Dear Chairman of the ANCEFA board, board members and national coalitions,

  I am a very concerned about the letter distributed by board chair for all board member and coalitions in Africa. Board decision in Addis Ababa- We wish to reiterate to you, Mr. Chair, board members and national coalitions, that the meeting in Addis Ababa ended without consensus by allboard members as well as without resolving the matter concerning the regional coordinator through a vote as per the constitution. Worse still, the meeting ended abruptly after chaos and acrimony which was caused by some colleagues of the board, as well as the departure of the people who were facilitating the proceedings as interpreters for the meeting. We are strongly concerned that you took advantage of lack of interpreters to make concluding remarks on the subject in French(to the French members of the board), and then quickly rush to hand the Regional Coordinator a letter of notification for termination of the contract.  As fellow members of the board, we find this un-procedural and total disregard of the provisions of the Constitution of ANCEFA with regard to how to handle meetings and reach resolution of meetings as contained in article 8 of the constitution.

We also find your action at odds with the resolutions of the board meeting in Ouagadougou where it was agreed that the Coordinator should relocate to Dakar in March 2016 pending the renewal of his contract. As concerned members of the board, and coalition in East Africa. we therefore reiterate our position that the board did not make a decision or resolution on the issue of regional Coordinator in Addis Ababa. We therefore ask you to withdraw  your decisions the letter you sent to the coordinator and  the recent letter to all board members and coalitions with our joint agreement as a board or decision makes of  ANCEFA. Today I would like to bring this issues that the unprofessional way of the chair's decisions without voting and consensus among board members.I would like to share the matter should be known by all coalitions of ANCEFA and board members  in Africa.

The other ruling type of  decision was nomination of Interim Regional Coordinator: In light of our
position in point  above, I reject your motion and request to nominate any person from the members of the ANCEFA Management Team of the Secretariat to be the Interim Regional Coordinator, since the board didn't come up with joint decisions on RC. I would like to insist the period of 6 month for the current RC to clean all limitations and commitment ANCEFA made with partners. The proposal  we are making has a lot of merits and advantages. The extension period will allow for the new board to finalize all transitional matters referred to the board by the previous board and the management at the Secretariat, and implement the road-map we have set up with GCE on the CSEF project. It will also give us time to
monitor and assess the performance of the coordinator and the management team, before we make a decision on whether we provide a new contract or we open the recruitment of a new Regional Coordinator.
This period will also help to ensure that ANCEFA does not have to pay extra penalties (such as expected two month-payment in lieu of notice) for not giving a notice of three months as per the contract with the coordinator. It will also help ANCEFA avoid a potential contractual and legal conflict with the current coordinator on payment of end of

contract benefits, since as we leant in Ouagadougou, ANCEFA is facing a huge deficit on payments for salaries of staff and contractual terminal gratuities. Last but not least, the decision is a win-winproposal which will help to ease the current tensions in the board andgive all of us an opportunity to resolve our differences and begin towork as a team, at this early stage of our mandate as a board.


  I would like to suggest in the spirit of mutual understanding, and the need to create a positive and conducive environment in ANCEFA while we fight for the rights of the African Child, we ask you to think about our inputs seriously, and take it into account as you are making your final decision on 10 February, 2016.

If, for whatever reason, you are unable to take into account our proposal, which will be regrettable, then we make it clear that we distance ourselves from your decision, and we should not be held responsible for negative consequences of that decision on the functioning and future direction of ANCEFA.

Dear Our Chairperson, Mr. Samuel Dembele,

Please refer to the consultations held in Ouagadougou, Burkina Faso
(17-19 December 2015), Addis Ababa (29 January 2016), the emails of
the Regional Coordinator (1 and 4 February, 2016) and the Board email
exchanges following your three mails sent to the board on 2 February,
3 February and 6 February 2016.

A lot of discussions have taken place over the above topic and to
avoid getting into too many details we write to petition you on two
main areas of concern contained in your emails to the members of the
board on 6 February 2016. The first is about your insistence that the
board meeting in Addis Ababa made a resolution to terminate the
contract of the incumbent Regional Coordinator when it expires on 29th
February 2016. The second issue is you request for nomination of
Interim regional Coordinator, who should take over the affairs of the
Secretariat when the incumbent leaves office.

Our response to these two areas is as follows:

1)      Board decision in Addis Ababa- We wish to reiterate to you, Mr

Our Appeal

As your fellow members of the board of ANCEFA we request you to
seriously consider our appeal for the Board to extend the contract of
the current Coordinator, Mr. Limbani Nsapato, to a period of at least
6 months (it can be six months or one year).

