Namasthe all,
I also invite the discussion on the Judgement of Hon'ble Apex court in the case of State of Gujarat Vs Girish RadhaKrishnana Varde (Crl Appeal No.1996 of 2013 dated 25-11-2013. The point held by the Hon'ble Apex Court in the said judgement is that the magistrate cannot exclude or include any section into the charge sheet after investigation has been completed and charge sheet has been submitted by the police.

I cite an example.  Facts and investigation disclose murder but the IO files charge-sheet under Section 323 IPC.
As seeker of justice I expect the Magistrate to follow the procedure, not the decisions.  Let us follow the procedure.
