A visiting friend from Italy by mistake has allowed her
three-month tourist visa to expire (two days ago). She
would like to stay two more months. Any advice on the
best course of action? Is it still possible to renew it,
and how? What are the consequences of not renewing it?

Thank you very much ---Luigi Semenzato

She might be able to renew it by appointment at a US consulate in
Canada or Mexico. But, it's the date on her I-94 in her passport that
counts - the visa only has to be valid at time of entry.

Check the date on her I-94. INS officer at port of entry usually
gives 6 month expiry date for visitors visa ( not in all cases).
Her stay is legal if her I-94 has not expired yet. Visa expiry
date on her passport is only for entering US.

you have to first check what is the Permited to Stay Until date
in the I-94. THis is the date that determines how long you can
stay in the US. If you intend staying past this date, (I did
this for my parents), go the the nearest INS office and ask
them if they could extend her stay past that date. If you have
good reasons I do not see a problem. My parents were given
extention of stay, without any probelm but they had very good
reasons -they were hurt in an accident.