The proposal we are making has a lot of merits and advantages. The
extension period will allow for the new board to finalize all
transitional matters referred to the board by the previous board and
the management at the Secretariat, and implement the road-map we have

It is unfortunate that Board members now have to debate internal boardroom issues in public. This, unfortunately, is what the current leadership is causing us to do. I wish to correct the information that Illiass is portraying in his mail. ANCEFA constitution in section 8 is clear that meetings should be agreed by consensus and that where there is no consensus,  there should be voting, and voting should be by secret ballot. According to the section, the chair should cast a deciding vote when there is parity in the votes. During the meeting, there was no consensus, and there was no voting procedure that took place. The numbers that Illiass is fabricating have no basis, since no voting took place. He is referring to a process of going round the table, which is not part of ANCEFA constitution. In fact before the matter was concluded and as the debate went on, interpreters who were assisting in the meeting, left and there was no interpretation. This led to chaos, shouting and acrimony until the meeting ended abruptly. Since the issue was tabled by the Chairperson,  he just took it upon himself on the way forward.  Mr Limbani was given and responded to a letter which was not based on consensus in the board but the Chair acting based on his biased opinions which were supported only by the French-speaking board members who had the benefit of understanding the Chairperson's final comments when interpreters had left the meeting. If the Chairperson or Illiass would like to challenge my views, let them send to us a report of the voting process  if they are arguing that  voting took place. The fact that no consensus was reached and that this matter was not concluded is substantiated by the petition which was sent to the Chair on Monday by four members of the board who did not agree with his decision. Instead of addressing the petition, he has decided to use this public forum to paint a picture as if all is well with the decisions he took. It would have been better for him to wait until the board resolves the matter and then send information to all members. Finally, i reiterate that ANCEFA board has not agreed to the process of recruiting a new regional coordinator or appointing an interim regional coordinator. We are still resolving this matter within the board. I however, deplore the dictatorial tendencies and divide and rule tactics which we are witnessing in the board at the moment. I regret that these dictatorial tactics will not build ANCEFA, and will not benefit the millions of illiterate people in Africa who are destined to live in poverty throughout their lives.

Je vous remercie très sincèrement pour cette note d’information qui
fait le point des actions menées par le nouveau conseil élus à Dakar.
En effet après la réunion de Ouagadougou qui prit un certain nombre de
décision dont celle qui fait l’objet  de discussion par certains
membres du conseil notamment la question du recrutement d’un nouveau
coordonnateur. La réunion  de Ouagadougou a utilisé les termes que
voici
 Du 27 au 29 janvier a Addis , nous avons eu une session de travail
très fructueuses avec le comité de surveillance du CSEF qui a aboutit
a la levé de l’administration du CSEF et le rétablissement de la
responsabilité de ANCEFA. Aussitôt après une réunion du conseil a été
convoqué pour statuer sur les points cités par le président Dembélé.
Sur les sept (7) membres du conseil présents un tour de table a été
fait, quatre (4) membres se sont prononcés pour le recrutement d’un
nouveau coordonnateur et de faire notification a Limbani que le
processus de recrutement sera relancé. Âpres ce tour de table le
président Dembélé a tiré la synthèse qui tient compte de la majorité.
Apres notification a Monsieur Limbani, ce dernier a écrit au président
pour prendre acte et dire qu’il va se préparer pour la passation et a
même suggérer au président de nommer un intérimaire parmi le mangement
de ANCEFA.
Je rappel que même l’ancien conseil, lorsque les partenaires de ANCEFA
avait demandé de reprendre le processus de recrutement du
coordonnateur , a écrit pour dire qu’il souhaite que cela soit fait
après le contrat de deux ans de Limbani pour éviter des pénalités et
je pense que nous sommes a la fin de contrat a la date du 29 Février
2016.Nous devrons être respectueux de nos paroles et respectueux de
règles minimales de gestion et de bonne gouvernance .Cette question de
coordonnateur de ANCEFA a été a la base de beaucoup de difficulté que
ANCEFA a connu ce deux dernières années et a mon humble avis nous ne
pouvons plus  continuer a tergiverser autour de cette question qui
risque de compromettre la cohésion et la survie de ANCEFA.Nos
partenaires sont très regardant sur notre comportement et le respect
des engagements que nous avions pris en matière de rétablissement de
la bonne gouvernance. Pour finir je me pose plusieurs questions :
-       Où est le problème dans cette affaire, sauf si on veut continuer à
défendre les intérêts de x ou de Y,
-       Nous ne comprenons pas que nos collègues insistent sur des questions
mineures tout en bafouant les règles élémentaires de gestion de
management,
-       Nous ne comprenons pas pourquoi, les gens veulent se cacher derrière
la langue pour défendre leur position alors que le seul souci qui doit
nous guider reste la préservation et la crédibilité de ANCEFA.
Pour toutes ses raisons, je demande à mes collègues membres du conseil
de revenir à la raison et de soutenir les actions de redressement et
de dynamisation  d’ANCEFA sous la direction de Monsieur Dembélé .En
démocratie on doit se soumettre a une décision prise.
En conclusion je tiens à vous informer que la décision et la
notification faite a Limbani par le président Dembélé conformément a
l’esprit de la réunion d’Addis est un débat  dépassé ( Notification de
fin de contrat) et la prochaine étape est la nomination d’un
intérimaire ainsi que la  relance du processus du  recrutement du
nouveau coordonnateur dans la transparence totale. Monsieur Dembélé
doit choisir entre le mangement de ANCEFA le plutôt, un intérimaire
pour faire la passation avec Monsieur Limbani.

