Rob Estes in two different characters in MP ??

I'm sure that the actor who played Sam Towler in episode 36, is the same as
the one playing Kyle now.
Correct me if I'm wrong - it is Rob Estes both times, isn't it??????????
Please help me - my boyfriend doesn't believe me, he's driving me nuts!!!!!

Alison is waking up from a late night martini binge. The empty bottle and
glass catch her eye and she quickly carries them to the kitchen, and climbs
back into bed with Billy. He is just waking up and doesn't suspect Alison
had passed most of the night on the living room couch. She begs off his
attempts at lovemaking, explaining that she has a very busy day at the
office. Billy says he hopes she's not burying herself in work in order to
forget Keith.
Jane answers her door, to be greeted by Sam Towler, a friend of Michael's
and her's, with whom she had a brief romantic encounter in a weak moment.
Sam says he is in town for a week on a construction project. He is surprised
to hear Jane and Michael are divorcing.
CUT ----->
Jo and Jane have lunch together. Jo recognizes Jane's spaced-out mood and
suggests she start dating again. Jane is not sure, but then remembers Sam
Towler. She stops by the construction site and invites him to dinner at her
apartment.
CUT ----->
When Jane tells her sister about her date with Sam, Sydney says it's too
soon to be dating. She's not divorced yet.
Billy meets with Amanda privately and decides to tell her the whole story of
Alison's traumatic experience with Keith. Amanda is stunned and agrees to
try to help Alison as much as possible.
Matt invites Katya, a Russian emigre doctor at the hospital to join him for
a taco lunch. They enjoy each other's company.
The dinner date between Jane and Sam goes very well. He expresses relief
that they didn't spend the evening bashing Michael.
CUT ----->
After dinner, Sam holds Jane close for a warm kiss. She responds, at first,
but then pulls away saying she wonders if she's doing this just to get even
with Michael. She says she needs time to think it all over.
CUT ----->
Jane tells Sydney that her date with Sam was more fun than she had with
Michael over the past year.
CUT ----->
Sydney pays a visit to Michael at his beach house and casually mentions that
Jane is dating his old friend, Sam Towler.
CUT ----->
Michael goes to see Sam and angrily tells him to stay away from Jane. Sam
reminds Michael that he and Jane are divorcing. They square off, but Michael
backs away, realizing he's no physical match for Sam.
CUT ----->
Sam stops by Jane's apartment. He wants to know why she talked to Michael
about their dinner date. Jane confronts Sydney for telling Michael, but her
sister denies she had anything to do with it.

Yes, I noticed the same thing, Rob Estes played an old friend of Jane and
Michaels and he kisses Jane while they are still married, I believe it's
about 3/4's down the first season.
