BY DEKE FARROW | ERIN TRACY The president of the Hells Angels Motorcycle chapter in Fresno was among three Angels convicted Thursday in federal court of murdering one of their members in aid of racketeering. Fresno chapter president Brian Wayne Wendt of Tulare, along with Santa Rosa residents Jonathan Nelson and Russell Taylor Ott, were found guilty for the 2014 killing of fellow Angels member Joel Silva, the Department of Justice said. The murder happened in Fresno. Wendt, 45, Nelson 46, and Ott, 69, had determined that Silva was “creating problems” for the motorcycle club and, thus, decided to kill him, according to the DOJ. According to federal prosecutors as told by NBC Bay Area, Nelson arranged for Silva’s murder with Ott. Ott drove Silva from the Santa Rosa area to Fresno on the pretense of his needing to “fight” with the Fresno chapter president Wendt in order to resolve his problems with the club. Upon arrival at the Hell Angels’ clubhouse in Fresno, Wendt shot Silva in the head. The following day, Silva’s body was illegally cremated at a nearby funeral home. Silva’s death led to the FBI investigating the Fresno Hells Angels chapter and the Sonoma County Hells Angels chapter. The Fresno Hells Angels chapter operates a toy drive for children each year during the December holiday season.
However, a 2017 indictment described the Hells Angels as a violent, transnational outlaw motorcycle gang. In addition, the Hells Angels Sonoma County chapter was considered a subset of the gang whose members primarily operate in that Northern California county. The Sonoma County motorcycle gang was accused of committing murder, assault, maiming, witness intimidation and more in the 2017 indictment. A total of 11 Angels were arrested on racketeering charges. The DOJ said that activity included murder, drug dealing, assault, robbery, extortion, illegal possession of firearms and obstruction of justice — which Wendt, Nelson and Ott took part of. Wendt, along with Nelson and Ott, each face 10 years in prison for conspiracy to commit murder and a lifetime in prison for the racketeering conspiracy charges. Three Members Of Sonoma Motorcycle Gang Convicted Of Racketeering Conspiracy And Related Crimes
Jury Finds Defendants’ Enterprise Engaged in Broad Array of Violent Crimes Including Murder, Assault, Robbery, Extortion, and Witness Intimidation
SAN FRANCISCO – Earlier today, a federal jury found Jonathan Nelson, a/k/a Jon Jon; Brian Wayne Wendt; and Russell Taylor Ott, a/k/a Rusty, guilty of murder in aid of racketeering as part of their participation in a criminal enterprise involving their membership in the Sonoma County charter of the Hells Angels Motorcycle Club (HASC), announced United States Attorney Stephanie M. Hinds and Federal Bureau of Investigation (FBI) Special Agent in Charge Sean Ragan. The verdicts follow a nine-week trial before the Honorable Edward M. Chen, United States District Judge.
“The jurors found that these members of a violent motorcycle gang killed one of their own and engaged in a conspiracy to commit many other serious criminal acts,” said U.S. Attorney Hinds. “This office is laser-focused on removing from our neighborhoods those elements who use violence to achieve illegal goals. Today’s verdicts are the result of an intense multi-year investigation and should serve as notice to all such criminal enterprises that this office will devote the resources necessary to bring them to justice.”
“Today’s verdict marks a milestone in an investigation that spanned nearly eight years and involved multiple agency partners, including the Santa Rosa Police Department and the California Highway Patrol. Each agency involved in this investigation provided crucial expertise and resources, making a guilty verdict possible,” said Special Agent in Charge Ragan. “Criminal acts perpetrated by the convicted members of the Sonoma County and Fresno County Hells Angels adversely affected our communities, and their presence infested our citizens with worry. Today’s verdict is a step toward removing their violent and criminal ideals from our community.”
On October 10, 2017, a federal grand jury indicted eleven members and associates of the HASC, charging the defendants with being part of a conspiracy whose members furthered the aims of the enterprise by engaging in a broad swath of criminal activity including murder, narcotics distribution, assault, robbery, extortion, illegal firearms possession, and obstruction of justice. As set out in the indictment, the Hells Angels is a transnational violent outlaw motorcycle gang and the HASC is a subset of the gang whose members primarily operate in Sonoma County, Calif. while working cooperatively with other Hells Angels chapters to engage in criminal activity. The trial that led to today’s verdict focused on the activities of Nelson, 46, of Santa Rosa; Wendt, 45, of Tulare; and Ott, 69, of Santa Rosa. In finding all three defendants guilty, the jury concluded that each conspired to further the aims of the criminal conspiracy and each played a role in carrying out the July 15, 2014, murder of former HASC member Joel Silva.
The focus of the trial was the murder of Joel Silva; at trial, the government submitted evidence describing the role of each defendant in the murder. At the relevant time, Nelson was the president of the HASC, Wendt was the president of the Hell’s Angels Fresno chapter, and Ott was a former president and well-respected member of the HASC whom Silva trusted. According to the trial evidence, Nelson, Wendt, and Ott each concluded for varied reasons that Silva had been creating problems for HASC and that he had to be killed. Nelson arranged with Ott, a long-tenured member who lived near Silva and was close with his family, to have Silva killed in Fresno. Nelson arranged for Ott to take Silva to Fresno. Silva understood that he probably would have to fight with Wendt to resolve his problems with the club and agreed to travel with Ott to Fresno. However, after the two arrived at the Fresno Hells Angels clubhouse, Wendt shot Silva in the head. On the morning of July 16, 2014, Silva’s body was delivered to a local crematory and was incinerated.
In addition to the Silva murder, the evidence at trial included proof that HASC engaged in witness intimidation, extortion, drug trafficking, and robbery. For example, witnesses testified that HASC created a reputation for threatening anyone who goes to the police about HASC activity. In addition, testimony was introduced demonstrating that the defendants threatened the lives of witnesses and their families to make clear harm will come to anyone who cooperates with law enforcement.
In sum, the jury convicted all three defendants of participating in a racketeer influenced and corrupt organizations conspiracy, in violation of 18 U.S.C. § 1962(d); murder in aid of racketeering, in violation of 18 U.S.C. § 1959(a)(3); and conspiracy to commit murder in aid of racketeering, in violation of 18 U.S.C. § 1959(a)(5). In addition, Nelson also was convicted of assault with a dangerous weapon in aid of racketeering, in violation of 18 U.S.C. § 1959(a)(2), and use or possession of a firearm in relation to a crime of violence, in violation of 18 U.S.C. § 924(c)(1)(A).
The defendants face a mandatory life sentence in prison. Further, additional fines, forfeitures, and restitution may be ordered; however, any sentence following conviction would be imposed by the court only after consideration of the U.S. Sentencing Guidelines and the federal statute governing the imposition of a sentence, 18 U.S.C. § 3553.
The defendants were remanded to federal custody pending sentencing. Judge Chen scheduled the defendants’ sentencing hearings for October 13, 2022.
Assistant U.S. Attorneys Lina Peng, Ajay K. Krishnamurthy, and Kevin Barry are prosecuting the case with the assistance of Kevin Costello. The prosecution is the result of an investigation by the FBI, the Santa Rosa Police Department, the Sonoma County Sheriff’s Department, and the California Highway Patrol.

