G4 US visa

Hi there,

I am about to be given a G4 visa for entry to the US. I have 2
questions. Firstly, can I convert from G4 after arrival to an
immigrant visa with a long term view of becoming an American citizen?
Secondly, I gather that a G4 visa is a diplomatic type of visa and I
have read that children born in the US are automatically US citizens
.... except those born to foreign diplomats, so if I am on a G4 visa
in the US, and if I have children born there, will they not be
entitled to US citizenship?

Let's answer the second question first. The actual law that controls your
children's citizenship is the US Constitution, the 14th Amendment,
specifically. It says that anybody born under the jurisdiction of the
United States is a US citizen (not just entitled to citizenship, but
actually is a citizen - your child would not even have the option of
declining).

Foreign diplomates usually have diplomatic immunity and therefore are not
subject to US jurisdiction. This may or may not be true for you.

As for the first question: if you qualify, you can apply for a Green Card.
You would have to waive your diplomatic immunity. The bigger challenge is
that you would have to qualify for a GC just like anybody else in one of
the few available categories. Be aware that it can take years or decades
to get one - if you qualify for one in the first place. For more

Dear Crg14624,

You mention in your response to the original poster that G4 visa waives
some grounds of inadmissibilty. Could you disclose which ones exactly?
I'm curious to know whether it waives all grounds of inadmissibilty such
as diseases, illegal presence (overtsay or out of status for illegal
employment...). I would guess that criminal activities are not waived!
I'm researching this visa and all it entails and this is the first forum
after so much search on MSN, Google...talking about that.
So your answer will be most appreciated.
