Shane Wheale, the murderer with the big dick, sentenced

Regina Carr, was sentenced to life plus 13 to 20 years in prison. You
may recall my report that when he was not given the death penalty, he
jumped up with his fists over his head and yelled "Yesss!"
Lawyers around here say that Wheale's appeal of the conviction may be
successful. The DA for some reason--probably trying to show a pattern--
included a previous rape sans murder in the trial with the murder of
Carr. Wheale says that Carr died during consensual sex--she choked on
his huge member, and the evidence of beating was just from her head
hitting the steering wheel of the car they were in. I think it was a
mistake to conflate the two cases; I doubt that the jury would have had
any trouble, given the extent of the victim's injuries (her vagina and
anus were torn from "slipping on the gearshift"), convicting him without
the evidence of prior rapes.
You may also recall that Wheale wept mightily on the witness stand
during his murder trial, frustrated that no one seemed to believe him.
His mother told reporters that everyone was against Shane because he is
so good looking. Wheale spoke again, at length, at his sentencing:
"This was a witch hunt from the beginning, and everyone viewed me as if
I was a monster, everyone." Speaking of the rape victim who testified
against him, he said, "This woman is mentally disturbed. Then they got
some psychological quack to take the stand without even interviewing me
(the psychologist concluded that Wheale is a sadistic serial rapist;
Wheale doesn't see it that way)." He also complained that he was not
allowed to present evidence that Carr's brain could have swelled from
alcoholism and not from the beating. "I don't care what those pictures
said. I don't care what anyone says. I did not rape and kill her." He
claimed that Carr's injuries were self-inflicted, that she performed
sexual acts on herself in his presence which caused her own death--it
was suicide, see.
"They used my looks against me. It's just stupid to say to a jury I
used my looks to pick up women. Imagine that." He said that the rape
victim had been coached by the DA to sit in the second row in court and
cry in the presence of the jurors. "So many people got on that stand
and lied, the court even recognized it."
"I made a promise with God, with myself and with my family to tell the
truth, and no one recognizes that. The only thing the jury saw was a
bad person. They didn't see that maybe this was an accident. As crazy
as it sounds, maybe this was an accident."
"You know what? I'm confident enough that I'm going to get a new trial.
I'm going to prove this. I'm going to prove what I say is true." He
complained that the media put him through "a living hell. Everyone has
a giggle. Everyone has a laugh when I say that. I have a family, too,
that was hurt. They made damn sure to print my mother's name, my son's
name, my girl's name."
"The commonwealth wanted to kill me. They wanted to strap me to a bed
and stick a damn needle in my arm. I'm saying no one deserves to get
the death penalty. No one deserves to die." He said that his life has
been threatened in prison, by inmates who were friends of Carr's late
husband.
He complained that the DA had mischaracterized him as arrogant. "Maybe
I'm not arrogant. Maybe I'm confident I'm telling the truth."
He is now on trial for some other sexual assaults and for insurance
fraud. He hurt his back on the job and was deemed 100% disabled but
during that period worked as a tree surgeon. Uh-oh.

I thought it was only during the sentencing phase that the pattern of behavior
is really relevant.
Perhaps it's admissable in the guilt/innocence phase and I'm blocking it out
because I dont think it should be.

Maggie's right. Evidence of prior bad acts _is_ admissible at trial
to show "motive, opportunity, intent, preparation, plan, knowledge,
identity or absence of mistake" [ see Fed. Rules of Ev. 404(b)].
Most states' rules are similar.
Evidence of prior bad acts is _not_ generally admissible at trial to
prove character or that defendent acted consistent with that character
at the time of the crime charged. For example, prosecution can't
introduce evidence of prior convictions and say "he's been bad in the
past, so he must have done this crime too."

Thanks both of you for the correction. Actually GB, I cant see that the rules
you posted about when it is admissable cant be stretched to cover what it is
*not* admissable which makes the idea of inadmissability a farce.
It's kind of like the hearsay rule and all the exceptions.

all, they should know where every prisoner is at every second. Faster
executions of those where there is no doubt of guilt. Don't put

How it that little sweetheart and the rest of your family? My daughter
and grandson just went back home on Wednesday. Had them here for 4
weeks but it just flew by. My grandson is in that stage where he copies
everything and everyone.. LOL .. We went into London to Covent Garden
last Saturday and they had some mimes and such. Matthew was so funny
watching him watch them and then trying to copy them.. HAHAHAHA.
BTW: I wanted to ask you if you know any channels here in Britain that
show truecrime tales and such like they show in the states. We have
ntl: for phone, cable and internet where we are at. We were told they
are the cheapest but since our contract is ready to expire we are
looking around. Any suggestions?

I don't happen to consider a baby a sentient being (it isn't until at
least a year or two) so I'm just as upset at a whale or an elephant dying
as I am a human baby. My feelings might change if I was a parent, but I

I'm not saying it's right to kill a baby (unless it is severely disabled)
but then I don't think it's right to eat meat either.
I *do* think that killing an adult is a *lot* more serious than killing a

as I type, (one-handed!! )

I'm on SKY Digital, they do a number of channels that often touch on crime, eg
Discovery, History channel etc
You get more channels for your money too, than cable!

yeah, I bet she is. I was never so lucky when I had my daughter 21
years ago. We already celebrated Christmas when my family was here.
Hubby and I will probably just stay home in bed alll day.. hehe .. He

I do get Discovery, History on ntl: but don't often see crime programs
on that. Maybe they are different for digital. Have you seen the ones
on serial killers that Channel 5 has been showing? .. Do you know if
