniunely suffering because of impact of farmers claim all across Noida. BUT this thing is over since long, even other assumption that samiti is slow and working is not at all applicable. I would like to echo my voice with those who have expressed there concerns earlier on this forum that we are being cheated. 

I believe that Samiti has done registrations for nearly 500 apartments out of which nearly 100-150 are PSU employees (would really be great if i these nos. could be double checked, not 100% sure of this nos.). Still the idea is that loyal and proper tax filing middle class have been cheated out of which significant no. comes from respectable PSUs like NTPC, BHEL,etc. Even Samiti was told to be founded by ex-employees of Navratnas and Mahratnas PSUs.

I clearly see Samiti not at all being transparent. Major points being:-

1. Not Receiving Audited reports of Financial Statements (Quarterly/Half Yearly/Annually)

2. Zero progress in the project and still 4 installments being taken

3. No Monthly/quarterly update

4. Not ready to file case against Gardenia even after repeated requests from the members

I have spoken to legal team in my office and came to opinion that as many mouths as many opnions are formed. But one thing is common- that WE HAVE TO TAKE LEGAL ACTION. Mr. A K Singhal's personal experience and opinion can come handy.

I am in for filing case PIL at the highest level possible. Grounds being that if the PSU name can be used so easily in forming a co-operative society and cheat middle class with majority of those coming from Indian PSUs; then who else in this country could be trusted??

As already mentioned I already won case through consumer furum where I was not getting solution for last 8 years.

With this experience I do not waste time & file the case with consumer forum for any problem & always getting desired

civil suite is most useless option.

In consumer forum individual has to file the case making all 3 culprits as party.Before filing case you have to given notice to all  parties giving 15 days time.Then only you can file in consumer court.However they have limited powers.

PIL is the best option in high court/supreme court.

First of All, Mr. Alok I appreciate where you are coming from and can understand your views but wait and watch policy is not working; else even delay could have been accepted to a certain extent. Here the primary issue is not delay; the question is whether land is ours or not and frankly speaking we could not fight with the farmers. The authorities (Samiti, Noida Authority, Gardenia) whom we have bestowed our faith are neither fighting for our cause nor giving details of our money locked with them. Lets come forward and fight for it. I would have a humble request that you have meeting with other NTPC guys who have booked flat in Samiti. We need your support to fight for your/our cause.

Before proceeding further Iets try to be clear of the following things:-

1. Who's the culprit and against whom can we are liable to take action?? - 

Here's my understanding of the case:-

Step - I: Noida Authority handed over 150 acres of land to Gardenia consortium (AIMS MAX Gardenia) to build Eco City in Sec -75, Noida.

Step - II: Apni Sahkari Samiti purchased 5 acres of plot from Gardenia Consortium

Step - III: Apni Sahkari Samiti approached us to take flats and offered a co-operative society structure in return.

Step - IV: Everything went for a toss when we came to know that land is yet to be procured from farmers. 

Present Scenario

1. Earlier our land and whole Gardenia project got affected due to the delay in procuring land from farmers. But not Gardenia has successfully procured all land except ours. 

2. Apni Sahkari Samiti have shown lack of governance, transparency and refused to work on the request of members when asked by members to take action against Gardenia or asked for regular reports and audited statements periodically

Whats most fascinating is that why only our plot is affected out of 150 acres??..Why not even a single farmer from other areas??Why exactly our plot??

Not an inch more, not an inch less of other area is being held by farmers???

When we visited Apni Sahkari Samiti office in August/September 2012...they told that court orders have come that if farmers dont take compensation within 90 days then builders can start the work...and Samiti said that work would begin by Diwali 2012...But here we are even Holi 2013 has gone..but nothing looks to be in shape..

Considering all this, I think that whosoever is the real culprit..whether its Samiti or Gardenia or Nodia Authority..firstly office bearers are answerable to us then Gardenia is answerable to Samiti as per their MoU. But if office bearers are not listening to its own members the fault and the claim rests with  office bearers of Samiti...

