It is not surprising Occhifinto, a wealthy and politically
well-connected New Jersey businessman, and Wheat, one of Atlanta's
most prominent and wealthy young citizens, have a lot in common; they
are both convicted international drug smuggling felons whom have known
each other for a long time and sometimes work as partners[1] in their
nefarious endeavors. The similarities don't stop there i.e.
Occhifinto is a convicted money launderer and Wheat is currently under
investigation for the same in both the U.S. and Belize[2]. Both
Occhifinto and Wheat are currently under investigation by the FDA, FTC,
DEA, IRS, FBI, other U.S. Justice Department subordinate agencies, and
various State Attorneys General.
What the authorities don't know is that Wheat, well aware he could be
indicted any day, has paid off authorities in Belize in preparation for
his flight from justice whereat he intends to spend the rest of his
life enjoying the millions of dollars he has already made as well as
the millions he will make from his next caper.
Wheat's next caper is a clever scheme to exploit the revocation of
the ban on Ephedra wherein he will distribute complying products
containing low dosages of Ephedra to the mainstream while sub rosa
distributing what has now been deemed to be potentially fatal
noncomplying dosages to pre-existing customers. The latter garnished
him millions heretofore and he has every reason to believe he will do
even better operating clandestinely both inside and outside the
country. This is in fact a practice he is currently engaged in with
Viagra-like drugs as well as steroid-like drugs. Wheat, individually
and through the web of companies he controls, has gone as far as to
re-register, no less than 50, old drug trademarks[3] and is now
distributing Viagra-like drugs and steroid-like drugs utilizing the
same modus operandi.
Wheat has a well rounded U. S. and international portfolio insofar as
he manufactures look-alike designer drugs overseas and then imports
them into the U.S. Once in the U.S., utilizing the soak method wherein
the tablets are soaked in controlled substances, he causes them to be
redistributed. These tablets may be identified on the street by their
"worn" look or by the fact that the edges lack definition as a
result of the soaking process.
Wheat views the I.R.S. as his biggest competitor hence he employs
money-laundering in the U.S. to put him on equal footing. He has
stated sales in various lawsuits that are not even close to his actual
sales. A quick check of the sales through the many legitimate U. S.
distributors evidences the fact that 3 distributors alone have
purchased more than the aggregate sales Wheat provided to the FTC.
Wheat knows the authorities are closing in but like his mentor
Occhifinto he has invested substantially in creating the perception he
intends to weather out his fight with law enforcement when in fact,
unlike his mentor, he has a well-financed, carefully planned exit
strategy designed to deliver him to Belize as a very wealthy free man
ala Robert Vesco and Marc Rich.
Together Occhifinto[4] and Wheat[5] leave behind a long trail of
bodies[6] and consumers whom were duped into believing they were
ingesting safe dietary supplements. A Google search of either name
"Robert Occhifinto" or "Jared Wheat" will tell you how U.S. law
enforcement feels.
In closing it should be known that Wheat has absolutely no intent in
settling his current litigation with the FTC, his only concern is to
draw it out as long as possible and then to flee to Belize from where
he will continue the same.

