Enter U.S. on visa waiver after L1 visa denial

hello you all,
just wondering - would it be a major problem to enter the U.S. as a
tourist on visa waiver program after a possible denial of L1 visa?
has anyone ever gone through that?

If you have been denied a visa then you should contact the American
embassy before you travel as you might not be able to use the VWP. You
have to declare it on the actual waiver form as well so best make sure
you can actually use it.

Waiver Program. See

You will need to apply for a B1/B2 visa at a US Consulate.

I was refused a Visa and used the VWP.

All clearly stated on the London Consulate web site.

You do have to declare it, and will probaly get to visit Secondary.

Doesn't having a visa give you a better chance being admitted?? Maybe not...
you may still end up in Secondary I guess.

Problem is getting a B when you can use the VWP.

I do not know if the I-94 asks the same questions, probably not. But the
I-94W does ask about refused visa's.

Not everybody gets to go to Secondary, but you should expect it.

thanks for the link! that was really helpful - but it actually says it
makes me NOT uneligible. good news.

Wouldn't the reason for denial have some bearing on the ability
to use it?
