Dear Members of Anand Ashray RWA (Regd),

This is in reference to Letter No 3180 dt. 23-01-2013 received on 27-01-2013 for revision of Maintenance Charges.

I just want to know the few point for this letter as mentioned below:

1. How this rate of Rs. 1.25 per sqft is calculated, whether the maintenance of the society is of such quality that it can fetch Rs. 1.25 per sq.ft.?
    Parks are in poor condition even no grass in park near swimming pool area. Empty Swimming Pool is just a show item in the society
1A. What is the total chargeable area in the society and @ Rs 1.25 how much maintenance charges is expected to receive. What are the expense against this receipts like Security, Lift Maint., Salary etc.

2. How this Generator rate of Rs. 1050/- per qtr is calculated?

3. While there are 346 flats in the society how any decision can be taken on the basis of 101 members?

4. What is the need to change the deposit date for quarterly maintenance Charges while the existing time seems to be appropriate.

5. We have not received the annual accounts of the RWA for the year 2011-12 ever after 10 months from the end of the year.

6. What is the status of shop in society i.e shop is on rent or sold?

7. What are the incomes coming from allowing persons to distribute templates, selling of carpets, car service campaign and allied activities.

8. Account of money collected from members for getting completion certificate and amount received from society for the same not received till date.

With the above points, I request please consider all points before revising the rates for maintenance.

After going this chain mail & discussion started by Mr. Vikas, I am in full agreement with him on certain issues pertaining civic problem like seepage, dampnes on walls garbage menace etc. which are becoming a chronic problem in our society.
 
Issues like 15K deposits & maintenance calculation need to be discussed by a larger forum and RWA should make an update especially on steps taken by him in recovery from defaulted members and publishing total expenditure on NOC & Registration related activities.
 
I am also surprised to see our management still praising CCSE who had created all the mess related to NOC & Registry and adopting there procedures & scientific methodology of society maintenance knowing that CSCE do not have any prior experience of managing a society.
We should take the help of our neighbor societies like JVV & AWHO who and try to frame a system which should be acceptable to all.
 
I request our RWA to circulate copy of ANANDASHRAY SOCIETY BYE LAW so that people like me should be aware our RIGHTS, OBLIGATIONS & PRIVILEGES.

The points raised by you regarding the maintenance and functioning of RWA of Anandashray are very logical as well as valid. In my opinion in order to save one's skin if someone says that he has been following whatever being done earlier by CCSE, especially when you were appointed to change the same by taking all the stakeholders (members) in confidence.I have a strong feeling that the office-bearers of current RWA have no courage to bring all such issues for discussion at right platform through GBM as we see hardly any GBM has been held and whatever been in past were just eye-wash. This indicates the non-transparency in their functioning and their callousness towards all the genuine issues of this society.

Dear Mr. Chauhan,

Thanks for your mail and surprised to understand the reason of escalation of maintenance charges mentioned by you in this mail and your letter dated 5th oct. As per me both are entirely different from each other.

At first I am not writing mail for the purpose of reducing the maintenance charges of our category but my point is to collect the adequate charges from the each member to meet the near time direct and indirect maintenance expenses of the society and keep society healthy to live in future.

Any way point mentioned by you regarding NPCL and generator load of flats, for your kind information there is a great scientific reason directly proportionate with area of flat .


Even though few questions asked by you. I am having an answer and reasoning but I strongly and personally feel that, only those will give you the picture of one face of the coin and might help society to meet running expenses but not the routine /accidental expenses. , Which is not the correct way to operate the RWA to keep our society healthy and safe to live.


In regard with adoption of CCSE process of calculating the maintenance charges for which you may say that this is scientific but general views are that it is very old and traditional way of calculating the maintenance. This will only work well when society is new where only running expenses occurs.But in case of residential complex like us which is old and by nature going to deteriorate day by day for which maintenance cost is high and this system will get failed. And that is the reason most of the residential complexes (any type of )has adopted the system of per square feet based to meet the need and demand of the residential complexes.


Here I want to mention in several previous communication RWA has praised the CCSE.But sorry to say that Anand Ashray members has suffered, for example Rs. 15000 + 2500 paid to RWA for completion. Which is moral and legal responsibility of CCSE.I am confident still RWA has not recovered amount assured by CCSE towards completion charges, If recovered please update each member. In above regard , RWA had collected common amount of Rs.15000 from each member and Rs. 2500 indirectly with out in notice of members through lawyer( we don’t know the reason behind Rs.2500).

