Exclusive: As Andrea Yates begins her appeal with help from an anonymous
$50,000 donation, her husband says, ‘I’ve given all that I want to give’

Oct. 7 issue — Attorneys for Andrea Yates, the Houston woman who
drowned her five children, can now proceed with her appeal. An anonymous
donor last week agreed to pay the roughly $50,000 cost of preparing a
transcript of her trial—the first step in launching her appeal.
ATTORNEY GEORGE PARNHAM wouldn’t identify the donor. But Debbie
Holmes, a close friend of Yates’s, questioned why Rusty Yates couldn’t come
up with the cash himself to help free his wife. She noted that he recently
moved out of the family home into a nearby luxury-apartment complex that
boasts a stocked fishing pond, white-sand beach, resort-style pool with
cabana and gym. One-bedroom units in the pink Mediterranean-style complex
rent for nearly $1,000 a month.
“Why isn’t he living in that bus?” Holmes says, referring to the
converted Greyhound that the Yateses once lived in. “It was fine for his
family, for his children to sleep in that luggage hold.” Psychiatrists
testified at the trial that the stress of those living conditions
contributed to Andrea’s mental decline. For his part, the NASA shuttle
engineer told NEWSWEEK that he moved out of the house where his children
died because he wanted to simplify his life. “I don’t want to spend my time
cutting tree limbs,” he says. As for the appeal, which he gives only a 30
percent chance of success, Rusty says he’s paid all he’s going to pay.
“What I spend on food and lodging is nothing compared to what I’ve paid in
legal expenses,” he says. “I’ve lost money in this, not made it. I’ve given
all that I want to give.” His pastor, the Rev. Byron Fike, says he remains
involved in the church: playing basketball, attending men’s prayer sessions
and becoming involved in the singles group.
Yates says he’s still considering suing his wife’s doctor and the
mental hospital that released her less than a month before she drowned the
children. He’s also contemplating another legal action: divorce. “Being
apart from Andrea has been an extreme struggle,” he says, adding that he is
allowed to hug her only once a month. “Andrea and I need to sit down and
work out where we’re going from here.”
Meanwhile, Andrea’s health has improved. According to those who
have visited her, she is taking about a fourth of the antipsychotic
medication she was during her trial, she works in the laundry room and she
takes part in group therapy. She also now fully realizes that she killed
her children. Recently Yates asked her mother to bring photos of them.
“When she saw these pictures, you could see the pain and the sadness,” says
Holmes, who was there. “She just cried

Becoming involved in a singles group??????? Perhaps Mr. Yates should
reread the tenants of his faith. He was adamant that his family live by
his interpretation of biblical instruction and used the same to drive
his wife over the edge. Perhaps he should do some more Bible
studying...he will see that he is still a married man.

Funny how so many folks pick and choose the rules they will
follow...maybe it's not funny.

It's been clear to me that Yates only does what is
convenient for him. This includes leaving a disturbed
woman alone with 5 small children. It's not surprising
he is moving on, probably to another woman who can produce a new
"basketball team" for him.

This is beyond revolting. Rusty did a ROI[0] calculation and deemed
his wife's appeal NOT cost effective. The possiblity that she would be
returned to him for further breeding is just too low for the financial
output. However, moving to a luxury 1-bedroom apartment ALONE - when
he could just live on his bus or in his house... In the long term,
it's a better payoff.

right. he's gonna "sit down" with her and "work out where {they}'re
going" once he's done "contemplating" divorce.... I bet this session
of Rusty and Andrea "working out where they're going" will consist of
him serving her with divorce papers.

Rusty Yates is an asshole. She's better of without him. He, however,
will always be one of the most despised people on the face of this
earth - in my book.

I'm so angry/shocked/disgusted by reading this article that I'm dizzy
and my hands are numb.

I know. Everybody hates Rusty, everybody wants to crucify Rusty, it's
all Rusty's fault. Rust whould be punished, Rusty should get the death

And when he tries to sue the people who failed to treat Andrea, he
gets slammed for that too.

It makes me sick. Every irresponsible action done by a woman has to be
blamed on a man. Why is that?

I pretty much agree..but if she is fully responsible for her own act, why sue
the hospital? I don't like the blame-shifting mindset of many people either,
but suing the hospital would seem to be another example of doing just that. So,
in that respect, I think "getting slammed" is what he deserves. (Actually, I
think he just wants money.)

He's damned if he does and damned if he doesn't. He'll be damned if he
tries to help his wife, he'll be damned if he walks away and starts a
new life. He's damned no matter what he does, solely by virtue of the
fact that he married a child-killer. Because he's the MAN. And all
crimes commited by a female must be blamed on a man. The nearest man.
Preferably, one who loves her.

If Rusty Yates drowned each of his children, would people be
persecuting his wife? I don't think so.

If you were undertreated for a serious disorder, causing detrimental
harm, would the practice who treated you be at fault in any way?

Please. Mothers are routinely blamed for how their children turned out.

Mr. Yates is being villified because of his own actions. He
impregnanted a severely mentally ill woman. Twice. Then left her in
charge of his children when he knew she was homicidal towards them. Now
he's moved on to a single's lifestyle. The guy is a creep.

And did not live in a "motorhome" but a bus, where he had his kids sleep in
the luggage compartments and kept half of it to himself for a "workshop".
Dominating, manipulating, demanding and controlling all of their lives,
thoughts actions and deeds.

Spend 24 hours in that amount of square footage with that form of
deprivation with that amount of children for whom you are the sole caretaker
and then think about it. Think about having to get up in the morning - if
you have even been able to sleep all night - and doing it again. Pregnant.
Again.

worked. As a NASA engineer I'm sure he had the income to hire people to take
care of those kids and their mother. The fact he impregnated her twice is
complicated by the strict religious sect of which they were members, which
forbid any form of birth control (or so I understand). I have a friend whose
wife suffered from severe post-partum depression. They got permission from
thier priest (they are Orthodox Christians)for her to get a hysterectomy, and
even today he frets whether they did the right thing because he believes that
God wants married people to be fruitful and multiply. So I can see Rusty
Yates wanting to have kids for that reason. But his neglect of his severely
ill wife was reprehensible, as were his actions since, including appearing on
the Tonight show of all things, and moving into luxury apartment. If he can
afford a luxury apartment, he could have afforded to pay a nurse to look
after his wife and kids. I find him creepy, callous and crass. The hospital
may be liable for releasing her, but he was responsible for not making sure
she got proper care.
Would I be so considerate toward a man who committed the same horrible deed?
If he were suffering from a severe mental illness such as schizophrenia or
manic depression I would.
