Şu aşamada şikayeti kimin yaptığı belli değil. Şu anda raportör rapor hazırlıyormuş. Ben savunmamı gönderdim. Bir kaç gün içinde sonuç rekabet kurulunun web sitesinden de açıklanacak sanırım.

Aslında kim olduklarını biliyor olsam da açıklamazdım herhalde. Çünkü bu yazıyı beni şikayet eden firmayı şikayet etmek için değil sektörümüzde çok yaygın olan bir zihniyeti eleştirmek için yazdım. İşin detayı artık avukatların işi. Şimdilik konuyu bir firmanın bilgisizliği olarak değerlendiriyorum ama olur da bu iş büyürse hepimiz kim olduğunu öğreneceğiz zaten :)

Rapor hazırlama aşamasında oldukları için resmi bir açıklama gelmedi ama telefonla aldığımız bilgiye göre: ücretsiz program dağıtarak restoran otomasyon sektöründe haksız rekabete neden olmak, pazarı domine etmeye çalışmak gibi bir şey.

Selam emre oncelikle seni tebrik ederim. Senin gibi insanlar turkiye az.
Sikayet eden firmaya gelincede aslinda onlarin bu yaziyi bile okuyunca anlayacaklarindan supeliyim.
Onlar yetisememis zeka ozurlu cahil dna larinda bozulma meydana gelmis insanliktan nasibini almamis yaratiklar. Baska ne yapmalarini beklerdinki.
Yazindada dedigin gibi onlar yazilim nedir tekniloji nedir bilgi nedir ne ise yarar saha kavrayamamislar.
Sagdan soldan kod tirtiklamaya gelince hic cekinmezler. Sonrada yazilim dunyasina birsey katmazlar.
Teknoloji ozurlu ticaret adami bunlar.
Ben artik bu ulkede olan ve olacak hic birseye sasirmiyorum.

Biz de açık kaynak kodlamaya destek veren ve proje geliştiren insanlarız. 

Dava açılmasına gerçekten çok şaşırdım. Açık Kaynak bir projeye dava nasıl açılabilir onu da şu anda kestiremiyorum. Ne olursa olsun bütün davalık durumlar zordur. Gerçekten Allah kolaylık versin diyorum. Belki grupta bu tarz süreçlerle karşılaşmış ve aşmış arkadaşlarımız vardır.

Bu arada projeni de daha önce incelemiştim. Eline sağlık güzel bir iş başarıyorsunuz. İnşallah baltalanmaz ve yolunuza devam edersiniz.

Bilgisizliğimi mazur görün lütfen ancak dünyada her sektör için açık kaynak aktif olarak kullanılabilir uygulama mevcut. Bu durumda bunlar bu kafayla ileride orchard yada nopcommerce gibi projeleride engellemeye çalışırlar mı sizce?

Mantalite çok enteresan madem aynı yazılımı yapıyorsun mahkemeye vermek yerine daha iyisini yap, firmalar için daha avantajlı hale getir.  Açık kaynaklı yazılımın şikayet edilmeside dünyada bir ilk sanırım...

Şimdiye kadar korsan yazılım ile ilgili bir yazılım şirketine gidildiğini hiç görmedim duymadım ancak olsa bile çok doğru gerçekten hiç bir şey elde edemeyiz. Birilerinin ceza almasının veya batmasının bize bir faydası da yok çünkü. Bunlar için harcanacak zamana yazık.

birilerinin tekerine comak sokarsan durdurmak için elinden geleni yapar.Durum budur.

yasal zeminde hak aranmalı ama kimdi birileri dedi suclamanın netleşmesi cok onemli.Ne olduğunu bilip ona göre savunma yapmak (gerekiyorsa) gerekir.

Peki,  Rekabet Kurulundaki yetkiliker haksız rekabete yol açtığına karar verirse (Burası Türkiye), açık kaynak olan bu yazılım üzerindeki yaptırımları ne olacak ? yada para cezası mı kesecekler?

Ama benim anlamadigim, davayi kimin actigi bilgisine neden sahip
olamadiginiz. Boyle bir sacmalik olamaz, biri beni dava edecek, kim
oldugunu ogrenemeyecegim.

Kim olduklari onemli, degil deyip kendimizi kandirmanin bir alemi yok.
Bu kadar ahmakca bir aksiyon sorumlusuz kalmamali.

Henüz buna dava demeyelim de şikayet diyelim. Rekabet kurulu mahkeme statüsünde bir kurum değil ancak çok sağlam para cezaları kesme yetkileri var. Şikayetleri topluyorlar, bir kısmını değerlendiriyorlar ve bazılarını kurula gönderiyorlar. Kurul şikayeti haklı görüp soruşturma isterse soruşturma açılıyor. Sonuçta cezaya karar verilirse mahkeme süreci ondan sonra başlıyor. Ceza alanların Danıştaya itiraz hakları varmış. Biz kurulda görüşülecekler arasındayız. Bakalım ne sonuç çıkacak bekliyoruz.

Şikayeti yapan kişi gizlilik talep ettiği için açıklamıyorlar. Sürecin herhangi bir noktasında ortaya çıkacak mı bilmiyorum ama en kötü durum olsa ve Danıştaya gidilse bile muhattap rekabet kurulu olacağı için bu ismi hiç açıklamayabilirler.