[1] Profits Abound in Unregulated Ephedra Market

Robert Occhifinto is a twice-convicted felon and one-time piranha
farmer with no formal training in science or medicine.
Yet, the 41-year-old New Jersey businessman has made millions of
dollars hawking yellow pills he concocted that promise to turn flab
into muscle, provide jolts of energy and enhance sex appeal.
Occhifinto's company, NVE Pharmaceuticals, markets Stacker 2 and other
dietary supplements via the Internet, retail stores and a NASCAR
auto-racing sponsorship. The company generates $29 million in annual
sales, according to an industry group, though a top executive says the
actual amount is much higher.
But federal authorities have raided NVE's plant in Green Township,
N.J., twice this year, destroying millions of dollars worth of
supplements and raising questions about the marketing of company
products and the ingredients that go into them. The Food and Drug
Administration continues to investigate the company.
Occhifinto isn't giving interviews, denying repeated requests during
the past two weeks. But he hasn't been able to keep all his secrets to
himself.
Under oath before a congressional committee last month, he lifted the
lid on a hidden, largely unregulated world where people like him
produce dietary supplements by reading books and magazines, without the
help of chemists or pharmacologists.
Often, their favorite ingredient is ephedra, a potentially dangerous
herbal stimulant the FDA has linked to strokes, heart attacks and
death.
"How many more innocent victims will have to be buried before the FDA
stops this man?" asked Sen. Dick Durbin, D-Ill. Durbin has been raising
questions about Occhifinto since an Illinois high school athlete, Sean
Riggins, died of a heart attack last September while using Yellow
Jackets, an NVE product that contains ephedra.
"We have reached a sad point when this fellow with a high school
diploma can peddle dangerous drugs legally," Durbin said. "The FDA
should be ashamed."
Walter Orcutt, vice president of NVE since April 1, and the chairman of
the Warren County Republican Party, said, "We are having no comment --
that is our official stand" regarding the pending investigations.
"We are all operating within the rules we have, but there are not many
rules, as one can see," he said.
Under a 1994 federal law, dietary supplements made of herbs, vitamins
or amino acids don't have to be tested for safety or effectiveness like
prescription drugs. Companies may sell the products over-the-counter
without FDA premarket approval, but they can't make misleading claims
or promote them to treat a particular disease.
After the law passed, the dietary-supplement industry boomed, and
companies began marketing a host of products claiming to reduce weight,
increase energy, build muscles, improve athletic performance and
memory, increase sexual drive or offer a better night's sleep.
Arthur Grollman, a professor of pharmacology and medicine at the State
University of New York at Stonybrook, said NVE is "small potatoes"
financially, but one of the many "reprehensible" promoters in the $17
billion industry.
"He is part of a significant section of the industry that is willing to
take advantage of an unregulated environment and take chances with
public health in order to make a lot of bucks," Grollman said.
Occhifinto was already established in the business by the time Congress
gave the dietary supplement industry its green light.
He entered the business fresh out of Lenape Valley Regional High School
in 1980 by opening a retail vitamin store, Netcong Vitamin Emporium,
with money he had saved.
In recent years, he has personally developed all of his company's
dietary supplement formulas "by referencing herbal books, magazines,
what was on the market, what could be sold," he testified. He said he
never sought the help of professionals.
"I've been in this industry for 23 years, and that is practical,
on-the-job training," he testified.
NVE employs about 80 people and generates about $29 million in sales,
according to Information Resources Inc. of Chicago, a marketing
research firm. Orcutt said the sales are actually "appreciably higher."
NVE's main product is the Stacker 2 ephedra dietary supplement, the
name of which is plastered on the Winston Cup Series car of NASCAR
driver Kenny Wallace.
It is advertised as the "world's strongest fat burner" and promoted for
weight loss, body building and as an energy booster. It sells for
$39.95 for 100 capsules.
While building NVE through guile and aggressive marketing, Occhifinto's
other business pursuits have been less successful.
>From 1983 to 1985 he ran a tropical-fish business, and from 1985 to
1995, he had a construction firm. Starting in 1987, he also raised
piranha and sold them to oriental restaurants. The fish-farm business
failed, and he filed for bankruptcy protection during 1993, according
to information from Dun & Bradstreet.
Occhifinto's practices have gotten him in trouble with the law.
In 1983 he was arrested on a narcotics charge and placed in a pretrial
intervention program. Eight years later, he was sentenced to eight
months of home confinement after being convicted of illegally importing
liquid hashish.
Then, in 1996, Occhifinto was sentenced to 18 months in jail and fined
$50,000 for concealing $350,000 he made selling 100 kilograms of the
chemical ephedrine to an individual who used it to make the illegal
drug methamphetamine, according to Occhifinto's congressional testimony
and documents from the Drug Enforcement Administration.
Occhifinto's practices at NVE have attracted scrutiny.
During the mid-1990s, he began concentrating on making supplements with
ephedra, an ingredient derived from an herb that acts as an
adrenaline-like stimulant affecting the heart and central nervous
system. The FDA is considering restricting or banning the use of
ephedra products.
Two of NVE's ephedra products were known as Yellow Jackets and Black
Beauty. Occhifinto testified it was a coincidence Yellow Jacket is a
street name for barbiturates and Black Beauty amphetamines.
A day after Occhifinto's testimony, FDA Commissioner Mark McClellan
told Congress how FDA agents during January, armed with a search
warrant and accompanied by U.S. Marshals, ordered the destruction of
the $4 million to $5 million worth of NVE's Black Beauty and Yellow
Jackets supplements.
McClellan said the pills weren't intended to supplement the diet, but
were pushed for "recreational purposes, to get high." That is illegal,
he said.
After the raid, McClellan said NVE began selling supplements called
Yellow Swarm and Midnight Stallion as replacements that "appear to be
identical in formulation and appearance."
"Safety issues associated with these types of products remain," said
the FDA commissioner.
The FDA followed with another raid during late May, finding five herbal
supplements known as SIGRA, STAMINA Rx, STAMINA Rx for Women, Spontane
ES and Uropin contained tadalafil, the active prescription-drug
ingredient in Cialis, a male-potency drug produced by Eli Lilly that is
approved for sale in Europe.
Occhifinto testified the firm received the ingredients from Hi-Tech of
Norcross, Ga., and simply was making the product for them. Jared Wheat,
president of Hi-Tech, couldn't be reached for comment.
The FDA warned during June these supplements pose a serious health risk
including "a drastic lowering of blood pressure."
FDA spokeswoman Kathleen Quinn said federal law requires any product
with a prescription ingredient to be tested for its safety and
effectiveness, and to be approved for sale by the government. There is
no record of Occhifinto's company ever receiving FDA approval to make
or market such a product.

