If the Comelec takes its sweet time in replying to the 10-day period can the five PLs file a quo warranto case or even a certiorari petition to expedite our impending proclamation?

I just cannot trust the Comelec's unwanted delay in the case of PLs vis-a-vis the undue haste in proclaiming the Senators-elect.

Justice De Castro was right when she said that Justice Sereno's "blanket" TRO against the proclamation of the remaining seats in the party-list may "adversely affect third parties not impleaded in the present case in violation of their right to due process."   It is a basic requirement in procedural law that if you want to enjoin the proclamation of the other winning party list groups, you should implead them in your Petition for TRO or preliminary Injunction.  It is a matter of due process.   You cannot prejudice the other parties without giving them the right to be heard.  Apparently, Justice Sereno overlooked this matter.  Be that as it may, the non-impleading of the five non-proclaimed party list groups (e.g., Append PL) is one of the apparent defects of the petition of the Senior Citizens Party-List which should be looked into by the SC in the resolution of the petition.
