More Arrests in Sund/Pelosso Investigation

<http://www.kiem-tv.com/news/sund/sund.html>

The Sund/Pelosso murder investigation has resulted in the arrest of
another man connected to the group of Modesto parolees under suspicion
from the F.B.I.

Agents say their probe into the deaths of Carole and Juli Sund and
Silvina Pelosso led to Modesto Police picking up Kenneth Stewart.
Stewart was arrested on a parole violation and charges of attempted
murder. However, F.B.I. investigators say these charges are not related
to the killings of the three sight-seers.

Another Modesto parolee. Paul Cander was arrested in Alabama for
skipping bail in California. Tuesday, Special Agent Nick Rossi stressed
that although agents may speak to Cander, ***he is not directly involved
in the Sund/Pelosso investigation.***

At this point, agents ***still do not anticipate filing charges in the
killings anytime soon.***

Excerpts from The Union Democrat:

Suspect may be linked to Sund case

<http://headlines.uniondemocrat.com/cgi-bin/news/story.pl?story=202+19990608+1002>

By the Associated Press and staff reports

The investigation of the slayings of three Yosemite sightseers has
turned up evidence of yet another unrelated crime.

A man with ties to the looseknit band of methamphetamine-using parolees
under scrutiny by the FBI in that case was accused Thursday of
attempting to murder a man he knew from prison.

Kenneth Alan Stewart, also known as ''Soldier,'' was taken into custody
Monday by his parole agend and a Modesto police detective during a
scheduled meeting at a relative's trailer home in nearby Ceres.
Stewart, 24, was being held on two counts of attempted murder and a
parole violation, said Modesto police spokesman Kelly Huston.

While the FBI said ***its investgation of the sightseers' murders
contributed directly to Stewart's arrest***, they said the investigation
***did not lead to the arrest of a Tuolumne County fugutive being held
in Alabama today. The man, Paul Leckey Candler,**** 46, of Moccasin, is
accused of skipping bail in March after being arrested Nov. 12 on a
weapons charge.

Candler may be among the many people the FBI wants to question in the
murder case, a spokesman said, but he was not arrested for that purpose.

Stewart's charges, however, stemmed directly from the task force work.

Stewart, who was paroled after serving time for second-degree burglary
and auto theft, is accused of stabbing and then trying to shoot a
37-year-old man over a disagreement that originated in prison.

Excerpts from KTVU Fox News:

<http://www.bayinsider.com/news/1999/06/09/missing.html>

A Tuolumne County man, who is wanted for questioning by the FBI about
the Sund-Pelosso murder case, has been arrested in Fultondale, Ala. and
is awaiting extradition back to California on an unrelated weapons
charge.

According to Alabama authorities, Paul Leckey Candler Jr., 46, was
arrested by bail enforcement agents from Murphys, Calif. at a Super 8
Motel on Monday
in the small town just north of Birmingham.

***"We did not seek his arrest. He is not the subject of any warrants
generated by the (Sund-Pelosso) task force."*** FBI Special Agent Nick
Rossi

A ***nationwide warrant for Candler's arrest was issued Nov. 16*** on a
charge of felon in possession of a firearm.

Officer Jeff Jones of the Fultondale Police Department said his
department assisted bail agents Stephen Sanzeri and Rick Janes with the
arrest at the motel on Highway 31. Jones said Candler was alone and no
weapons or drugs were found at the time of the arrest.

Candler was booked into Fultondale jail where he was questioned by two
Birmingham ***FBI agents yesterday morning for about 20 minutes, Jones
said. Special Agent Craig Dahle of the Birmingham FBI office said
Candler was questioned regarding the Yosemite murders case at the
request of the FBI's Sacramento office. "It was a routine interview,"***
Dahle said.