[2] Police Bust Open Major Recreational Drug Ring

It's one of the largest single day ecstasy seizures ever recorded
anywhere and tonight, Belize's Anti-drug Unit has recovered 228,153
Ecstasy pills valued at U.S. $5.7 million.
The seizure was made at Target Data Pro in the Data Pro Export
Processing Park at the junction of the Northern Highway and the Burrell
Boom road. The company is licensed to operate as an online pharmacy,
selling legitimate drugs but it turns out it was operating primarily as
a clandestine ecstasy lab. The drug unit descended on Target's
warehouse last week Thursday and for the past 5 days officers have
literally been bagging and counting hundreds of thousands of ecstasy
pills.
Today, one man was charged and he is the local Accountant Guillermo
Pech Jr. In court this afternoon, he was read 16 counts of drug
trafficking to which he pleaded not guilty. The charges of are for
restricted drugs including pills for depression, specifically Xanax,
weight loss, Didirex, and tranquilizers, specifically Valium and of
course, Ecstasy. In total Pech was charged for 383,000 illegal pills,
and 22 kilograms of pills powder. He was offered bail of $15,000, but
did not meet it and will spend the night in remand.
It's a heavy rap and Pech is only the accountant, the manager who is
also a Belizean is out of the country as are the two owners, American
men. One of them, known to us as Jared Wheat, slipped out of his
residence at a local hotel, the day after the police moved in. So far
police investigations show that Target would accept online orders for
Ecstasy and other drugs, and send them right out of the Belize Post
Office in DHL envelopes. Typically, the drug would be concealed in
magazines, placed in the envelope and looking like regular mail would
slip past postal authorities. In Belize that omission was particularly
gainful as Target reportedly did tens of thousands of dollars in
business every month with the local post office.
And again, while most of the Product was shipped out, some of it was
smuggled out by local employees and the Ecstasy pill with the playboy
logo has been circulating on the city streets. After this r3ecord
seizure, the DEA which came in to observe the operation last week is
expected to follow up with some federal indictments. And while U.S.
authorities follow up, the Belize Customs Department also has to answer
some tough questions including the fact that massive quantities of
prohibited substances were imported by Target Data Pro without a
permit.

Target's Assets Frozen

The legal vise continues to tighten around the corporate neck of Target
Data Pro.
7NEWS has learned that Belize's Financial Intelligence Unit has frozen
two of Target Data Pro's accounts and a related account all in Belizean
banks. We are reliably informed that the total amount frozen is over $2
million. That freeze will be argued next week in the Supreme Court when
Target will be represented by Hon. Dean Barrow. And while that matter
is in the upper courts, in the lower courts, money launder charges were
brought against Target's Belizean accountant and its manager. 26 year
old Guillermo Pech and 36 year old Michelle Young were charged with 5
counts of money laundering for transfers totaling US $350,000.
But that's only the beginning, police have dozens more charges prepared
for Targets American principals Jared Wheat, and Peter Rouss along with
well known local mover, Gerald Macdermott. Those charges amounting to
hundreds of thousands of dollars in money laundering accusations are
expected to go through next week.
Find this police claim to have found 228 thousand ecstasy pills. It was
an incredible bust, and now it turns out that it is just that... an
incredible bust because the pills were not ecstasy. Tests conducted in
the United States on batch samples show no proof that the pills were
ecstasy, scientifically known as MDMA. So how could the Belizean
authorities have made such a major gaffe? Well, we're still trying to
figure that one out, but it seems the pills had a popular design for
ecstasy pills, which is the playboy logo. But looks like it, isn't
quite it, and now the supreme court has entered the picture to order
the police to return all the drugs that are not controlled substances
to Target Data Pro. This includes prescription drugs such as Viagra,
Xanax, Didirex, and Valium. That's a request local authorities are
still stalling on as they say they now want to charge Target's owners
for mislabeling the drugs - a far less serious offence than trafficking
in a controlled substance.

