daughter, Rosie O'Donnell, flew to San Francisco and married her gay
partner Kelli Carpenter-O'Donnell, yesterday. So, congrats to Charlie,
Rosie, and her new wife! I wish them and their four kids the very

Are they married? The City of San Francisco has no authority
under California law to issue same sex marriage licenses. It
possible, and I say likely, that all same sex marriages performed
in San Francisco will be either not recognized by the state as
valid, or voided.

Well, California's Family Code says that "Only marriage between a man
and a woman is valid or recognized in California" (section 308.5),
although there is a provision for "registering as domestic partners"
that says, "Registered domestic partners shall have the same rights,
protections, and benefits, and shall be subject to the same
responsibilities, obligations, and duties under law, whether they
derive from statutes, administrative regulations, court rules,
government policies, common law, or any other provisions or sources
of law, as are granted to and imposed upon spouses" (section
297.5(a)). It sort of depends just what is written on the license.