In regard with your letter dated 5th oct 2012 where RWA has mentioned reason of escalation of maintenance charges based on mixed reactions / inflation / security /electrical/office staff etc. I am agree with most of these expenses, I am sure these will increase on regular interval in future. But other face of the coin amount fixed for collection is entirely gives negative picture, which shows thatabove factors are not having any impact for escalation. Below is the some fact and figure hope to understand….

CATEGORY RATE PER SQUARE FEET PER MONTH

A,A-1 Rs. 1.80 SFPM.

B Rs.1.36 SFPM

C Rs. 1.17 SFPM

D Rs. 0.79

P1 Rs. 0.87

P2 Rs. 0.81

Hope above will give you clear picture about maintenance charges and request each member of RWA please let me know that any type of resident complex will give our kind of maintenance including power back up on above rates.

Hence that was the reason to avoid above kind of controversy, most of the residential complexes has adopted on the basis of SFPM.

Apat from of the above there is several pending issues for which are not addressed by RWa till now.

Parking, wastage of water, Power saving of open area , seperage/ leakage, stair case wall, white wash, steal grill repainting, club etc.

Hope RWA will understand the gravity of the subject and act accordinallly as an institution not as an individual.

Npcl charges for meter on the basis of electrical load sanctioned to the particular flat. It has nothing to do with area of any house.


Generator running charges are also calculated on the basis of the electrical load connection to the flat owner. Area has nothing to do with it.


Now here are few questions to be answered :-
1. Whether big flat owner enjoy more security than others? If yes then how ?


2. Whether big flat owner use lift services more than others? If yes , then how?


3. Whether big flat owner take more services from office staff? If yes, then how?


4. Whether big flat owner is more benefitted from house keeping services? If yes, how?


I may remind everybody that RWA has adopted the system of charging maintenance initiated by the promoter society CCSE.And the system seems to be very scientific . RWA has not made any change in the system . Suggestions are welcome to improve the system it should be based on reasoning. We should not copy others blindly as we are co- operative society based on legal enactment.

I was out of station & therefor couldn’t give the answer of your mail. I had raised the issue to entire RWA & issue will be discussed once entire RWA members is available . Presently president is out of country & expected to return by mid-December. You had raised many issues & can be explained to you. You can come to RWA office/ my house & have healthy discussion on every issue , I believe in resolution of issues. There are some areas where improvement will be done based on your inputs.


Further new RWA election might be organized in January’12 & I personally want some enthusiastic person like you to come forward & do the good work for society. In the meantime issues raised by you shall be taken care properly.

Agree with below queries, seems no thought process or logic has been practised before floating the circular, these decisions should be taken in GBM. It has become habit of RAW to threaten members by highlighting penalties and objections/restrictions on providing basic facilities. Till date no audits have been provided and no confirmation on clearance of society has been assured. Regardless of fulfilling all the financial demands raised by RAW till date, results are nowhere.

 

This circular is not acceptable without any clear details on financial of Anandashray.

Dear Mr. Chauhan,

 

I am in receipt of your urgent letter dated 23/1/2013 regarding increase in maintenance charges. My comments are as under:

 

·         The quarterly maintenance charges were revised upwards from Rs. 4000/- per quarter to Rs 4600/-per quarter in the last quarter itself. There is absolutely no logic in arbitrary increase of charges in a short span of just 3 months.

 

·         Maintenance charges based on area of flat is the correct method but charge of Rs 1.25 per sq ft is too high. Even the modern societies like ATS etc charge only Rs 1.50 per sq ft in which they provide host of services. The charge should not be more than Re 1.00 per sq ft in any case.

 

·         Henceforth, the increase in maintenance charges should be linked to wholesale price index so that inflation is taken care of every six months/ one year.

 

·         Maintenance charges are paid on quarterly basis. There is no logic in levying penalty for delay in payment after 15th of beginning of quarter. The present system of charging penalty after 45 days of beginning of quarter is correct. In fact we should encourage members to pay maintenance charges annually and give rebate of one month if annual charges are received by 30th May each year (for the period April to March).

 

·         The security guards in the society really do not perform their duties properly and allow any vehicle inside without enquiring/verifying the purpose. Security staff seems to be just for name sake.

 

·         The security surveillance system (CC TVs) is not being used. It is not clear whether it is out of order or has been switched off. Such a costly system must not be kept idle.

 

·         There is heavy seepage in kitchen wall in the Gangotri Block. Similar is the position of several other blocks. Something needs to be done urgently for this.

 

·         Elections to the RWA have not been held for the last 3 years. Hence immediate elections should be held.

 

The above points must be considered and deliberated upon before taking a final decision.