Elbette meraktan çatlıyorum ancak gerçekten de hiç önemli değil kim oldukları. 15 yıldır bu tür sektörlerin içindeyim bu zihniyette o kadar çok adam tanıdım ki. İçlerinden herhangi biri olabilir. 

Garip ama insanlar hakikaten zengin ve güçlü adamları seviyor, destekliyor. Biz daha çok böyle programı satmadığı için bedava dağıtan önemsiz programcılar gibi algılanıyoruz. Bunlar böyle hızlı para görmüş, kendilerini acayip akıllı ve içten içe de kullanıcı milletini gerizekalı sürüsü olarak gören adamlar. Belki de bu yüzden iyi imajları var. İnsanların neye önem verdiklerini çok iyi biliyorlar. İş öyle bir durumda ki açın yazılım firmalarının web sitelerini, bırakın ürünü denemeyi veya bir videosunu görmeyi, bir screen shot bile göremiyorsunuz. Çünkü firmalar istesem notepad bile satarım psikolojisindeler. Kendilerine o kadar güveniyorlar. Elbette bu durum en çok programcı kesimini etkiliyor. Bizler imajdan ziyade iyi şeyler üretmeye önem vermek zorundayız. Bunun için günlerimizi, gecelerimizi harcıyoruz. Ama gelin görün ki normalde ürünlerin, becerinin, kalitenin rekabet etmesi gereken bir ortamda kişiler, imajlar, etiketler rekabet ediyor. Bu nedenle işi imajla götürenler, insanların teknik eksikliklerinden faydalananlar daha başarılı oluyor. 

SambaPOS projesinin ortaya çıkışını etkileyen bir çok faktör var ama bunlardan birisi benim bu duruma duyduğum tepkidir. Kendimi zengin olmaya adayıp hayatımın bütününü boşa harcamak istemiyorum. Güzel ve faydalı ürünler üreterek başarılı olabileceğim bir ortamda yaşamak istiyorum. Bunu yapabilmenin tek yolu iyi ürünlerin tercih edildiği, insanların kimin yaptığını pek umursamadığı bir ortam yaratabilmek. Bunun için birilerinin farklı bir şeyler yaparak alışılagelmiş şeyleri değiştirmesi gerekiyor.

İşte bu nedenle kim oldukları önemli değil. Bu zihniyeti taşıyan ve sektörde kısıtlamalar yaratarak yolunu bulan herkese aynı duyguları besliyorum çünkü.

Bu ba$vuruyu kabul edecek kafada insanlar bir yerlerde var demek.

Bir ki$i de cikip demez mi ki arkada$, bunca acik kaynak proje var
neden bu diye?

Zannimca bu kurula gidi$ a$amasinda bir bilirki$inin gormemi$
oldugudur, yoksa cahil bir bilirki$i bile 2-3 kere google a girmi$se
bunun cok aptalca bir ba$vuru oldugunu bilir.

I$in komigi bircok devlet kurumu da suclu konumuna du$er, bu muthi$
bir siyasi olay olur ve buyur. Du$un mesela Tubitak suclu, Pardus acik
kaynak. Windows'un zararini tazmin etsin :)

bu memleketin bilirkişilerinin de ne mal olduğu ortada iken, olumsuz bir sonuç almanız muhtemel.. gerekirse taksim'de soyunup olayı protesto ederiz hocam, memleketin bu kadar erkeği çıplak görmeye hazır olduğunu sanmıyorum.

Yanlışsam düzeltin bu sambaPOS’ u herhangi bir firma alıp bedava kullanabiliyor, kodda da değişiklik yapıp kullanabiliyor. Ama ek özellikler katıp satamıyor değil mi?

Bilirkişi olmak zorunda Doğa, daha önce akademisyen yıllarımda 2 farklı konuda bilir kişi olarak görev yapmıştım.
Olayı bir veya daha fazla yazılım mühendisinin yorumlaması düzeltecektir zaten, tabiki doğru adamların bilirkişi olması koşulu ile ama bu konu oldukça net.
benim bilirkişi olduğum her iki konuda bir telekom firması ile ilgiliydi ve oturup 3-4 gün araştırma yapmış hatta küçük bir simulasyon bile yazmıştım iddaa edilen veri kaybının ortalamasını çıkarmak için:)) Her bilirkişi aynı mıdır değildir ama bu konu için araştırma yapmaya bile gerek yok. Konu çok fazla emsal barındıran net bir konudur.

Aksi durumda grup olarak biz aksiyon alıp kamuoyunda ses getirecek bir açık kaynak davası açalım ki, tüm dünyadaki OSS news grouplarında yankı bulsun, hatta NY Times Tech' te falan çıksın:)

Benim eski firma bir lab yazılımı için ventura yazılımla calisiyordu.Zamanla onların ana ürününü taklit edip hastanelere satmaya baslamıs benden sonra...


aha bu da mahkemenin verdiği karar ve bilirkişinin yorumları..

TECAVÜZ son bulsa da zarar zarardır..Haklarını helal etmesinler!!!
