Just a quick one....I live in London and would like to go over to the US
to live/work. Now I have both a degree and a diploma, about 10 years
experience in finance industry, single and no security issues.
Problem is that to get the E3 you need to have a specialty occ, I was an
analyst in the past but I currently work as a PA (to a Chairman) and
would like to remain so - I have absolutely no interest in going back to
being analyst.
Would a PA or 'Executive Assistant' position qualify me for an E3?

As far a INS is concerned, job title doesnt mean a darn thing to them.
You would need to list your job responsibilities to justify the
requirements.
I hate to ask a stupid question, but I have read posts that seem to say
you can apply for the LCA online yourself. Is this correct, or does the
employer apply? What is the actual process - they apply online, where
does the actual certificate needed for the interview go from/to? How do
I get it in my hand for the interview?

It takes seconds to approve and you can print off the approval from your
computer and take it into your interview.
if you have a job offer letter that states that you are employed "at
will" will this be ok to obtain an E3. The company has written that they
anticipate two years work and it is also stated in the job offer letter.

My partner got an H1B on an "at will" contract based in LA.....I know,
different visa, but it reflects that many companies only hire people on
an "at will" basis.

This is incorrect. The employer must apply for the LCA, not the
employee. They can do this online very quickly as it is approved
automatically. Then they print it out, sign it and give you a hardcopy
for the interview with USCIS.
The 'at will' clause in a standard American employment agreement should
be no problem for an E3 as almost all companies do this.
Great to see more people getting their E3's. If you are anything like
me, you will love living in the United States! :-)

looks like the Wage is not good. I was wondering if we are offered below
marketing rate coz we wanna work in USA ?

That sometimes happens. But you're implying that American employers never
make low salary offers to American workers. They do do, and for numerous
reasons and purposes. You're forgetting that those other reasons and
purposes may apply to you too.
The thing about "average" wage figures is that while 50% of the people earn
more that it, 50% of people earn less than it. Getting a work visa doesn't
automatically imply that you are in the top 50%.
If you don't all the skills an "average" person has, or you don't have an
"average" amount of experience - or simply because the employer is equally
mean to everyone - then you will not be offered a "top" salary.

I have been hearing a lot of crap from people about how you cannot
renew E-3 and must leave, although they also said they know of someone
that had to do this - I asked how that could be possible, since the
visa has only been available for one year and noone could have reached
the end of it yet!!
For the person that asked if a healthcare professional would need the
Visa Screen Certificate, I believe the answer is YES. Any foreign
healthcare worker on an occupational visa must provide the Visa Screen
Certificate at consular interview.
I do not know of any other RNs who have been able to get a job in the US
based on an E-3, so it will be interesting to see how it goes - the only
other option is green card route for RNs, so this would mean I could get
to the job being offered in the US a whole lot faster!!

did you do it successfully ? could you pls tell me the process ? like
you had an interview with potential Employer and he agree to offer you
ajob then he do the LCA on line ?
Is it possible to do LCA on line by ourself and bring it to empolyer
when ppl get the interview ? it sounds like sensible ....... IMHO,.

I am panicking right now! My employer filled out an LCA online last week
and he says he hasn't received anymore info. What does the form look
like when it is approved or is there a confirmation email???
Everything was in check on the 9035 form why is it taking so long

i have never been for a visa interview - a silly question: since the
e3 is for professionals, does this mean that we have to dress formally
for the interview?? - does it have any bearing on the outcome?? - its
going to be summer soon in sydney and i would much rather go in a t-
shirt & jeans.
I've been for a few interviews and I dont think it really matters.
You're "interviewed" behind a huge glass window and its not as personal
as you may imagine. I would just dress respectively.

