Documentation of the amount received from each owner (including non-association owners) for the asphalt surfacing and the amount charged to the Association for the surfacing is required to be in the minutes of our meeting and be made part of the record. This is part of the association financial history and is part of public record according to access privileges pursuant the bylaws. “Someone” has the records and a receipt. A general accounting of all receipts and expenditures by the Associations of the previous and current expenditures is required in the bylaws.

I agree that getting all the owners identified is the biggest challenge, and trust that we can get a dynamic updated listing from this meeting forward. If we haven't knowledge of a particular lot we could probably somehow get to the county and look up the record. We need to add a by-law if it is not already there that a transfer of ownership needs to be communicated to the association, which will be doable once we formalize the association location and board members etc. So, lots of stuff to discuss in the upcoming meeting.
Proposed Agenda Draft:
1. Review of owners list (and land-owners who are not members but are impacted and desire to be present or notified of decisions/actions) and determine everybody is identified and notified. (overview the by-laws and refresh ourselves on the rules etc.)
2. Determine the board members present and if there will be authority to vote and do business.
3. Nominate new board candidates (we have no board chairman for sure at this moment)
4. Agree on legal process to schedule next meeting and votes etc. (Feb?)
5. Present and review financial statement and bank balance.
6. Discuss budget requirements and annual owner fee (currently approved $250.00/never billed or collected)
7. Present and discuss expenses incurred to date (bookkeeping, road weed maintenance and utility shed PSE monthly billing)
8. Re-authorize our current attorney and provide her the minutes etc. for this meeting.
9. Discuss lake and possible lake maintenance requirements
10.Discuss automatic gate, placement and installation (security)
11. Discuss any winter road maintenance or desire for winter clean-up etc.
12. Other items as required
The above list is the obvious stuff that I have heard or discussed with owners at one time or another. We have the financial statements for presentation as well as bank statement. We all understand that time and resources are very limited for all owners and therefore we need to keep our efforts super-efficient. We may have owners that will volunteer to take on a specific project or administrative task and that will be most appreciated by all.

By-laws require that ever member is notified of the upcoming meeting a minimum of ten days prior to the meeting date but no more than 50 days prior. At any rate, the “group” has scheduled the first meeting in the last two years for the last DAY or the Last SATURDAY in January. I suspect that Dave G. intended to say “the last Saturday” rather than the “last day of January”.

I respectfully suggest that members read the existing by-laws prior to making general assumptions pertaining to the changes that may be made (or not made) by a simple vote. The bylaws are part of your deed and are recorded with the assessor’s office. Whenever a property changes ownership, the recorded bylaws and covenants transfer with the property. Both are either a liability or an asset, depending on your point of view. Regardless, a simple vote cannot change the bylaws or covenants, unless all requirements are met. That means that the required percentage of members AND the required percent of lending organizations (100%) financially involved approve the changes.
If there are not any lending organizations involved with any properties (that is, they are all paid-for without debt). Then the Association can make changes by vote. The changes must then be recorded with the Assessor’s office on each title.
The rules (Bylaws and CCR’s) are in place to protect the lenders and owners and their property investment.