It is very good to understand  that many of you are interested to express your views on the information shared by the Chairperson of the Board of ANCEFA, particularly with regard to the Regional Coordinator. 

Your recommendations that the board should act professionally are noted,  and mostly that we should follow laid down procedures as per ANCEFA constitution and human resources policies and guidelines. This is the only way we can act impartially and also avoid violation of employment principles, which can become costly to ANCEFA. ANCEFA should not be exposed for  unnecessary costs, since we are struggling the financial gaps.  

 

I wish to commend my brother Kouameh Paulini, who has asked some questions and directed them to me. I think it is proper to answer your questions, as follows: 1. When is the end of contract for the regional coordinator?-  It is 29 February. 2. Has Mr. Limbani been informed of the end of the contract?-Yes, according to the chair, this was done on 29 January through the letter by the Chairperson. 3. Is there a violation if ANCEFA starts recruiting a new Coordinator at end of contract? -ANCEFA must fulfill all procedures related to end of contract as laid down in the ANCEFA policies and employment contract. In addition, we should consider the implications of letting the coordinator go, at the time of transition at this early stage of the board.  If the above areas are not considered and main procedures not fulfilled, there can be a violation. In my view, this is an important topic which the board is supposed to discuss. 4. Date of the last meeting of the board- 29 January 2016. 5. Was issue of recruitment of regional coordinator discussed at the board meeting? -Yes, but the issue was not concluded, because the meeting ended in chaos, acrimony and abruptly after language interpreters left the meeting. 6. What was the decision of the board regarding end of the contract?  -As in 5 above, there was no resolution or decision, because the board meeting ended abruptly without any consensus and voting.

 

I hope I have tried to respond to Mr Kouameh. If you still have questions you can ask me. I am here to respond, since I was  the one who presented the East Africa coalitions as an ANCEFA board.

 

Now turning to my brother Tahirou (from Burkina Faso- the same country as our Chairperson), i am glad that you have commented, and i believe that your views reflect to a great extent the thinking of the chair. ..I wish to agree with you that the Chairperson was mandated to lead ANCEFA and the board through the voting process that took place at the General Assembly in Dakar on 12 November . However, I want to warn you that do not think that the mandate given to the chair meant that he should lead without regard to ANCEFA policies or constitution or professional principles. The Chairperson should be the first one to uphold these governing documents and principles. In addition, leadership is a shared responsibility, and that ANCEFA constitution, requires that decisions must be made by consensus and not by dictatorship.  If consensus is not there, then voting must be made. In Addis Ababa, during our board meeting on 29 January, we discussed the issue of the Regional Coordinator, and we neither reached  consensus nor took a vote. And besides that, the meeting ended abruptly, because there was no interpretation service to allow all members to discuss freely in their language and conclude the matter on the same page. Towards the end of the meeting, it was only French which the Chair was using, and there was no interpretation to English and Portuguese . The Chair then went ahead to implement a proposal on the Regional coordinator, which he brought to the board meeting, but which was not resolved in the meeting. This is where the problem is, because his actions did not fulfill the procedures laid down in ANCEFA constitution (Chapter 8). That is why some of us are uncomfortable with the manner of decision making and that is why four board members including myself sent him a petition on Monday (8th February) to reflect on the case and come up with a win-win solution as a leader. But he did not accept our recommendations. We are not defending an individual member of staff (eg.  Limbani), but we are defending the principles that govern ANCEFA and the spirit of professionalism. 

 

Once again, I wish to welcome and thank all those who are urging the board to discuss again the matter, and reach an agreement on the way forward, with due respect to our human resource policy and ANCEFA constitutional provisions. I hope that our Chairperson will take these proposals into account, and lead us towards good decision making. As an African I feel bad that often we spend our time and energies on our personal popularity and individual ambitions rather than to bring unity and follow good governance principles that  will respond to our collective calling and responsibility for ensuing universal quality education and an end to  poverty.
