Carruth's son won't visit prison
CHARLOTTE (AP) — Rae Carruth's mother failed in her bid Tuesday to secure
court-ordered visits with the former football player's preschool son.
Lawyers in the case said Theodry Carruth wanted to take the 4-year-old to see
his father, the man convicted of conspiring to kill his mother in a November
1999 drive-by shooting that injured the child as well.
Mecklenburg District Judge Becky Thorne Tin, following a one-hour hearing,
told Theodry Carruth "no court on the face of this earth" would force visits,
given the circumstances.
Doctors delivered the baby, Chancellor Lee Adams, by Caesarean section about
an hour after the shooting. Chancellor, now 4, suffers from cerebral palsy.
His mother, Cherica Adams, died about a month after being wounded in the
southeast Charlotte attack. Her mother, Saundra Adams, gained custody of her
grandson within hours of Cherica's death, and has cared for the child since.
Prosecutors argued during Carruth's high-profile December 2000 criminal trial
that the former pro athlete didn't want Adams to have the baby because he
didn't want to pay child support. He is serving an 18- to 24-year sentence.
During the hearing, lawyers for Saundra Adams and Cherica's father, Jeffrey
Moonie, argued that Theodry Carruth shouldn't get court-ordered visits unless
she could show that circumstances had substantially changed since Saundra Adams
gained custody.
Theodry Carruth's lawyer argued that courts give grandparents fewer rights
than biological parents when it comes to controlling access to children.
Tin called Theodry Carruth to the witness stand and asked her if she still
believed her son was innocent of conspiring to murder Cherica Adams. Theodry
Carruth said she still believes that. Rae Carruth is appealing his convictions.
Addressing Theodry Carruth, the judge said: "With that kind of belief, when
the facts are proven how could any court ever find that Chancellor is adversely
affected by having no contact or limited contact with you? No court on the face
of this earth."
Adams said Theodry Carruth is welcome to visit, but can't take the child to
Rae Carruth.
"I never want Rae Carruth to have the opportunity to touch Chancellor," she
said. "He is convicted of trying to kill Chancellor."
Theodry Carruth said she felt she was being punished because people dislike
her son.
"I'm really disappointed," she said. "This is not about Rae. I'm just here for
my grandson."

I wondered what ever happened to the old bag, thank's for the update. Where
is Rae housed anyway? I'm guessing because the case was heard in
Mecklenburg county he's no longer in Central Prison? Or was the case held
there because that's where the child resides? Wonder who's paying for
Theodry's 'life style' now that she's lost the 'sonny-boy' gravy train?