Target Data Pro's Bigwigs Targeted

The whirlwind investigations into Target Data Pro's activities is
settling and in its wake charges are being filed against a number of
persons.
Today another to be taken in to Magistrate's court to face charges is
77 year old businessman Gerald "Jerry" McDermott. He along with his
Attorney Dean Barrow appeared before Magistrate Earl Jones where he was
read five counts of money laundering. No plea was taken as the charges
are indictable.
Allegations are that on January of 2003 McDermott was involved in a
transaction in which some US$105,000 believed to be proceeds of crime
was transferred from an account of Target Data Processing limited at
Provident Bank and Trust of Belize Limited to an account of Generic
Limited at the same bank. Other charges are grounded on allegations
that other monies amounting to some US$180,000 were in the possession
of McDermott, these are believed to be proceeds of crime. The final
charge alleges that he was involved in a transaction that was the
proceeds of crime.
4 other persons were jointly charged with McDermott, they are Michelle
Young and Target Data Pro's accountant Guillermo Pech; in absencia is
David Brady Jr. and Jared Wheat. Today McDermott walked out of court on
$50,000 bail. The case was adjourned until September 13th.

Fake Ecstacy

It was a very big deal in july when police claimed to have found a
massive ecstasy manufacturing operation at a company called target data
pro in the export processing park. After 5 days of counting, as the
financial intelligence unit moved to freeze accounts connected to
target data pro director Jared Wheat. According to U.S. authorities,
these accounts are the product of money laundering. The chief justice
again dismissed the freeze order, that had already been dismissed
earlier in the month by justice Lucas. Even with this, we are told, the
finanical intelligence unit and the DPP's office, both eager to please
their US counterparts, are still trying to seize the accounts.

The DPP eyes the Leader of the Opposition

For the past week, rumors have been circulating in legal circles that
DPP Kirk Anderson is considering bringing charges of money laundering
against leader of the opposition, Dean Barrow. That rumor today made it
to print when the story was mentioned in two articles in today's times.
Through its own investigation, 7 news has learned that the DPP has
written to the director of the Financial Intelligence Unit Keith Arnold
recommending that money laundering charges be brought against Barrow
and the Atlantic Bank. Both do business with EPZ company Target Data
Pro, the owner of which, Jared Wheat, is under investigation by the
united states department of justice for money laundering. Anderson
alleges that Barrow has been paid lawyer's fees from an Atlantic Bank
account whose proceeds are derived form money laundering.
But Anderson is the only convinced that the account is tied to money
laundering activity, because twice two different justices of the
supreme court have struck down applications to freeze the account. Most
recently, just two weeks ago, the chief justice said that the DPP's
application to freeze had no merit. Still, that had no effect on the
DPP, but it did instruct the actions of the FIU director Arnold, who,
as we understand it, has informed the DPP that there is no evidence or
authority to suggest that such charges can be brought.
With that, what we understand to be a firm refusal, the plan is
stalled, but it's worth noting because of the explosive political
nature of even the suggestion to bring such charges against a political
leader. For background, we note that Barrow and the DPP had a quite
fierce showdown in arguments on the same case before the chief justice
a week ago, in a hearing that Barrow ended up winning when the chief
justice ordered the target account un-frozen.

Target Data Pro Assets Frozen

In the Supreme Court today Justice Adolph Lucas ordered that two
accounts related to the Target Data Pro investigation remain frozen.
US$27,000 in an account belonging to Generic Limited at Provident Bank
and Trust and another $89,000 for Target Data Pro at Atlantic Bank were
frozen. Attorney Dean Barrow however successfully argued against any
action on the account of Pegasus Resources and its US$1.9 million at
Atlantic Bank. Justice Lucas ruled that he didn't see any connection
between Pegasus and the alleged irregularities at Target. The crown
alleges that Jerry McDermott who is the Director of Pegasus is also on
record as the Director of Generic Limited but dean barrow who is his
attorney argued that is simply hearsay since prosecutors offered no
concrete proof.

