Consumers should be aware that motor vehicle laws differ for used cars and buyers do not have the same protections as when purchasing from a licensed dealer. Remember, there is no Lemon Law for used cars in Florida.
Recording the Mileage
An odometer disclosure is included on Florida titles. The odometer reading at the time of purchase will be required on the title application. Both the buyer and seller must acknowledge the odometer disclosure on the title transaction.
Applying for Title
FLHSMV urges buyers and sellers to complete the transaction in a motor vehicle service center for the protection of both parties. If the title is paper, the owner will complete the Transfer of Title by Seller section on the front of the title certificate. The buyer must complete an Application for Certificate of Title with/without Registration form, attach it to the title and submit to a motor vehicle service center to transfer the title into their name. The purchase price does not include sales tax or tag and title fees. Expect to pay these fees to a local motor vehicle service center when transferring ownership. This must be done within 30 calendar days to avoid a late transfer penalty fee.
If the title is held electronically, the seller and buyer must visit a local motor vehicle service center to complete a secure title reassignment (HSMV 82994 or 82092) and disclose the odometer reading. The buyer and seller must both be present and provide photo identification.
If the vehicle will be titled in another state, the buyer will need to contact that state for proper titling procedures. The buyer may purchase a temporary tag at a motor vehicle service center that will be valid for 30 days so that they may legally drive the vehicle to that state. The buyer must pay Florida sales tax when purchasing the temporary tag.

Vehicle Assessment
Before renewing your license you are required by Arkansas law to assess your vehicle with your county assessor and pay all personal property taxes you owe. You are also required to maintain liability insurance on your vehicle. These requirements are automatically checked using a computer. If any of the information reflects "NO" on your vehicle registration record when you attempt to renew, you will not be able to renew by phone or internet. To renew by mail or in person you must furnish written proof of compliance for any item listed as "NO". (Written proof of compliance is a paper copy of either your personal property tax assessment for the current year, your personal property receipt for taxes due by the previous October 10th, or your vehicle liability insurance coverage).
Dealers who hold a General Distinguishing Number license may issue dealer temporary tags, buyer's temporary tags, and Internet-down temporary tags for each type of vehicle the dealer is licensed to sell. The law requires you to collect a $5.00 fee from each buyer that is issued a buyer's eTAG. This fee will be paid to the county at the time the title and registration is filed just like the TT&L. The buyer tag is the only tag for which this fee is charged. This fee also applies to out of state transactions.
If the webDEALER System is unavailable at the time of a retail sale, you must use an Internet-down tag and provide a buyer's receipt. You will enter sales information into the database once the webDEALER System is available again. This must be no later than the close of the next business day that you have access to the Internet.
The buyer can also have the power of attorney & odometer disclosure for electronic title filled out at the same lime. This allows the paper title to be mailed directly to the buyer who can use the power of attorney to assign the title themselves.
If at all possible, the buyer should bring the notarized lien release with them when they apply for 60-day permit it to have processed by our office. This ensures the buyer the paper title will be sent to them within the 60-day period.

The MVA provides a Bill of Sale form. If this form is required, fill it out and have the buyer(s) and seller(s) sign it in the presence of a Notary Public. (The Notary Public may charge a small fee.)
Can you sell a car with expired tags? Sometimes the world moves too fast for us to keep up with everything. People can get so caught up in preparing to sell their car that the car registration date goes by unnoticed. Selling a car with expired registration is possible, but it may be more difficult due to buyer concerns and additional fees.
If your registration is about to expire, you may be able to obtain a non-operational title to save money on the registration, depending on the state. This can also help you avoid late registration fees for missing the deadline. However, this identifies your vehicle as not being roadworthy, and potential buyers won't be able to take it for a legal test drive. Registering your car before you advertise it for sale is the easiest way to provide a buyer with the necessary paperwork to transfer ownership of the vehicle. If you're considering selling your car with expired registration, be sure to check with your DMV to see if it's possible in your state and how to go about it.
If the buyer is obtaining outside financing, most financial institutions will require the title. The institution will submit the title to DMV and become a lienholder through the Electronic Lien and Title system. In this case, the security agreement from a licensed financial institution can take the place of a title for registration.
If the vehicle is a 2010 model or older, you may be able to submit the duplicate title forms and a Bill of Sale (VP 104) to transfer ownership. We suggest the buyer and seller complete the transaction at a DMV office. A Bill of Sale by itself is not acceptable.
The DMV does not disclose owner information to potential buyers. However, you may bring the vehicle and paperwork to the VIN Inspection Station at larger DMV offices for review. No appointment is necessary.
The only exception is if the vehicle was 1) last titled in Nevada, 2) is model year 2010 or older, and 3) has no liens or the owner of record has a lien release, the buyer and owner of record can then complete 1) an Application for Duplicate Title (VP 012) and 2) a Bill of Sale to transfer ownership. Get all promises about service and guarantees in writing in the contract and in the final copy of the buyer's guide. If you were promised something but it is not in writing, do not sign. If the seller offers a warranty, it must be in writing for it to be valid.
All used car dealers are required by federal law to tell buyers whether a used car is being sold with or without a warranty. Dealers must clearly display this information on a side window of each used car. This buyer's guide, or window form, should state either:
The buyer's guide becomes part of the contract at the time of the sale, and any guarantees listed on it override any restrictions in the contract. If the sale is in Spanish, the buyer's guide must be in Spanish. If you don't see the buyer's guide in the car window, ask to see it before you agree to buy a car.
Dealer tags are temporary license plates that only a licensed vehicle dealer can buy. These tags generally allow auto dealers to use, transport, and demonstrate unregistered vehicles on public roads. Dealership tags are also called D-tags, dealer plates, and paper tags.
In general, licensed dealers can put dealer tags on cars purchased at an online car auction. When used correctly, these tags allow buyers to drive auction-purchased vehicles back to their dealerships.
The Title Fee is paid to the county where the buyer registers the motor vehicle. It is due within 30 days of the purchase date for the vehicle. You must submit the Title Fee payment with your application for a certificate of title. If you purchase your vehicle from a car dealership, the dealership must collect the Title Fee from you and remit it to the county tag agent on your behalf.