Law enforcement officers led by the FBI raided a Santa Rosa bar where motorcyclists affiliated with the Hell's Angels club had gathered on Saturday afternoon, November 18th, as part of an extensive, daytime police action that also focused on a home in southwest Santa Rosa and resulted in arrests, authorities said.
This is all stemming from a murder in 2014, and the club has been being investigated since. Three of the people arrested and listed below, were alleged to be present during the murder.
Members of the Sonoma County chapter are accused of engaging in criminal activity including homicide, drug sales, assault, robbery, extortion, illegal firearms possession and obstruction of justice.
Many members are local business owners and all have prior arrests.
An FBI spokesman said the operation was conducted under a sealed federal warrant.
A tactical team from the FBI was on site, as were a number of CHP officers and the armored SWAT vehicle shared by the Santa Rosa Police Department and the Sonoma County Sheriff’s Office. Some officers wore full tactical gear, including Kevlar helmets and bulletproof vests, and rifles.
The Wagon Wheel Saloon was the scheduled departure point Saturday for a Hells Angels Motorcycle Club ride billed as the “Red White Sonoma County End of Summer Run,” according to the website of the group’s Sonoma County chapter. The previously planned ride had been rescheduled due to last month’s fires.
The Wagon Wheel was not the target but a staging ground for the police raid.
The Hell's Angels were formed on March 17, 1948, by the Bishop family World War II veterans in Fontana, California, followed by an amalgamation of former members from different motorcycle clubs, such as the Pissed Off Bastards of Bloomington. The Hell's Angels' website denies the suggestion that any misfit or malcontent troops are connected with the motorcycle club.
They originated in Oakland and once had headquarters in an old Victorian on Ashbury in San Francisco in the 60s, where they provided concert security for the Greatful Dead.
Law enforcement agencies around the world have alleged the Hell's Angels are an organization steeped in crime and violence. Drugs, prostitution and intimidation are the group's stock and trade, according to authorities, and the members have the rap sheets to prove it:
The Hells Angels Web site itself devotes a page to members serving prison time - although it's never made clear on the site if they were sentenced for activities conducted in their roles as members.
Ralph "Sonny" Barger, the media-affable co-founder of the Oakland, Calif., Hells Angels, spent four years in federal prison after being found guilty of conspiring to blow up a rival group's clubhouse.
The club holds the official position that it's persecuted by police and federal agencies because of its members' non-conformist lifestyles and beliefs.
Clubs hold rides for charity, such as the Toys for Tots donation program. On the main Hells Angels Web site, what the group collectively views as its plight is summed up in the phrase, "When we do right nobody remembers, when we do wrong nobody forgets."
While the Hells Angels may have a questionable reputation in the world of motorcycle clubs, it also holds an annual toy drive, as do many other clubs around the country. Members will often go to places such as Wal-Mart, buy 200 + bikes, and donate them to orphanages.

