In the past one month, several documents related to the 97th Constitutional Amendment and the Gujarat High Judgement were sent to many of you. Just for your ready reference to make a decision about your organization or cooperative that you promoted to file a PIL you may need to have them, these documents are again attached.

 

We are not requesting you to file a PIL and fight the case in the respective high courts. We are only expecting these PILs to be filed and we receive a number for the case registered. After that there is no action required from you as we do not want these PILs to be proactively pursued by the petitioners. Once there are enough PILs related to 97th Constitutional Amendments file in various high courts, we will move the Supreme Court for considering all of these PILs as a batch.

Please see the mail below. We had a meeting in IRMA on the follow up action related to 97th Constitutional Amendment based on the Gujarat High Court Judgment. Please let us know if any of you are willing to file a public interest litigation in your High Courts. We will provide necessary technical support for that. If you are not able or willing to file PIL, please do identify suitable NGOs or cooperatives who can file a PIL in the State High Courts. Once the Gujarat High Judgement is challenged in the Supreme Court by Union of India, all these PIL pending in the State High Courts will be called for by the Supreme Court and having 30-50 PILs pending in several high courts will put enough pressure on the Supreme Court.

Dear All:

 

Some of you may be aware that the Odisha Government decided to repeal the Self Help Cooperative Act 2001 (liberal cooperative law). Many of the civil society organizations engaged in promoting self help coops decided to appeal to the State Government not to repeal the liberal coop law. Access Development Services held a round-table in Bhubaneswar on 30th May 2013 and made a representation to the State Finance Minister not to repeal the coop law.

 

Please find attached a copy of the memorandum submitted to the State Government. Hope the state government does not move forward with its decision. If they do come up with an ordinance repealing the self help coop law, many of the civil society organizations and cooperatives in that state are ready to challenge the ordinance in the Odisha High Court.

 

Today there was a meeting held at IRMA to discuss and develop plan of action related to the Gujarat High Court’s judgement on the 97th Constitutional Amendment. It has been decided to challenge the 97th Constitutional Amendment in several State High Courts and also fight the Union of India’s appeal against the Gujarat High Court judgement as and when Union of India files a Special Leave Petition (SLP). A more detailed report on the IRMA meeting will be circulated soon. There is a plan to challenge the MP High Court’s decision to repeal the liberal cooperative law in that state.

 

All the supporters and promoters of self reliant coops in India must support the ongoing efforts.

Dear Sir,

I have given a press note to India Express.  With regard to meeting other govt. functionaries, it was not possible, as we had another important consulations. However, nayana Mohanty has shown her interest to make a PIL, and she is discussing with some of the advocates. Malaya and Nayana Mohanty would also me meeting to the governor, but so far they have not received any appointment.

Have you been able to meet any other functionary in the Government? We [CS Reddy, Rama Lakshmi and I] will be happy if you can keep us updated on the developments?

 

I must say that the Roundtable was very well organised. We were happy to have participated in it. It is heartening to note that ACCESS has been able to mobilise several self help cooperatives, NGOs and social activists on the issue of the proposed repeal of the OSHC Act 2001. Keep up the good work.

 

On our return to Hyderabad this afternoon, Rama Lakshmi and I briefed CS Reddy. We will be happy if you email a copy of the representation to us.

 

In our view, we must continue to work on two fronts: (1) the proposed repeal of the OSHC Act 2001 and (2) the implication of the Constitution (97th Amendment) Act 2011, in the context of the Gujarat High Court judgment.