Police Find Ecstasy Pills at Data Pro Park

They've had it under 24 hour guard for the past week, and this Morning,
the Anti-Drug Unit descended on the company called "Target," in the
Data Pro Export Processing Park. 7NEWS was on the scene as police and
forensic specialists went inside looking for export quantities of the
illegal recreational drug ecstasy.
Keith Swift Reporting from Data Pro Park,
"Behind me is the headquarters of Target Data Pro Company. There are
police vehicles in front of the building because inside this morning
officers from the Anti-Drug Unit are conducting a search where they
expect to find barrels full of the illegal recreational drug ecstasy.
They also expect to find other drugs in illegal quantities such as
alprazolam which is used in the creation of the anti-anxiety medication
Xanax."
Late information this evening is that the drug unit has found a
significant volume of ecstasy and have spent much of the day counting
the pills. Charges are expected to follow but two who won't get caught
in the net, at least not right now, are the American owners who police
have not been able to find as at least one of them is believed to have
absconded.
The products from Target are sold over the internet to international
purchasers but investigations show that some ecstasy and high grade
viagra have entered the local market, presumably as the product of
employee theft. Information also indicates that Belize's drug unit is
working in concert with the DEA and agents are expected in Belize to
assist with the case.

Police Close In On Rogue EPZ Operation

The Police Department has been moving swiftly to draw the net in on a
rogue pharmaceutical operation in the Data Pro Export Processing Zone.
Since we broke the story on Friday (Police investigate irregularities
at Data Pro Park) one man has been arrested and police have been
looking for two others. That's after police chemists found that Target
Data Pro which manufactures prescription drugs in the zone and sells
them over the internet was determined to be in violation of local drug
laws specifically that they had imported a prohibited substance. But if
this company sells its product over the Internet, what's the local
link? Well Keith Swift has been looking and found some fairly
specialized drugs available on the city streets. Here's his story.

This small little pill with the playboy logo may look like a play pill
or some sort of placebo but in fact this is the real thing - the
recreational drug ecstasy and this pill came from the streets of Belize
City where it is available.
Where did it come from? Authorities are investigating a business here
in the Data Pro Export Processing Park where a company called Target
Data Pro is in the cross hairs. This morning the company's 26 year old
accountant Guillermo Pech Jr. was taken to court and charged for
trafficking of 3,660 pills with the drug alprazolam which is the main
ingredient in the anti-anxiety medication Xanax.
But he's just the local employee left holding the bag full of pills.
Authorities are now after two American men who own this company and are
believed to be running a profitable and high volume operation out of
the EPZ Park. These men are now wanted for questioning by the police
and one of them is known to be out of the country.
The Anti-Drug Unit has mounted a 24 hour watch on the building to make
sure that no one leaves with anything because inside may be restricted
drugs including this: a high grade version of Viagra which is also on
Belize City's Streets. Its called sildenafil which is the active drug
in Viagra and these pills are 100 milligrams each. That is the five
times the normal dosage and on the streets these sell for as little as
$20 each.
It's just the tip of the iceberg in an investigation that threatens to
shake up the free wheeling largely unregulated EPZ community.
As we noted police are looking for the two American men who own Target
Data Pro. The manager who is a Belizean is also believed to be out of
the country and will also face questioning when he returns.

'Shady Business' at Data Pro

"Shady business", that's what 14 employees of a company in the Data Pro
have concluded after finding themselves without a paycheck, without
employment, and without anyone to give them answers. On the 4th of
January employees of Mirage, an online sports gambling operation at the
Burrell Boom cut-off, were told to take the 5th and the 6th off and
return to work on the 7th. But when they returned to work, they found
that it had been cleaned out. And it's not the work of thieves; it's
the owner, a Canadian businessman who decided to just pack up and leave
without telling his workers. Now the employees of Mirage are holding on
to a promise that they will be paid for their last week of work and
accumulated vacation pay when their boss in exile sends them money
through Western Union this weekend. If it seems strange to you, to the
employees it seems like a straight up "wop" and now all they can do is
wait and hope that their money is indeed wired to Western Union. We
note that Mirage's website is still up and taking bets.