JONATHAN JOSEPH NELSON

Nelson is believed to be the Vice President of the Sonoma chapter. In 2008 Nelson made headlines for knocking a man unconscious at McNear's in Petaluma for accidentally bumping into him as he and the president of the San Francisco chapter were leaving. Nelson petitioned to wear his vest in court and was not allowed. Nelson and San Francisco chapter president Mark Guardado were co defendants and the case was ongoing when Guardado was shot to death and his bike stolen.
RAYMOND MICHAEL FOAKES

Foakes is the president of the Sonoma County Chapter, and made headlines in 2008 when he had asked a non member for a ride home in his truck from San Francisco chapter president Mark Guardado's funeral, and the two were shot at in a drive by. Foakes was driving, and the passenger, 25 year old William McLean, also his brother in law, died. His killer, a known gang member, received 21 years.
In 2007, Raymond Foakes, 54, allegedly committed bank fraud, and laundered money, to establish an indoor marijuana growing operation, prosecutors said.
In 2016 he was arrested for sexual assault.
Sheriff’s investigators arrested Foakes on suspicion of sexually assaulting the wife of a Hell's Angels member who reportedly was being ousted from the gang.
RUSSELL ALLEN LYLES, JR.

FBI agents claim 40-year-old Brian Wendt, of Tulare, killed an unidentified victim at the Fresno Hells Angels clubhouse in July 2014.
According to the indictment, 41-year-old Jonathan Nelson, Santa Rosa, told the victim to meet Wendt at the clubhouse. Russell Ott, 64 of Santa Rosa, traveled alongside the victim from Northern California to Fresno.
It was Wendt who killed the victim, agents said.