Had my E-3 visa interview at Calgary, Canada consulate. I was in the US
for 5 weeks when I got my offer and decided to come here to shortcircuit
things. Found the interview slot last Friday.
Arrived at 7:45am, interview was at 8:30am. Went through security and
got my number. Was called and application taken from me. I was told to
wait for my name to get called. 5 mins later a nice lady called me up
and told me the machine had rejected my pic. I quickly ran downstairs
and got another one taken.
I went back in, handed my new pic in and was told to wait. 5 mins later
got called up for interview. The guy was quite rude and hostile from the
getgo so I geared myself for the worst outcome. I couldn't really
believe what I was seeing. He was literally shouting at me.
I'm an attorney and the job if a legal consulting role for a US telco
firm doing business in Aus. The interviewer said I don't meet the
specialty occupation req cause I didn't have a "current" practising
certificate. I have an older one that I submitted together with an
affidavit from the Law Society that I'm fit and proper and eligible to
get another certificate upon application.
Anyway, he put my application on hold and told me to go back with the
certificate. I think he got it wrong though cause the US consulate
website says you can qualify for Specialty Occ if you're eligible to get
a license within a reasonable period of time.
Does anyone know if you can apply the dependent I-765 EAD online for E3s
or does it have to be done by mail
I sent mine by mail, together with certified true copies of mine and my
husband passports , visa and I-94. I got my EAD card after 3 months.

I am currently paying off a mortgage in australia. there are two ways to
send money home- you can wire it, which cost around $50 dollars per
wire, or the cheaper way... I have my mum as an additional card holder
to my US bank account. I sent her the card and she takes money out every
few weeks and banks it in my australian account. You only get charged 1%
of what she takes out. Make sure you ask the bank if you can raise the
limit on the amount you can take out in one day though otherwise you can
only take out around 500 at a time- very annoying.
In answer to your second question- check out ANZ's website they have a
special mortgage for expats.

I am no lawyer but I have some experience with this kind of stuff since
I just did my status change from H1-B to E3 so I will try to answer
your questions
1. I am currently on an E3 visa through Company 'A'. I am considering

You will need to file a Form I-129 with the Vermont Service center
for a status change (status change from your current employer to your
new employer)
2. DO I have to leave the US to do the transfer or can it be done

No you do not need to leave the US to do an employer change. I believe
you do not need a new stamp either since ure status is still E-3 and
has not changed. In my case since I changed from H1-B to E3 I would
need a new stamp. In your case all you would need when you re enter is
a valid I-797 approval notice showing your new company and your current
E-3 visa stamp.
3. What are the forms that company 'B' has to fill in to complete
the process?
They will need to file an LCA online. With the approved LCA you can file
form I-129.
4. Upon approval of E3 transfer, is there any time limit to join the
new company?
I believe it's similar to H1-B in that you can start working for the new
company right after you file form I-129.
5. Do you need to inform your present employer about your Visa Transfer?
Is there any way that my current employer can come to know about my
E3 transfer?
Again similar to H1-B you do not need to notify your old employer
about your status change. I dont believe they will come to know of it
through DHS.
6. Is there any limit for the number of times I transfer my E3 visa?.
No there isnt. However I have heard that when applying for a green card
people who have transfered their H1-B multiple times face additional
questioning. I am not sure how far this is true.

I have been working in the US for over three years. For the first three,
I was on a H1B visa. However, when that expired earlier this year, I was
granted a change of status (together with a change of employer) to E3
status. I have a I-797C giving me E3 approval until July 2008. All this
was done here in the US.
However, I now am heading back to Australia for an extended break, and I
know I have to get a new visa "stamp" in my passport to get back here.
(My H1B visa has expired, of course, and I am now on E3). I understand
that I have to attend an interview at a US consulate in Oz, but I am
finding it very difficult to determine what information the consulate
official will want to see to put that E3 'stamp' in my passport. I KNOW
they require DS157 and DS156 (electronic), plus photo and - of course -
valid Oz passport. However, will the E3 APPROVAL NOTICE I-797C serve as
sufficient evidence that I have been through the approval process and
have "legality" to work here? Do I have to pay the $100.00(US)
application fee again (it has already been paid earlier this year, of
course)? Any information will be gratefully received!

You have to pay the $100 to attend the interview.

in general it says that to qualify for an E-3 visa, an applicant must
demonstrate:
that he or she must have a legitimate offer of employment in the United
States; and
that the position he or she is coming to fill qualifies as specialty
occupation employment; and
that he or she is an Australian citizen; and
that he or she has the necessary academic or other qualifying
credentials; and
that his or her stay will be temporary; and
if required before the alien may commence employment in the specialty
occupation, that he or she has the necessary license or other official
permission to practice in the specialty occupation.
The fact that the homeland security approved is good but not enough and
does not compelle the embassy to approve.
The only issue I think may come up is your nonimmagrent intent, but 99%
is that it will go smooth like all the rest.
Bear in mind, its a treaty visa with Australia, so if you have all the
requirements, they need a darn good reason to deny you.