Police Investigate Irregularities at Data Pro Park

Export processing zones are set up as one of government's investment
incentives but these companies enjoy what is known as supra-legal
status, meaning that they are above domestic law. But there are laws
and conditions that these EPZ companies have to obey and tonight 7NEWS
has learnt that police are investigating a Ladyville EPZ for
irregularities.
A company, operating out of the Data Pro Export Processing Park, which
sells prescription drugs over the internet is being investigated for
the suspected manufacturing and exportation of controlled class C drugs
for which they have not been granted a license. It's a quite
significant multi-agency investigation that will require the
cooperation of medical, customs, and police departments with support
from the Attorney General's Ministry and BELTRAIDE. Police have
information from their U.S. counterparts that the company may have run
afoul of federal authorities.
Keith Swift Reporting from Data Pro Park,
Yesterday that information led police here to the Data Pro Export
Processing Park in Ladyville. We can't say which one it is because
these buildings carry no name but yesterday police staged a raid of one
of the properties on here and confiscated a stash of prescription
drugs. Those drugs have now been sent to the Forensic Lab in Belize
City for testing.
We have also learnt that these same drugs have been under scrutiny also
from U.S. authorities who suspect that the mixtures within the drugs
may not comply with Food and Drug Administration standards.
While 7NEWS has confirmed form multiple senior sources that yesterday
police were at the Data Pro Export Processing Zone, a Data Pro
Representative today flatly denied that report. She also insisted that
police have not taken any prescription drugs from any company there.
Still, according to our information, tests have turned up an amount of
drugs that are classified as class "C" drugs under the misuse of drugs
act which are prohibited. It is now up to the company to prove it has a
license to possess and manufacture using those drugs.
In an unrelated story, 7NEWS has received other information that police
are also investigating the appearance of a suped-up, high grade version
of Viagra that has appeared on the city streets, specifically in the
Victoria street area. So far the source of the prescription drug has
not been determined but police believe it is being illegally
manufactured in and smuggled out of the Corozal Free Zone.

NEWTON - Yet another lawsuit has been filed against a Green Township
company that, until a nationwide ban took effect last spring,
manufactured and sold dietary supplements made with ephedra.
In the new complaint, filed Monday in Superior Court in Newton, Michael
and Kelly Whalen, of Duchess County, N.Y., seek unspecified
compensatory and punitive damages against NVE Pharmaceuticals Inc. for
negligence and breach of warranty. The company marketed Stacker II, a
product the lawsuit blames for Michael Whalen's heart attack two
years ago.
Stacker II, the main ingredients of which were ephedra and caffeine,
was advertised as a product that would enhance its users' energy and
promote weight loss. According to the lawsuit, however, it contained
"a potentially lethal combination of ephedra alkaloids and
caffeine" which triggered Whalen's heart attack.
"Despite the availability of a large body of medical literature and
governmental publications warning of the potential dangers to human

public the product Stacker II," the lawsuit states.
The federal Food and Drug Administration has banned the sale of all
dietary supplements containing ephedra since April.
A stimulant derived from the Chinese herb ma huang, ephedra was a
popular supplement among body builders and others who wanted to lose
weight. It was banned after being linked to more than 150 deaths -
most notably that of Baltimore Orioles pitcher Steve Bechler in 2003.
It has also been shown to cause headaches and heart palpitations, and
has been associated with strokes, seizures, high blood pressure and
heart attacks.
The lawsuit states Whalen took Stacker II based on the recommended
dosage on the label, and that the label failed to warn of ephedra's
health risks.
"The label implies that there is no risk of injury associated with
ingestion of the product if the consumer does not suffer from one of
the enumerated (medical) conditions," it states.
NVE, which once promoted more than 80 ephedra-containing products, now
manufactures non-ephedra-based dietary supplements - including a line
of soft drinks called Stinger - in a converted cheese factory on
White Hall Road in Green.
The company's owner, Robert Occhifinto, served 18 months in federal
prison in the 1990s for money laundering after being convicted of
selling 100 pounds of chemical ephedrine to a California man who used
it to make methamphetamine. He later spent eight months under house
arrest for importing liquid hashish.
In 2003, federal agents directed NVE to destroy $5 million worth of
Yellow Jackets and Black Beauties - which a separate wrongful death
lawsuit filed last month against the company claims are actually
barbiturates and amphetamines, respectively.
An article in Forbes magazine last year stated there were at least 30
wrongful death suits pending against Occhifinto and NVE. Kevin Kelly,
an attorney for Occhifinto, said he could not comment on the lawsuit
Tuesday because he had not yet seen it.