Thus for us main culprit is the society..But as mentioned earlier can we go for case against Noida Authority and Gardenia??? Not sure??

2. Objective of Claim:

Either availability of apartment as per the promised conditions ASAP (which looks far from possible) 

or

Compensation of our money with the Interest 

(Don't forget that its not only about principle but also about the interest that these guys have earned out of our money and we have lost. Even the clipping that I have mailed earlier the guy who got his compensation back he got along with the interest)

3. Possible Options:

I believe the list from Mr. Rahul is exhaustive and many of them like reporting matter in print, filing in consumer court, reporting to UP CM and higher authorities can be done simultaneously. Biggest question is How??? Do we need to hire an advocate this also??Mr. AK Singhal/Mr. Manu Juneja...please share your views...

Just now I got a call from Samiti & we discussed the whole matter at length about 1 hour.

Based on my experience the best action at this stage is to write to Chief Minister UP

& same thing I conveyed to society.Society was little reluctant to this also but at last the

guy agreed to discuss my suggestion with samiti members.

We should write few letters to Chief Mnister & I am sure it will bring result.

Even if we decide to go court finally, these letters will be very helpful that we tried

our best at the highest level before coming to court.

Based on the detailed discussions with samiti yesterday,I feel that society must write whole problem

to Chief Mnister UP immediately & send reminder with 2 week interval.Basically action is to be taken 

by noida authority.However even for this society was reluctant.When I insisted for this, he agreed to discuss

this suggestion with office bearer of society.

Now I would request all members to write mail to society that letter to Chief Minister to be written immediately

& copy of letter to be mailed to all society members.

Seek help all friends in this matter & I am confident it will expedite the matter.

While it is a good idea to write to Chief Minister of UP, has the society ever written a letter to CEO, Noida Authority or District Magistrate highlighting the plight of the society. If they have written such letter (s) it would be worthwhile to mention the contents of such letter while addressing a letter to CM, UP. If they have not written any such letter the society should point out record of discussions held with CEO, Noida Authority or DM. The rationale is that the society may like to point out non resolution of its plight at the level of CEO, Noida Authority or DM while addressing its plight to CM, UP.

society fellows say that they made lot of efforts so far & all those efforts to be brought in record in the proposed letter to Chief Mnister.

Now it is already too late & we all should send mail to society that letter to CM to be written immediately with copy to all members.

After that we individually can also write to CM modifying letter in our own way.This first letter will give us the actual contents in this matter.

However during discussions with me society was reluctant for writing to CM & upon my insistance he agreed to discuss proposal 

of writing to CM with office bearer.

Actually in this deal every body except poor members are happy and enjoying.

We all should send mail to society that if letter with full facts not written to CM, immediately, we members will file FIR against society for cheating.

through legal action you can easily get refund of money with nominal interest.

Hence if we are interested in flat, no harm writing to CM & I have seen good results by writing at top.

Even if you go to court, you have to show that efforts already made at highest level.

I met one of society person .... when I asked why u given wrong information about registry of gardenia during booking time... then he replied we have not said anybody that registry is being done in the name of gardenia ..... what u have proof ..... that we have given wrong information. Hi All, 

 I would like to mention that we might be ending up in doing the same mistake as was did last time. we need volunteers of  a group(3-4) of people who can lead all these activities(of course based on their availability). Anyone who is on ground of action can volunteer and no need to say they will not be alone in this course.

Just like few others i am also not in INDIA but i can certainly make the required calls or write to the required people if necessary.

I have my friend in noida: Harpreet virdi who helped me in booking the flat in this project and he is also part of the group who is initiating talks with farmers and group. we can certainly seek his help and guidance in this matter.

we are all in this together. Any i/p to make this happen is welcome.

However leaders are always few & others follow them.

I have talked just now to 1 person who was there in meeting & they will be going to advocate for drafting the legal notice.

current situation. a plan has been chalked out and some of us are
going to meet advocate.

My advise would be to send copy of legal notice to U.P.Chief Minister without making him party, so that

he knows happening going on in noida authority.

Moreover option of FIR also to be explored so that some people are behind the bars.
