‘I just want to clear my name’

Jason McKee , jmc...@pottsmerc.com 06/10/2003

POTTSTOWN -- The age-old question of what’s in a name is proving to be
quite a problem for a local businessman.

Christopher Custer has an unfortunate name. Not because of a
connection with the ill-prepared Civil War general who was
slaughtered, along with all of his troops, by Indians at the Battle of
the Little Big Horn. No, the baggage accompanying this particular name
is a little more local, and a lot more embarrassing.

"My friends are really getting a kick out of it," Custer said Monday
from his office at Firestone Tire and Service Center on East High
Street.

Custer’s name appeared in a police brief Sunday in The Mercury after a
man with the same name was arrested for open lewdness. Officers found
Christopher Custer with his pants around his ankles, masturbating to a
pornographic magazine along Laurelwood Road, according to North
Coventry Police.

"Before 11 a.m. I had about seven of my friends call," Custer said. "I
had a good laugh about it at first. What else could I do?"

At work there’s a photograph of Custer receiving last year’s manager
of the year award. One of his associates was nice enough to attach a
copy of the police brief to the plaque. And another dear old friend
faxed the article to other Firestone stores in Trooper and East
Norriton.

But it wasn’t the first time Custer, 36, got tangled up in the
troubles of the other Custer, who is 29, and happens to live right
down the street from his name-sharing neighbor.

Three years ago, a sheriff’s deputy called Custer’s wife and told her
there was a warrant for her husband’s arrest. The woman defended her
husband’s innocence, but the deputy wasn’t convinced until Custer’s
description and date of birth didn’t match the paperwork.

Then, in February, there was another mix-up. State troopers
investigating a hit-and-run made a stop at Custer’s home in Upper
Pottsgrove. One of the officers said they were looking for Jamie
Custer, a brother of Christopher Custer. Custer said he had no brother
named Jamie. But the officer wasn’t satisfied.

According to Custer, the trooper was enraged and swearing obscenities
in front of Custer’s wife and two children -- ages 2 and 5 -- before
handcuffing the man and stuffing him into the back of the police car.

The officer later realized the mistake, and Custer, after speaking
with the officer’s superiors, decided he just wanted to forget the
incident ever happened.

He later found out the 29-year-old Christopher Custer lives down the
street, on Mauger’s Mill Road. Court records indicate this Custer has
been arrested in the past on burglary and prowling at night charges.

"And now this," he said, pointing to the clipped article on his desk
detailing the open lewdness charge. "I have a sense of humor about it,
but I don’t want my customers thinking it was me. They’d never bring
their cars back to me for service."

To spread the word, Custer posted a sign in front of his shop
declaring his innocence.

"I just want to clear my name," he said.

Custer said he would rather be confused with someone who was charged
with, well, something a little more mainstream.

"Anything but this," he said.