The results of that interview are being forwarded to the Sacramento
office, he said. FBI Special Agent Nick Rossi, who was in Modesto
Wednesday, said Candler is ***"just one of many people we would like to
talk to'' in connection with the Sund-Pelosso murders. "We did not seek
his arrest," Rossi continued. "He is not the subject of any warrants
generated by the task force.***"

Two suspects in Sund case behind bars
By AMY NILSON

Two key suspects in the case of three murdered Yosemite sightseers are
in custody, ***Tuolumne County District Attorney Nina Deane openly
confirmed Tuesday.***

Deane said the ***two are in custody on other charges, and have not
formally been charged with any crimes related to the sightseer case***

But she indicated that charges in connection with the case are pending
as the search continues for other people who might also have been
involved in the mid-February murders.

Deane's comments confirmed what has been rumored for some time, but so
far has been attributed only to anonymous sources or people outside the
investigation.

"We feel comfortable two of the suspects are in custody on other
matters," Deane said told The Union Democrat Tuesday. "People need to
know that."

***"There may be others involved, but to what extent, we still don't
know,***" she said.

Deane declined to name the suspects she referred to, and said
prosecutors are not yet ready to file formal charges.

"It's coming, but it's not there yet," she said. "We don't have the
whole thing yet. We don't have it all put together. ... There is so much
to do."

While the investigation has focused on circles of Modesto drug users and
parolees -- and ***the suspects are among that group*** -- Deane said
Tuolumne County is still deeply connected.

"Many of the people (questioned) do have ties to Tuolumne County," she
said. "And the bodies were found here. ... It's had a huge impact on our
sense of safety. This is a particularly brutal and frightening crime.

"This cuts to the heart of what we all fear -- the stranger attack."

Since then, Tuolumne County sheriff investigators have teamed up with
the FBI and Modesto law agencies in a joint effort to find the killers.

High-profile case weighs on investigators and staff

By AMY NILSON
The Union Democrat

The murders horrified the nation, and abruptly shifted the focus of the
high profile case to Tuolumne County.

Information on the investigation has slowed to a trickle, but the public
is still fixated. Even the smallest developments or connections capture
headlines as people wait to hear the crime has been solved.

Investigators at this stage bear the bulk of the pressure. The task
force includes agents from the FBI, four investigators and a clerk from
the Tuolumne County sheriff's office, and investigators from the
Stanislaus County sheriff's office and Modesto police. The Tuolumne
County District Attorney's office also has a prosecutor and two
investigators assigned as needed.

Maddock confirmed that also - but didn't state the
number. I'm surprised that it's *only* two!

There's a more extensive covering article in this morning's Fresno Bee but I
can't find the article online. It doesn't appear to be in the online
version of the newspaper. It goes into great detail about why they are
having a problem with building a case against the perps they have in
custody, mostly because they are all drug addicts who can't " remember what
they did yesterday " let alone weeks ago with regard to this case.

I think the qualifier is key or major players.  There are minor players, too.

We don't know how many yet.

Hi, Sherry -

There's two almost-identical stories (Fresno Bee and Sacramento
Bee) -- I posted the URLs under another thread. If you didn't
see it, the stories are at:
<http://www.fresnobee.com/localnews/story/0,1225,85364,00.html>
<http://www.sacbee.com/news/news/local01_19990610.html>

The reason I'm posting both URLs is to highlight the conflicts
between the two stories (yet obviously, both were primarily
written by the same person!)

Fresno Bee:
To prove a federal capital case, authorities would have to
present evidence that the perpetrators hijacked the
threesome's vehicle with intent to cause them great harm,
prove that the slayings occurred on federal property or show
that the tourists were slain by someone hired to do it.
Maddock declined to disclose whether the task force's
evidence meets any of those standards but said investigators
are leaning toward a state prosecution.

Me: If leaning towards a state prosecution, this
pretty much blows the "Jens did it" stories out of
the water, doesn't it?

With the current "pressuring" of witnesses/suspects
to talk, if there was any hint of a murder-for-hire, I
doubt Maddock would have phrased his statement
that way.

Sacramento Bee:
We all agree that ideally it should be a state case ... But
because we don't know all of the issues about why or where
(a carjacking occurred), it's premature to decide which
approach would be best at this point."

Me: This variant seems to tell us that the investigators
know that the "locals" want to have their own case - but
that the firm decision hasn't been made.

Murder for hire has absolutely no bearing in this case.
It is a special circumstance making a case capital in California.
Give it no thought.
